Home My WebLink AboutORD 643ORD 643Ì¤<žjh£ŸjHÂßORDINANCE NO. 643 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CERTAIN PROVISIONS OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO THE PLANNING COMMISSION THE CITY COUNCIL OF THE CITY OP BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 2201 through 2206, inclusive, of the Baldwin Park Municipal Code, are hereby amended, respectively, to read as followss 2201. MEMBERS• The Planning Commission of the City shall consist of seven 7) persons, each of whom shall be a qualified elector of the City at the time of his appointment, and at all times during his term." 2202. TERMS, The term of office for a member of the Planning Commission shall be for a period of two 2) years." 2203. APPOINTMENT. REMOVAL OF PLANNING COMMISSIONERS. Members of the Planning Commission shall be appointed by the Mayor with the approval of the City Council, and shall serve at the pleasure of the City Council. A member of the Comm- ission shall continue to serve, notwithstanding expiration of his term, until his successor is duly appointed and qualified. Qualified persons shall be apponted to vacant positions on the Planning commission by the Mayor with the approval of the City Council." 2204. MEETINGS. The Planning Commission shall conduct a regular meeting thereof not less than once per month, on the 4th Wednesday of each calendar month. Special and adjourned regular meetings may be held by the Commission in the time and manner provided by law. The Commission shall conduct its reg- ular meeting in the City Council Chambers of the City Hall at 14403 E. Pacific Avenue, Baldwin Park, California." 2205. ABSENCE FROM MEETINGS. If any member of the Plan- ning Commission is absent from three 3) successive regular meet- ings of the Commission, he shall be deemed, for all purposes, to have resigned from said Commission and his office shall be deemed to be vacant. The absence of a member of the Planning Commission from a regular meeting of the Commission due to illness or un- avoidable absence from the City shall be deemed to be an excused absence, if such member has advised the Secretary of the Comm- ission not later than the day preceding such regular meeting of the fact of such intended absence." 2206. DUTIES. fhe Planning Commission shall perform such duties as may be allocated to it by applicable law, including, but not limited to, the provisions of the Baldwin Park Municipal Code; provided however, that the Planning Commission shall not have authority to expend, or authorize the expenditure of, any public funds, for any purpose, without prior express consent of the City Counc-1." SECTION 2. COMPENSATION. The City Council may, by resolution, provide for compensation to Planning Commission members for ser- vices rendered by them in such capacities. Members of the Plan- ning Commission, with the prior consent of the City Council, shall be entitled to reasonable expenses incurred in the performance of their official duties as Planning Commissioners." 2208. PLANNING COMMISSION OFFICERS. a) Chairman and Vice Chairman. At the regular meeting of the Planning Commission held during the month of July of each calendar year, the Commission shall select one of its members to serve as Chairman and one of its members to serve as Vice Chair- man during the succeeding year. b) Secretary. Hie City Manager shall provide for secretarial services for the Planning Commission, so that the minutes, resol- utions and other official documents of the Commission are permanent- ly filed- The City Manager shall designate a qualified person to act as Secretary to the Commission." SECTION 3. That the amendments to the Baldwin Park Municipal Code as contained in this Ordinance are intended, among other things, to alter the terms of offices of the current members of the Planning Comm- ission of this City. Notwithstanding the provision of Section 2202 of the Baldwin Park Municipal Code as adopted hereby- The adoption of this Ordinance shall constitute a direction to the City Council to take the following action: a) That the Mayor shall accept nominations from the City Council for the seven 7) Planning Commission offices; and b) That the Mayor, with the approval of the City Council, shall appoint seven 7) members to the said Commission and shall determine which four 4) members of the Commission shall serve for terms of office expiring on June 30, 1973, and which remaining members of the Commission shall serve for terms of office expiring on June 30, 1974. That the four 4) Commissioners who serve for a term expiring on June 30, 1973, shall be deemed to hold Planning Commission offices 1, 2, 3, and 4; the remaining three 3) members of the Commission shall be deemed to hold Planning commission offices 5, 6, and 7, respectively. SECTION 4. That the City Clerk shall certify the adoption of this Ordinance and shall cause the same to be published in the manner pre- scribed by law. PASSED AND APPROVED this 5th day of July 1972.
