AH ORDIHARCE OF THE CITY COUHCIL OF
THE CITY OP BALDWIN PARK GRANTING A
FRANCHISE FOR A COIMOnTT ANTENNA
TELEVISION STSIBI.
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
ORDAIN AS FOLLOWS:
SECTION I. That the City Council of the City of
Baldwin Park does hereby find, determine and declare, as
follows:
a) That the City Council has con-
sidered applications for community antenna
television systems hereinafter referred to
as CATV") from a nunber of companies; and
b) That as a result of studies of
necessity required the grant of a franchise
for CATV purposes to Tbeta Cable of Cali-
fornia. a corporation hereinafter referred
to as Grantee"); and
c) That representatives of Grantee
have examined the provisions of Section 6650
et seq. of the Baldwin Park Municipal Code
and have represented to the City that they
are thoroughly familiar with the provisions
thereof; and
d) That the grant of this non-exclusive
CATV franchise, within the boundaries of the
City, is in the public interest.
SECTION 2. That Grantee is hereby granted a non-
exclusive franchise for the purpose of constructing and
maintaining a community antenna television system, as
defined in Section 6650 et seq. of the Baldwin Park Municipal
Code, upon the following terms and conditions:
a) TERM, The term of this franchise
shall be for a period of ten 10) years from
and after the effective date of said franchise;
and
b) BATES, The rate structure as proposed
by Grantee in Its October 9, 1970 application on
file with the City Clerk of said City, as set forth
cm Pages 18 through 21, inclusive thereof, be, and
the same hereby is, approved.
There shall be no alteration in said rate
structure except by approval of the City Council
of City, expressed by resolution adopted by not
less than three affirmtive votes thereof: aad

c) FRAHCfflSE PAYIgBTS, Franchise pay-

per cent of Grantee's gross receipts or One
Thousand Two Hundred Dollars $19200) per year,
whichever fs the greater, during the term
hereof, shall be due annually in the manner
prescribed in Section 6655 of the Baldwin Park
Mmicipal Code; and
d) COHFOBMAHCE TO LAWS, This franchise
is granted upon condition that the Grantee, at
all times during the term hereof, shall couply
with all applicable laws. Including, but not
limited to. Section 6650 et seq. of the Baldwin
Park Municipal Code; and
e) AGHCT, Within not to exceed ten 10)
days after the effective date of this ordinance,
Grantee shall, in writing, advise the City
Manager as to the officer or employee of Grantee
to whom written notices shall be given on behalf
of Grantee, relating to the operations of
Ck-antee hereunder.
SECTION 3. The City Clerk shall certify the adoption
hereof and cause the same to be published in the manner
prescribed by law. The said City Clerk shall forward to
the Grantee a certified copy of this Ordinance
PASSED AND APPROVED this 1st day of December
1971.
