AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK AMENDING
CERTAIN OF THE CITY'S ZONING
REGULATIONS URGENCY ORDINANCE)•
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
ORDAIN AS FOLLOWS:
SECTION 1. That Section 9422 of the Baldwin Park
Municipal Code is hereby amended by adding thereto, as
Subparagraph 2a) the following:
2a) Bedroom shall mean any room
in a dwelling unit, however
designated^ other than a
living roon, dining room,
kitchen, bathroom, utility
room and hallway,
SECTION 2. That Subparagraphs 4)(c) and 4)(d) of
Section 9522 of the Baldwin Park Municipal Code are hereby
amended to read, respectively, as follows:
c) 3 bedroom family units 1150 sq. ft."
d) 4 bedroom family units 1300 sq. ft."
SECTION 3. That this Ordinance is hereby declared to
be an urgency ordinance, and shall take effect immediately
upon its adoption. A statement of facts constituting its
urgency is as follows: that many R-l type structures are
now being built which have been described as being 2 bed-
rooms and den"; in fact, these are 3 bedroom houses and
are designated as 2 bedrooms and den" in order to be
constructed with less than 1,300 sq. ft; that the amendment
to Section 9422 of the Baldwin Park Municipal Code, above
described, is necessary to prevent further construction of
units which are, in fact, 3 bedroom and which are designated
as 2 bedrooms and den type units; that in the course of
reviewing the problem concerning the definition of Bedroom"
the City Council has preliminarily determined that the
requirements of the minimum of 1,300 sq. ft* of gross floor
area for 3 bedroom units and 1,450 sq. ft. of gross floor
area for 4 bedroom units is excessive and is hindering the
growth of single family dwelling units in the community;
that the Planning Commission is currently studying the
question of such minimum gross floor area and pending the
conclusion of that study this ordinance is immediately
required to preserve the public peace, health and safety.
SECTION 4. That the City Clerk shall certify the
adoption of this Ordinance and cause the same to be
published in the manner prescribed by law,
PASSED AND APPROVED this 15th day of September
1971.
