AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CERTAIN OF THE CITY'S ZONING REGULA- TIONS WITH REFERENCE TO ZONES C-M, M-R. M-l AND M-2 CASE NOS. AZC-56, 57. 58 AND 59). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Part XVIII of Article IX, entitled Service Station Regulations", of the Baldwin Park Zoning Code, consisting of Sections 9650 through 9655, inclusive, is hereby redesignated as Part XIX of said Article IX, entitled Service Station Regulations", and said Sections 9650 through 9655, inclusive are hereby renumbered as Sections 9700 through 9705. inclusive, of said Code. SECTION 2. That Section 9700 of the Baldwin Park Zoning Code is hereby renumbered as Section 9409, thereof. SECTION 3. That Part XVIII of Article IX of the Baldwin Park Zoning Code, consisting of Sections 9650 through and including Section 9654, is hereby adopted to read as follows; PART XVIII DEVELOPMENT STANDARDS, INDUSTRIALLY CLASSIFIED PROPERTIES 9650. Application of Part* The provisions of this Part shall apply to the development, and re- development of all real property within the boundaries of the City which is classified in Zones C-M. M-R, M-l, or M-2, hereafter lot". 9651. Purpose of Part. The purpose of the adoption of the provisions of this Part is to establish a set of standards for the development, redevelopment and continued usage of industrially zoned properties within the City. so as to render the same compatible with surrounding and adjacent existing and permitted uses of other properties. 9652. Standards for New Lots. 1) Minimum lot area. The minimum lot area of any such lot which is created after the effective date hereof, shall be not less than 10,000 square feet. 2) Minimum lot width. The minimum lot width of any such lot which is created after the effective date hereof, shall be not less than 75 feet. 9653. Standards for Construction. 1) Required yard areas. Each such lot shall observe the required yard areas shown on the diagrams attached hereto and incorporated herein by this refer- ence, marked Exhibit A". 2) Building height. The maximum height of any building or structure located upon such lot shall be 50 feet. provided that if any such building or struc- ture is located within 100 feet of any R" zoned property, the maximum height thereof shall not exceed 35 feet. 3) Residential units. No residential building or unit located upon any such lot shall be converted to an industrial use. Standards for Maintenance and Operation* 1) Uses within an enclosed building. All uses, principal and accessory, on such lots, shall be conducted and maintained completely within an enclosed building except: a) For those uses customarily conducted out of doors; and b) Off-street parking and/or loading facilities; and c) Storage of materials, 2) Toxic matter,. No person shall, for any period of time, permit or allow the discharge of toxic, noxious or odorous matter from such lots in such con- centrations which is, or may be detrimental to the public health, safety or welfare, or injury or damage to adjacent and abutting properties or uses. 3) Glare and heat. Any operation producing intense glare or heat on such a lot shall be performed only within an enclosed building and in such a manner as not to create a public nuisance or hazard to the adjacent or abutting properties. 4) Open storage and/or trash areas. No outside storage and/or trash area shall be located on any such lot unless the same is completely enclosed with a masonry wall or view obscuring fence, the mini- mum height of which shall be six feet. Access gates thereto shall be view obscuring. No part of such an area shall be utilized for the purpose of fulfilling any of the off-street loading and/or parking require- ments of this Code. No materials shall be stored in such an area so as to be visible above the required fencing, if such storage would be unsightly from ad- jacent or abutting properties or a public street. 5) Required yard areas adjacent to streets. Each required yard area, which is adjacent to a street, shall be landscaped and continuously maintained. 6) Walls. A six 6) foot high solid masonry wall shall be constructed and maintained on each pro- perty line of any such lot which abuts any R" zoned property except that on lot lines which abut front yards of an R" zoned lot, said wall shall not exceed a height of thirty-six 36") inches. 7) Lighting. Exterior lighting located upon such a lot shall be directed away from any abutting or adjacent R" zoned property in such a manner as not to constitute a nuisance to the adjacent R" zoned property* W Si^ns. Signs located upon any such lot shall be erected, constructed and maintained in ac- cordance with the provisions of Section 9830 et seq. hereof. 9) Off-street parking and loading facilities. No portion of any loading facility shall be located within 20 feet of a lot line of any R" zoned lot. All off-street parking and loading facilities shall be constructed, instal- led and maintained in accordance with Section*9500 et seq. hereof. Notwithstanding any other provision of this Code with reference to nonconformity of uses, buildings or struc- tures, each use, building and/or structure located upon any such lot, as of the effective date of this Part, shall comply with the provisions of Section 9652, 9653, and 9654 as required, and within the times hereinafter set forth in this Section: 1) With reference to the Operation and Main- tenance Standards" set forth in Subparagraphs 1 through 7 of Section 9654, each use, building and/or structure located upon any such lot, shall comply with the pro- visions of said Subparagraphs within a period of one 1) year from and after the effective date of the pro- visions of this Part. 2) With reference to the New Lot Standards" and Construction Standards", set forth in Section 9652 and 9653, no use, building or structure which was in existence as of the effective date of the regulations set forth in this Part, and which conformed to the former Zoning Regu- lations applicable thereto, shall be deemed non-conforming by reason of a failure to comply with said subparagraphs. 3) Notwithstanding any other provision of this Part, any development which involves construction of new buildings or structures, or the commencement of a new use, shall comply with all of the provisions of this Part inso- far as such new construction and/or new uses are concerned. 9654. Abatement of Nonconformins} Use. The Abatement of nonconforming uses, buildings or structures in accordance with the provisions of this Part shall be pro- cessed and accommodated in the manner set forth in Section 9520 et seq. of this Code. SECTION 4. That Sections 9621, 9622, 9623. 9624, 9628, 9632, 9633, 9634, 9635, 9642, 9643 and 9644 of the Baldwin Park Zoning Code are hereby repealed and rescinded. SECTION 5. That Sections 9621 and 9622 are hereby added to the Baldwin Park Zoning Code to read as follows: 9621, Compliance with Development Standards. Every use permitted in Zone C-M shall comply with the provisions of Part XVIII of Article IX of this Code. 9622. Precise Plan Review, Lots classified in Zone C-M are subject to the provisions of Article IX, Chapter IV, Part IV of this Code, commencing with Section 9460, relating to precise plan review." SECTION 6. That Sections 9628 and 9629 are hereby added to the Baldwin Park Zoning Code to read as follows: 9628. Compliance with Development Standards. Every use Remitted in Zone M-R shall conply with the provisions of Part XVIII of Article IX of this Code. 9629. Precise Plan Review, Lots classified la Zone M-R are subject to the provisions of Article IX, Chapter IV, Part IV of this Code, io—cnclnfl. with Section 9460, relating to precise plan review." SECTION 7. That Sections 9632 and 9633 are hereby added to the Baldwin Park Zoning Code to read as follows: 9632. Conyllance with PewLl.ujii'nt Standards. Every use permitted la Zone H-l shall cowply with the provisions of Part XVIII of Article IX of this Code. Lots classified in Zone M-l are subject to the provisions of Article IX, Chapter IV, Part IV of this Code, commencing with Section 9460, relating to precise plan review." SECTION 8. That Sections 9642 and 9643 are hereby added to the Baldwin Park Zoning Code to read as follows: 9642. Compliance with Development Standards. Every use permitted in Zone M-2 shall comply with the provisions of Part XVIII of Article IX of this Code. 9643. Precise Plan Review. Lots classified in Zone M-2 are subject to'the provisions of Article IX, Chapter IV, Part IV of this Code, commencing with Section 9460, relating to precise plan review." SECTION 9. That the following is added to Section 9479 of the Baldwin Park Municipal Code, as subparagraph f) thereof: f) Screening of Outside Storage in M Zones. The requirements of Section 9654, subpara- graph a). SECTION 10. That the City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be pub- lished in the manner prescribed by law. 1972.
