HomeMy WebLinkAboutORD 574ORD 574ÜÂh£Ÿj쾺¼IORDINANCE NO. 574 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE ZONING REGULATIONS OF SAID CITY RELATING TO ON-PREMISE SIGNS, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 9551.9b; 9561b; 9570.2; 9590.4; 9601 E; 9611 E and 9633 of the Baldwin Park Municipal Code are hereby repealed and rescinded. SECTION 2. That Division B, entitled On-Premise Sign Regulations", consisting of Sections 9830 through 9839, inclusive, is hereby added tb Chapter XXI of Article IX of the Baldwin Park Municipal Code, to read, respectively, as follows: DIVISION B ON-PREMISE gIGN REGULATIONS" 9830. PURPOSEo The purpose of the provisions contained in this Division is to establish a comprehensive set of regulations applicable to the construction and main- tenance of on-premise signs within the City of Baldwin Park. 9831. DEFINITIONS. In addition to the definitions contained in Section 9420 et seq, hereof, for the purpose of this Division, the following words or phrases shall be defined as follows, unless it is apparent from the context that another meaning is intended: 1) Animated Sign shall mean a sign with action or motion, flashing, color changes requiring electrical energy, electronic or manufactured sources of supply, but not including wind activated elements such as flags, banners, or specialty items, 2) Background Sign Area shall mean the entire background area of a sign upon which copy can bo placed. 3) Building Department shall mean the Building Department of the City of Baldwin Park. 4) Building Facade shall mean that portion of any exterior elevation of a building adjacent to or oriented to a public right-of-way which extends from grade' to the top of the parapet wall or eaves and includes the entire width of said building elevation. Compilation of area of building facade shall include ali window and doorway openings. BIB] 37946-U01 ORD-U02 574-U02 LI2-U03 FO31548-U03 FO31623-U03 DO31622-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 574ÜÂh£Ÿj쾺¼IORDINANCE NO. 574 5) Canopy shall mean and include a structural, ornamental, roof-like appendage, freestanding or attached to a building., including roof overhangs, but excluding awnings or metallic hooks. 6) Changeable Copy Sign shall mean a sign which is characterized by changeable copy. 7) Directional Sign shall mean inc identa1 signs, freestanding, ground, or wall signs designed to guide or direct pedestrian or vehicular traffic to a given location, which does not include thereon any advertising material, 8) Director shall mean the Planning Director of the City of Baldwin Park. 9) Freestanding Sign. A sign which is supported by one or more columns, uprights, or braces in or upon the ground. 10) Height of Sign shall mean the vertical distance measured, unless otherwise specified, from the average finished grade of the lot frontage to the highest point of the sign. 11) Illuminated Sign. A sign which uses a source o£light in order to make readable the message and shall include internally or externally lighted signs, reflectorized, glowing or radiating signs, 12) Lot Frontage shall mean that portion of the lot adjoining a public right-'- of-way, 13) On'Premise Signs are those which advertise any of the uses conducted on the lot where the sign is located, 14) Permanent Sign^ shall mean and include every sign except temporary signs" as defined herein. 15) Portable Sign shall mean any sign not permanently attached to the ground or any structure. This type of sign includes the A-Frame" or Sandwich" sign, a sign board on wheels, a sign which leans against a stationary object or support, and any sign that can be moved readily, 2- BIB] 37946-U01 ORD-U02 574-U02 LI2-U03 FO31548-U03 FO31623-U03 DO31622-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 574ÜÂh£Ÿj쾺¼IORDINANCE NO. 574 16) Poster Sign shall mean a temporary sign printed on paper, cardboard or similar material which is generally displayed in windows or attached to trees, poles, buildings or staked in the ground. 17) Rea1 Es ta t e Sign shall mean a temporary sign indicating t^iat the lot on which the sign is located, or any building or structure located thereon, is for sale or lease. 18) Revolving Sign. A sign which resolves three hundred sixty 360) degrees, at not to exceed eight 8) revolutions per minute. 19) Roof Sign shall mean sign erected upon or above a roof or parapet wall of a building or structure, no portion of which shall exceed a height of ten 10') feet above the average height of the parapet walls of the building, or if no parapet walls, the average height of the roof. 20) Sign shall mean any writing including letter, word or numeral), pictorial presentation including illustrations or decorations), emblem including device, symbol or trademark), or any other similar device which; a) is used to announce, direct attention to, advertise or promote the interest of any person, business, group or enterprise; and f b) is visible from outside the building or structure; and c) directs attention to a principle business, profession or industry located upon the premises where the sign is displayedo 21) Temporary Sign shall mean and include any sign constructed of paper, cloth, canvas, or other similar lightweight material, with or without frames, including but not limited to, painted windows, intended to be displayed for a period not to exceed ninety 90) days, in any twelve 12) month period. 22) Wall Sign. PERMITS. No person shall erect, construct or alter any sign at any location within the City, without first obtaining a sign permit therefor, from the Building Department., Such permits shall not be required for signs referred to in Section 9833 hereof, nor for signs permitted in any of the R1 Zones, 9833. SIGNS PERMITTED IN ALL ZONES, Notwithstanding any other provision of this Division, the following signs shall be permitted on any property within the City: a) A sign required by law; b) A sign owned by a governmental agency; c) Temporary political signs, pro- vided that the owner and/or occupant of the lot, or building or structure where the same are located, shall remove each such sign within 90 days after its location, or within 7 days after the election to which it relates, whichever occurs first; d) Temporary real estate signs, relating only to the lot on which it is located, provided that the size thereof shall not exceed six 6) square feet in total background sign area; e) Public utility including mutual water companies) signs customarily utilized in conjunction with the lawful performance of the utility's function; f) Subdivision tract signs, provided; 1) no such sign shall have more than eighty 80) square feet of background sign area nor exceed a height of twenty 20) feet from finished grade, if freestanding; 2) the same is utilized only in connection with the sale of lots or dwelling units in the subdivision to which it relates; 4- BIB] 37946-U01 ORD-U02 574-U02 LI2-U03 FO31548-U03 FO31623-U03 DO31622-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 574ÜÂh£Ÿj쾺¼IORDINANCE NO. 574 3) that any such sign shall be removed within thirty 30) days after the last lot in the tract to which it relates is sold for the first time, or a period of one I) year after erection of such sign, whichever occurs first; 4) not more than one I) such sign shall be permitted for a subdivision; 5) that at the time of the approval of any tentative subdivision map, the owner and/or developer shall deposit the sum of $500 with the City, or in an appropriate time deposit, to insure that upon the expiration of the time permitted for the removal of said sign, said sign shall, in fact, be so removed; if the subdivider fails to remove such sign within such time, the funds so deposited shall be utilized for the City to enter upon the property upon which the sign is located, without notice to the owner and/or developer, to remove such sign, the cost of which shall be charged against the said deposit and the balance of said deposit shall be refunded to said depositor. g) One 1) construction sign may be located on a lot where a building or structure is being erected, provided: 1) that such sign identifies the architects, engineers or the contractor involved in the construction process; 2) that no such sign shall exceed a background sign area of 32 sq. feet, nor exceed a height of twelve 12') feet from finished grade, if freestanding; 3) such si^ns shall be removed within fourteen 14) days after completion of construction, as dcterniinc'd hy the City's records relating thereto. 5- BIB] 37946-U01 ORD-U02 574-U02 LI2-U03 FO31548-U03 FO31623-U03 DO31622-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 574ÜÂh£Ÿj쾺¼IORDINANCE NO. 574 h) Private traffic control signs directing, controlltng or pro- hibiting the flow of pedestrian or vehicular traffic; provided no such sign shall exceed three 3) square feet in background sign area. 9834. PROHIBITIONS. a) Projecting Sign: No sign shall project more than eighteen 18) inches from the face of the building or structure to which it is attached. b) Nature of Sign Copy. No sign shall be permitted unless it advertises a product or service which is available on the premises where such sign is located. 9835. SIGNS IN RESIDENTIAL ZONES. The following signs shall be permitted in the R-l, R-2 and R-3 Zones, provided that the same conform to the following provisions: a) R-l and R-2 Zones. Name plate signs, not in excess of two 2) square feet in background sign area, which display only the name of the property owner, or occupant and/or the address of the site. b) R-3 Zone. The following signs shall be permitted in th^ R-3 Zone: 1) Name Plate Signs. Not to exceed two 2) name plate signs, pro- vided the same do not exceed two 2) square feet in background sign area, which display only the name of the property owner or occupant and/or the address of the site. 2) Name SignSo One 1) sign which states the name of the building or its owner, which is an integral part of the building; provided that no such sign shall exceed a background sign face area of thirty 30) square feet, 6- BIB] 37946-U01 ORD-U02 574-U02 LI2-U03 FO31548-U03 FO31623-U03 DO31622-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 574ÜÂh£Ÿj쾺¼IORDINANCE NO. 574 3) Permanent Signs. Two 2) Permanent signs containing leasing information provided such signs shall not exceed six 6) square feet of background sign face area each. 9836. SIGNS IN COMMERCIAL ZONES. No person shall erect, install or maintain, or allow the erection, installation or maintenance of any sign or signs upon any building, structure or lot in C-P, C-l, C-2 or a C-M Zone, except in accordance with the following standards: 1) TYPES OF SIGNS PERMITTED IN THE C-P ZONE: a) Frees tand ing S igns. One 1) freestanding sign per lot, containing not more than one 1) square foot of background sign area for each lineal foot of property frontage and not more than tweity 20) feet in height. b) Wall Signs. One 1) wall sign for each use permitted on a lot, each having a background sign face area not in excess of twenty 20) percent of the building facade upon which it is located. c) Roof Signs. 1) Number. Subject to the provisions of Section 9838 5) hereof, one 1) roof sign shall be permitted in lieu of sign permitted pursuant to Subparagraph a) hereof. ii) Sign Face Area. No permitted roof sign shall exceed fifty 50) percent of the total background sign face area permitted for a wall sign. iii) Height. No roof sign shall exceed an overall height in excess of ten 10) feet above the height of the building roof line to which it is attached. 2) TYPES OF SIGNS PERMITTED IN THE C-l ZONE: a) Freestanding Signs. One 1) freestanding sign for each lot. The background sign face area of such sign shal1 not exceed one 1) square foot for each lineal tool of property frontage', nor shall the same exceed thirty-five 35) feet- in height. One 1) wall sign tor each ufie permitted on the lot, each of which may have a background sign face area of not to exceed thirty 30%) per cent of the building facade upon which it is lofcated. i) Where a use has a main entrance in more than one 1) wall of a building facing a street, each such building wall may contain one 1) additional wall sign, subject to the same size limitations as prescribed above. ii) Where a.use has a building wall facing a street, which does not have a main entrance therein, such building wall may contain one 1) additional wall sign not exceeding twenty 20%) per cent of the surface of the building facade on which it is located. c) Roof Signs. i) Number-p Subject to the provisions of Section 9838 5) hereof, one 1) roof sign shall be permitted in lieu of a sign permitted pursuant to Subparagrapli a). ii) Sign Face Area* No permitted roof sign shall contain *aure than fifty 50) percent of the background sign face ar<>a permitted for a wall sign pursuant to Subparagraph b) hereof, iii) Height. No roof sign shall exceed an overall height in excess of ten 10) feet above the height of the building roof line to which it is attached. 3) TYPES OF SIGNS PERMITTED IN C-2, C-M_AND M-RZONES a) Freestanding Signs. 1) Number. For lots tiaving more than one 1) legally established use thereon there shall be permitted to be placed upon a free- standing sign a changeable copy sign for the purpose of advertising the said uses, provided further that such area of the changeable copy sign face area shall not exceed forty 40) square feet. b) Wall Signs. Ono 1) wall sign for each use permitted on t'hc lot, each having a background sign face area not in excess of thirty 307o) per cent of the building facade upon which it is locatedo i) Where a use has a main entrance on more than one 1) wall of a building facing a street, such building side may contain one 1) additional wall sign, subject to the same siz^ limitations as prescribed above. ii) Where a use has a building wall facing a street, which does not have a m^in entrance therein, such building wall may contain one 1) additional wall sign not exceeding twenty 20%) per cent ot the surface of the- huilclinp, facade upon which it is located. 9- BIB] 37946-U01 ORD-U02 574-U02 LI2-U03 FO31548-U03 FO31623-U03 DO31622-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 574ÜÂh£Ÿj쾺 ¼IORDINANCE NO. 574 c) Roof Signs. i) Number. Subject to the provisions of Section 9838 5) hereof, one 1) roof sign shall be permitted pursuant to Subparagraph a) hereof. it) Sign Face Area. No permitted roof sign shall contain more than fifty 50) percent of the background sign area permitted for a wall sign pursuant to Subparagraph b) hereof. ill) Height. No roof sign shall exceed an overall height in excess of ten 10') feet above the height of the building roof line to which it is attached. d) Marquee and Awning Signs. One 1) marquee or awning sign shall be permitted on a building on any lot; provided that no such awning sign shall exceed two 2) square feet in background sign area; and further provided that no marquee sign shall have in excess Of fifty 50) square feet of background face area. i 9837. TYPES OF SIGNS PERMITTED IN THE M>1 AND ZONES, a) Freestanding Signs. 1) Number. The number of free- standing si^ns permitted on any M-l or M-2 zoned lot shall be determined as follows: a) one 1) freestanding sign \ of not to exceed one 1) square foot of background sign face area for each lineal foot of property frontage. 2) Size. The overall height or any freestanding sign shall not exceed sixty 60') feet; provided that no freestanding sign shall exceed a height of forty-five 45') feet if the same is located within six hundred sixty 660') feet of any freeway or adopted freeway route, b) Wall Signs. 1) Number. One 1) wall sign shall be permitted on each exterior wall of a building which has a main entrance, 2) Size. The background sign Tace area of any permitted wall sign shall not exceed an area equal to thirty 30%) per cent of the wall area of the building facade on which located, or three hundred 300) square feet, whichever is lesser. p) Roof Signs. 1) Number. Subject to the provisions of Section 9838 5) hereof, one 1) roof sign shall be permitted in lieu of a gign permitted pursuant to Sub- paragraph a) hereof. 2) Sign Face Area. No permitted roof sign shall contain more than fifty 50) percent of the background sign area permitted for a wall sign pursuant to Subparagraph b) hereof. 3) Height. No roof sign shall exceed an overall height in excess of ten 10) feet above the height of the building roof line to which it is attached. 9838. SPECIAL SIGN PROVISIONS. 1) Location. No sign placed on any C' or M' zoned property shall be located withiq fifty 00) feet of the lot line of such lot, which lot line is a common lot line of any R' zoned lot, if the Sign Face area is oriented toward such R' Zoned lot. 2) Window Signs. Permanent signs placed on or in any window shall not cover more than twenty 20%) per cent of the total area of such window. 13 BIB] 37946-U01 ORD-U02 574-U02 LI2-U03 FO31548-U03 FO31623-U03 DO31622-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 574ÜÂh£Ÿj쾺 ORD 574ÜÂh£Ÿj쾺 ¼IORDINANCE W. 574 b) that the proposed location of such sign will not interfere with free and reasonable access of light and air to adjacent properties; and c> that such proposed location will not unreasonably inter- fere with the peaceful use, possession and enjoyment of such adjacent properties, nor constitute a public or private nuisance; and d) that the public peace, health and general welfare will not be adversely affected by the granting of the permit as requested; and e) that a freestanding sign cannot be placed on the lot by reason of the regulations contained in this Division. The Director may impose reasonable conditions of approval upon such permit, to insure compliance with the provisions and^ purpose of this Section, in the absence of an appeal filed in the time and manner as hereinafter specified. Any person aggrieved by the decision of the Director with regard to the roof sign permit shall have the right of appeal to the City Councilo Such appeal shall be timely filed only if filed with the City Clerk within ten 10) days after the deposit of the notice of the Director in the course of transmission of the United Scales Postal System,, Thereafter, the City Council shall conduct an informal hearing upon said application and shall reverse, affirm or modify the decision of the Director. The decision of the Council shall be based upon the factors as set forth in this said Paragraph, The decision of the City Council shall be final and conclusive. 5) Revolving Signse Subject to the provisions of this Division, freestanding and wall signs may, in whole or in part, be revolving, 13- BIB] 37946-U01 ORD-U02 574-U02 LI2-U03 FO31548-U03 FO31623-U03 DO31622-U03 C5-U03 ORDINANCES-U03 11/20/2003-U04 ROBIN-U04 ORD 574ÜÂh£Ÿj쾺¼I ORDINANCE NO. f>74 6) Animated Signs. No animated sign shall be permitted on any lot, building or structure, except for time and temperature signs. 7) Accessory Signs. All accessory signs i.e., such as price, rime and temperature, hours of operation, credit cards, special sales event signs) shall be included in the total allotted background sign area permitted for the lot or use to which said signs relate. Provided further that each accessory sign shall not exceed a total back- ground sign area of twenty 20) square feet. 8) painted Signs. No painted sign copy shall be permitted to be placed upon any portion of a building or structure. 9) Sign Lighting and Illumination. All signs, with respecc to lighting and illumination, shall be arranged, operated, shielded and maintained so as to prevent any glare or reflection, nuisance, inconvenience and/or hazardous interference of any kind to abutting or adjacent properties and/or streets. 9839. NEW, EXISTING AND NON'CONFORMING SIGNS. 1) Non-ConForminfi Signs. a) Amortize^ ti on. As of the et tec Live date of the regulations contained in this Division, all non-conforming signs shall be abated and removed, or made to comply with the provisions of this Division within five 5) years b) Commencement of Abatement Periods. The abatement andremoval periods, as set forth above, 3hall commence to run, in all cases, from the time that an affected sign becomes non-conforming by reason of the application thereto of the provisions of this Division, c) Manner of A ba t ement. Abatement of non-conforming signs shall be accomplished in accordance with Section 9520 et seq. of the Baldwin Park Municipal Code. d) Add it iona 1 Sign Amort izat ion Provisions.All signs rendered non-c ontorming by reason of this Code, if located upon a structure proposed to be remodeled or rehabilitated, where the cost of the remodeling or rehabilitation is one thousand 1,000) dollars or more, shall be removed or made to conform to the provisions of this Code. 14. No person shall erect, Install, maintain any sign in place after the use to which it relates has been removed, discontinued or abandoned; any such sign shall be removed within not to exceed ninety 90) days after the date such use was abandoned or discontinued. If a sign, to which the provisions of this Sub- paragraph applies, otherwise complies with all of the development standards set fofth in this Division, the same need not be removed if the sign face area is painted out, and not again utilized until a new use of the lot upon which it is located is lawfully commenced. 3) Signs Approved B4 Conditional Use Permit Or Variance. Notwithstanding any other provision of this Division, all on-premise signs existing upon the effective date of this Part, which were authorized by a zone variance or a conditional use permit, shall not be deemed to be non-conforming by reason of the application thereto, of the provisions of this Division." SECTION 3. That the City Clerk shall certify the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law. Automobile service station signs shall be subject to the provisions of Section 9650 et« seq. hereof, exclusively. A) Roof Signs. Permit Required, a) Roof Signs. Status, All roof signs In existence as of the effective date of this regulation shall be deemed to be non-conforming. Notwithstanding any other provision of this Article, such non-conforming roof signs shall be removed within five 5) years after the effective date hereof subject to the procedure set forth in Section 9520 et seq. hereof), or, that the owner, or person in possession of the property on which such roof sign is located, shall within said period of time, obtain a permit for such roof sign, in the manner hereinafter described. y b) Permit Required, No person shall erect/ construct, reconstruct or maintain, nor shall the owner of any real property located within the City, permit or allow the erection, con- struction, reconstruction or main- tenance of a roof sign, without obtaining a permit therefor, as required by the provisions hereof. 1) Application. Any person desiring to erect, construct, reconstruct or maintain a roof sign, shall file an application therefor, with the Director, upon^ a form provided by him for that purpose, 2) Director's Action.
