HomeMy WebLinkAboutORD 579ORD 579ÜÂh£Ÿjì¾Ö¼IORDINANCE NO. 579 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING, BY REFERENCE, CERTAIN CODES, TO WIT: 1) THE UNIFORM BUILDING CODE, 1970 EDITION, VOLUME I"; 2) THE UNIFORM MECHANICAL CODE, 1970 EDITION, VOLUME II"; 3) THE UNIFORM BUILDING CODE, 1970 EDITION, VOLUME III, ENTITLED HOUSING1"; 4) THE UNIFORM PLUMBING CODE. 1970 EDITION; 5) THE UNIFORM BUILDING CODE, VOLUME V, ENTITLED SIGNS'; and 6) THE UNIFORM SWIMMING POOL CODE, 1970 EDITION. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 81RO, 8101 and 8102 of the Baldwin Park Municipal Code are hereby amended to read as follows: 8100. ADOPTION OF THE UNIFORM BUILDING CODE 1970 EDTTTOtT":—Subject to certain changes, deletions and amendments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt as the building regu- lations for said City the Uniform Building Code, 1970 Edition, Volume 1' copyrighted and adopted by the International Conference of Building Officials,) which said Code, consists of a published compilation of rules and standards, pertaining to the construction, alteration, repair, moving, demolition, conversion and maintenance of all building and structures. Said Uniform Building Code is made a part hereof as if set forth in full in this Chapter." 8101. SAME, AMENDMENTS TO CERTAIN SECTIONS OF THE UNIFORH^ILPTlTgrCgPE:—The following————— Sections of the Uniform Building Code hereafter Code'), adopted by Section 8101 hereof, are hereby deleted, as designated, or amended to read as follows: a) Section 202 f) Occupancy Violations. Whenever any building or structure is being used contrary to the provisions of this Code, the Building Official shall or4er such use dis- continued and the structure, or any portion thereof, shall be vacated by the person so using it. Such order shall be in writing, and shall be served upon such person by United States mail, postage prepaid, return receipt requested, addressed to such person at his last known address. Interpretation of Code. The City Council, upon the recommendation of the Building Official, shall determine the suitability of alternate materials, and types of construction, and shall provide any inter- pretation of any of the provisions of this Code which may be required in the interest of clarity The decision of the City Council with respect to any matter of interpretation or suitability of alternate materials and types of construction shall be made by majority vote of the Council and shall be final and conclusive. c) Section 302(e) Denial and Revocation. The Building Official sliall have the authority to deny the issuance of building permits or to revoke a building permit under the following circumstances: 1) Denia1. The Building Official shall deny any application for a building permit where the issuance would or could result in the violation of any provision of the Code or of the Baldwin Park Municipal Code, or if he should find that such issuance would be detrimental to the public welfare or safety. 2) Revocation. Whenever a building permit has been issued in error, or upon the basis of incorrect information supplied by the applicant, or in violation of any provision of this Code or of the Baldwin Park Municipal Code, the Building Official shall revoke the same. Revocation shall be accomplished by giving written notice thereof to the licensee by United States mail, postage prepaid, addressed to the licensee at his last known address. Said notice shall contain the basis for the action taken; revocation shall be effective 24 hours after the mailing of such notice. 3) Appeal. Such appeal shall be made in writing and filed with the City Clerk. Upon receipt of such appeal by the City Clerk, the matter shall be set for hearing before the City Council as soon as is practical. The City Clerk shall notify the applicant and all other persons requesting such notice of the time and place of such hearing. At such time and place of hearing, the City Council shall review the action of the Building Official and shall afford the applicant or any other interested petson a reasonable opportunity to be heard in connection therewith. If the City Council finds that the action taken is reasonable and in con- formity with the provisions of this Code, it shall uphold the decision of the Building Official. If such finding is not made it shall reverse the decision of the Building Official. The action of the City Council shall be final and conclusive, d) Section 306 c) Certificate Issued. When it is found that a structure complies with the provisions of the Municipal Code and with State Law, the Building Official shall issue a Certificate of Occupancy, e) Section 306 d) Temporary Certificate. A temporary certificate of occupancy may be issued by the Building Official for the use of a portion of a building prior to the completion of the entire building upon the application for a thirty 30) day temporary clearance for connection of the utilities and the payment for the addi- tional inspection is a $15.00 fee. If the building is not completed and ready for final inspection in the time prescribed by the Building Official, the building shall be vacated and utilities disconnected until such time that the building is completed, final inspection is made and a certificate of occupancy is issued,, f) Section 306 g) Fees. The original Certificate of Occupancy for a new building shall be issued without a fee. For the purposes of this Code, all properties within the City are hereby declared to be in the following: 1) All properties classified, pursuant to the City's zoning regulations in a C' Zone, shall be included in Fire Zone 2. 2) All other properties shall be included in Fire Zone 3." 8102. DEFINITIONS. Whenever any of the following names or terms are used in said Uniform Building Code or in this Municipal Code, each such name or term shall be deemed and construed to have the meaning ascribed to it in this Section as follows: a) Building Official' shall mean the Director of Pub tic Works. b) Fire Department' shall mean the Fire Prevention Bureau of Los Angeles County. SECTION 2. That Section 8195 of the Baldwin Park Municipal Code is hereby added to read as follows: 8195. ADOPTION OF THE UNIFORM SWIMMING POOL CODE, IgTPTi&tT ION'.—The City Council of the City of Baldwin Park does hereby adopt as the swimming pool regulations for said City the Uniform Swimming Pool Code, 1970 Edition', which said Code consists of a published compila- tion of rules and standards for the construction and repair of swimming pools. Said Swimming Pool Code is made a part hereof as set forth in full in this Chapter, Notwithstanding the adoption of said Code, Section 1,8 thereof is hereby deleted. Permit fees with reference to said Code, shall be required in the time and manner as set forth in the Uniform Building Code adopted pursuant to Section 8100 et seq. hereof." SECTION 3. ADOPTION OF THE UNIFORM PLUMBING CODE, 1970 EDITION.Subject to certain changes, deletions and amendments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt, as the plumbing regu- lations for said City the Uniform Plumbing Code, 1970 Edition" which said Code consists of a published compilation of rules and standards, pertaining to the regulation of plumbing within the City. Said Uniform Plumbing Code is made a part hereof as if set forth in full in this Chapter." 8201. SAME. AMENDMENTS TO CERTAIN SECTIONS OF TmrPtoORM PLUMBIHC CgPgT^The following Sections of the Uniform Plumbing Code hereafter Code'), adopted by Section 8200 hereof, are hereby deleted, as designated, or amended to read as follows: a) Section 1.1. Administrative Authority. Whenever in the Plumbing code, reference is made to City', it shall mean the City of Baldwin Park; whenever said Code refers to Admin- istrative Authority', such reference shall mean the City's Building Official, b) Sections 1.2 and 1.3 of said Code are hereby deleted. SECTION 4. That Sections 8225 and 8226 of the Baldwin Park Municipal Code are amended to read as follows: 8225. ADOPTION OF THE UNIFORM MECHANICAL COT5E"T IV 70 IBPITICTT^——Subject to certain changes, deletions and amendments, as hereinafter set forth, the City Council of the City of Baldwin Park does hereby adopt as the mechanical regulations for said City the Uniform Mechanical Code, 1970 Edition, Volume II, Uniform Building Code' copyrighted and adopted by the International Conference of Building Officials), which said Code consists of a published compilation of rules and standards, pertaining to the construction, alteration, repair and maintenance of all mechanical equipment in the City. Said Uniform Mechanical Code is made a part hereof as if set forth in full in this Chapter." 8226. SAME. AMENDMENTS TO CERTAIN SECTIONS OF TrorONlIJORM MECHANICAL COPE"~ The following Section of the Uniform Mechanical Code hereafter Code'), adopted by Section 8225 hereof, is hereby amended to read as follows: 5- BIB] 37946-U01 ORD-U02 579-U02 LI2-U03 FO31549-U03 FO31610-U03 DO31628-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 579ÜÂh£Ÿjì¾Ö¼IORDINANCE NO. 579 Section 203. Board of Appeals. In order to determine the suita- bility of alternate materials and types of construction and to provide for reasonable interpre- tations of the provisioris of this Code, the City Council shall act as the Board of Appeals." SECTION 5. That Section 8400 of the Baldwin Park Municipal Code is hereby amended to read as follows: 8400. ADOPTION OF THE UNIFORM BUILDING CODE", IV/0 EDITION. VOLPHTT.' ENTITLED 515^8.' The City'Couricil oj the city of Baldwin Park does hereby adopt as the building regulations for said Cicy, the Uniform Building Code, 1970 Edition, Volume V,1 entitled Signs', which said Code consists of a published compilation of rules and standards, pertaining to the construction, alteration, repair, demolition and maintenance of all signs in said City, Said Uniform Building Code, Volume V, is made a part hereof as if set forth in full in this Chapter." SECTION 60 That Section 8500 of the Baldwin Park Municipal Code is hereby amended to read as follows: 8500. ADOPTION OF THE UNIFORM BUILDING CODE", 19/0 EMTION, VOLDHniI, EHTTTLED HOUSING'. The Ci£y Council of tHe City o£ Baldwin Park does hereby adopt as the housing maintenance regulations for said City the Uniform Building Code, 1970 Edition, Volume III, Housing Code copy- righted and adopted by the International Conference of Building Officials) which said Code consists of a published compilation of rules and standards, pertaining to the housing in the Cityo Said Housing Code is made a part hereof as if set forth in full in this Chapter." SECTION 7. PUBLIC INSPECTION OF CODES, That three 3) copies of each code adopted by this Ordinance are available for public inspection in the City Clerk's office and have been so available for fifteen 15) days prior to the public hearing relating to this Ordinance. SECTION 8. VIOLATIONS, A MISDEMEANOR. No person shall violate any provision, or tall to comply with any of the requirements of this Ordinance or any Code adopted hereby. Any person in violation of any of the provisions of this Ordinance, shall be guilty of a misdemeanor. Any person convicted of a misdemeanor under the provisions of this Ordinance, shall be punishable by a fine of not more than Five Hundred $500.00) Dollars or by imprisonment in 6 BIB] 37946-U01 ORD-U02 579-U02 LI2-U03 FO31549-U03 FO31610-U03 DO31628-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 579ÜÂh£Ÿjì¾Ö¼IORDINANCE NO. 579 the City or County Jail for a period not exceeding six 6) months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this Ordinance is committed, continued or permitted by such person and shall be punishable accordingly In addition to the penalties hereinabove provided, any condition caused or permitted to exist in violation of any of the provisions of this Ordinance and/or Code adopted hereby, shall be deemed a public nuisance and may be, by this City, summarily abated as such and each day such condition continues shall be regarded as a new and separate offense. SECTION 9. That the City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law.
