SECOND 5/^;nG-.....-.fe.<='?./^..^^ ORDINANCE NO. 641 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING DIVISION III OF PART 10 OF THE BALDWIN PARK ZONING CODE, CONSISTING OF SECTIONS 9570 THROUGH 9573, INCLUSIVE, RELATING TO ZONING REGU- LATIONS IN THE R-3 ZONE CASE NO. AZC-61) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. Division III of Part 10 of the Baldwin Park Zoning Code, consisting of Sections 9570 through 9572, inclusive, is hereby repealed. SECTION 2. Division III of Part 10, consisting of Sections 9570 through 9573, inclusive, is hereby added to the Baldwin Park Zoning Code, reading in words and figures as follows: DIVISION III" ZONE R-3 9570. PERMITTED USES. No person shall use any property in any R-3 Zone for any use, other than the following: 1. M»i1 t-i pie dwelUnyg and Condominiums'. 2. Single Family Residential Units. Any single family residential unit which was lawfully erected and constructed upon any lot which is, presently, or in the future, zoned R-3, shall be a conforming use provided that the same complies with all of the following conditions: a) That such single family resi- dential structure, together with all accessory uses, was constructed in con- formity with the zoning regulations in effect at the time of construction; and b) That no uses exist upon the property except those permitted in the R-l Zone. This Subparagraph shall not be construed to permit the new construction of single family units in the R-3 Zone. The new construction of any structure accessory to an R-l use, or reconstruction of any existing building or structure which meets the require- ments of Subparagraph a) and b) hereof, shall be accomplished in accordance with the provisions of the R-l Zone. 3. DEVELOPMENT STANDARDS. All uses on lots in the R-3 Zone shall comply with the following standards: 1. Lots. a) Area. After the effective date hereof 9 no lot shall be created having less than 10,000 sq. ft. in lot area. b) Width. Each lot created after the effective date hereof shall have the following minimum widths: 1) Interior lots: Sixty 60) ft. 2) Corner lots: Seventy 70) ft. c) Permissible Lot Coverage. Buildings, including accessory buildings and structures, shall not cover sure than sixty 60%) per cent of the lot area. 2. Buildings. a) Length. No building or structure shall exceed a length of 150 feet. b) Height. No building or structure shall exceed a height of 45 feet or 4 stories, whichever is the lesser. c) Lot Area Per Dwelling Unit. One dwelling unit shall be permitted on a lot for each 1,500 sq. ft, of lot area. d) Minimum Floor Area for Dwelling Units: 1) Bachelor and efficiency units 575 sq. ft. 2) One^bedroom units 675 sq. ft. 3) Two-bedroo® units 850 sq. ft. 4) Three-bedrooa units 1,050 sq, ft 5) For each additional bedroom, in units having more than three bedrooms 150 sq. ft. of additional floor area. Open s fairways bucket type stairs) with open rails may not be placed within 5 feet of any door or window. f) Elevators. All buildings containing units above the third floor shall be served with elevators in addition to the stairways required by law. g) Off-Street Parking: 1) Location: No garage or carport may be erected in front of any main building, nor shall any garage or carport face or open upon a front yard area. 2) Required Parking: a) All required off-street parking spaces shall be located in a garage, or within a main building except as hereinafter expressly provided. b) Parking spaces located in a building, other than a garage designed for two 2) vehicles, shall be designed and constructed to provide each dwelling unit with two 2) parking spaces, having security separation, including a closable door, providing a physical separation from the parking spaces of the other tenants. c) Carports. Carports may be substituted for garages only if the Director finds, pursuant to Section 9460 et seq. that such carports will be architecturally compatible with the design of the main buildings, and will enhance the appearance of the project. d) Uncovered Parking^_____ Required guest and recreationa1 vehicle parking may be in the open. 3) All off-street parking facilities shall comply with the requirements contained in Part 7 of this Code. 3- BIB] 37950-U01 ORD-U02 641-U02 LI2-U03 FO31548-U03 FO31786-U03 DO31803-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 641̤<žjh£ŸjHÂÔORDINANCE NO. 641 3. Yards and Courts. Except as provided in this Division, no building or structure shall occupy any part of any required yard. Required Yards shall be as follows: a) Front Yards. 1) Each lot in the R-3 shall have and maintain a front yard of not less than twenty 20') feet in depth. 2) No off-street parking spaces or parking areas shall be located within the required front yard area or in front of the main building. 3) Parking garages, when completely below ground level may occupy required front yards. b) Side Yards. 1) Adjoining another lot five 5) ft. 2) Adjoining a street ten 10) ft. 3) Off-street parking spaces or garages, and accessory buildings not used for human habitation, may occupy required side yards adjacent to another lot. c) Rear Yards. 1) Each lot shall have a rear yard of not less than ten 10) feet, except that where such lot abuts an alley, the rear yard shall be not less than five 5) feet. 2) Off-street parking spaces or garages, and accessory buildings not used for human habitation, may occupy required rear yards except when adjacent to alleys. d) Roof Drainage. Gou^s * All courts shall be unobstructed from the ground to the sky, and shall have minimum dimensions of twenty 20) feet. 4. Open Areas. a) Usable Open Space. At least 100 sq. ft. of usable open space shall be provided for each dwelling unit. Usable Open Space shall mean: 1) any ground area designed to be used for outdoor living and recreation; and 2) landscaped areas and patios. No portion of any off-street parking space, driveway, accessory building, required front, rear, or side yard, or covered pedestrian walkway between buildings, shall constitute usable open space. b) Landscaping Required: Whenever a driveway is located within a required side yard and dwelling units face said yard, a landscaped area at least five 5) feet wide shall be main- tained between such driveway and any apartment building on the same lot. Required walkways may encroach not more than thirty 30) inches into this landscaped area. c) Drainage: All open areas shall be designer* to eliminate puddles or standing water. d) Internal Walkways; 1) Internal walkways shall be provided between the street and the front door of each dwelling unit and between the off-street parking area and any door of each dwelling unit. Such walkways shall be at least 30 inches wide and shall be improved with a hard, durable surfacing. They shall have not less than 7 feet height clearance. 5 BIB] 37950-U01 ORD-U02 641-U02 LI2-U03 FO31548-U03 FO31786-U03 DO31803-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 641̤<žjh£ŸjHÂÔORDINANCE NO. 641 2) Driveways shall not be permitted in lieu of required internal walkways. e) Fences, Walls and/or Screens: 1) Swimming pools shall have safety fencing and gates in accordance with Section 8170 of the Municipal Code. 2) Open parking areas shall be screened from habitable buildings and street views by a three-foot decorative wall. 3) Utilities and clothes areas shall have a six toot view-obscuring wall enclosing the same. 4) Side and rear lot lines shall have solid masonry walls not less than six 6) feet in height, except that in the required front yard areas the wall shall be 36 inches in height. 5) Outside storage areas shall be enclosed behind a six toot decorative waU» 6) Mechanical Equipment shall be completely screened from view. 5. Storage and Utility Areas: a) Accessory Stqraye Space: At least 90 cubic feet of enclosed exterior storage space shall be provided for each dwelling unit. Such storage shall be adjacent to each dwelling unit or within the garage serving said unit. b) Utility Areas: A utility area having at least five 5) sq. ft. of floor area per dwelling unit, shall be provided for the storage of building maintenance tools and laundry facilities. No such area shall contain less than 75 sq. ft. of floor space 6. Utilities: All public utility services shall be installed below grade. 7. Nonconfonning Buildings and Structures: Buildings and structures in existence, or, as to which a valid building permit exists, which conform or will conform to the development standards in effect on July 20^ 1972 shall not be considered non- conforming within the meaning of Section 9522 of this Code. solely by reason of failure to comply with the development standards set forth in Section 9571." 6- BIB] 37950-U01 ORD-U02 641-U02 LI2-U03 FO31548-U03 FO31786-U03 DO31803-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 641̤<žjh£ŸjHÂÔORDINANCE NO. 641 9572. MAINTENANCE AND OPERATION STANDARDS. 1. Storage of Commercial Vehicles. No person shall park or store any commercial vehicle, as that phrase is defined in Section 260 of the Vehicle Code of the State of California, having a capacity greater than three-quarters 3/4) a ton. 2. Exterior Lighting. Exterior lighting shall be arranged to reflect the light away from any dwelling unit. 3. Driveway Encroachments. All required driveways shall have a minimum overhead clearance of 14 ft. Utility meters, trash receptacles, power poles, exterior plumbing and similar facilities are prohibited within driveways. 4. Parking Within Driveways Serving More Than Five Vehicles.————————————————— a) No Parking" signs with lettering at least four 4) inches in height shall be placed conspicuously at the entrance to, and at intervals of not less than fifty 50) feet along every driveway. b) No person shall park, stand or leave any vehicle in any portion of said driveway, except for loading or unloading passengers or goods and only while such vehicle is attended by the operator. 5. Visitor Parking Signs. Visitor parking signs with lettering at least fourT4) inches in height, shall be placed conspicuously at the entrance to every required driveway. Each visitor parking space shall be clearly marked• 6. Trash Areas. a) All outside trash and garbage collection areas shall be enclosed with decorative masonry wall so as to not be visible fror* any dwelling. b) Trash containers shall provide at least 1/5 cubic yard capacity per dwelling unit and shall be located within 150 feet of each dwelling w^tp c) All trash, rubbish and garbage receptacles shall be regularly cleaned, inspected and maintained in a clean, safe and sanitary condition. All containers shall be pro- vided with tight-fitting lids. d) All trash storage areas shall be located for convenient vehicular access for pickup and disposal. 7. Landscaping. PRECISE PLAN REVIEW. Lots in the R«3 Zone are subject to the provisions of par? 4 Sf this code relating to Precise Plan Review." SECTI011 3" That Subparagraph 16 of Section 9501 of the Baldwin Park Municipal Code is hereby amended to read as follows: 16. Residential Uses: a. Owellii welling, one and two-family 2 parking spaces per dwelling unit to be located in a garage b. Dwelling, multiple: 1) Dwelling units having one 1) bedroom 2) Dwelling units having two 2) bedrooms 3) Dwelling units having three 3) or more bedrooms and 4) Additional Facilities; 1-1/2 off street parking spaces 2 off-street parking spaces 2-1/2 off-street parking spaces There shall be provided, as additional off-street parking facilities, 1/4 of a space for each dwelling unit located on the lot SECTION 4. That the City Clerk shall certify the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law. PASSED AND APPROVED this 21 day of June 1972.
