HomeMy WebLinkAboutORD 654ORD 654x ôÎÃORDINANCE NO. 654 AN ORDINANCE OF THE CITY OF BALDWIN PARK REPEALING AND AMENDING CERTAIN SECTIONS OF, AND ADDING CERTAIN SECTIONS TO, THE BALDWIN PARK ZONING CODE, RE- LATING TO DEVELOPMENT STANDARDS IN COMMERCIAL ZONES CASE NO. AZC-66). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. Sections 9591 through 9597, Sections 9601 and 9602, and Sections 9611 and 9612 of the Baldwin Park Zoning Code are hereby repealed. SECTION 2. Sections 9591 and 9592 are hereby added to the Baldwin Park Zoning Code reading as follows: 9591. COMPLIANCE WITH DEVELOPMENT STANDARDS. Every use permitted in Zone C-P shall comply with the provisions of Part 14.5 of this Code, commencing with Section 9613, relating to development standards. 9592. PRECISE PLAN REVIEW. Lots classified in Zone C-P are subject to the provisions of Part 4 of this Code, commencing with Section 9460, relating to precise plan review." SECTION 3. Sections 9601 and 9602 are hereby added to the Baldwin Park Zoning Code, reading as follows; 9601. COMPLIANCE WITH DEVELOPMENT STANDARDS. Every use permitted in Zone C-l shall comply with the provisions of Part 14.5 of this Code, commencing with Section 9613, relating to development standards. 9602. PRECISE PLAN REVIEW. Lots classified in Zone C-l are subject to the provisions of Part 4 of this Code, commencing with Section 9460, relating to precise plan review." SECTION 4. Sections 9611 and 9612 are hereby added to the Baldwin Park Zoning Code, reading as follows: 9611. COMPLIANCE WITH DEVELOPMENT STANDARDS. Every use permitted in Zone C-2 shall comply with the provisions of Part 14.5 of this Code, commencing with Section 9613, relating to development standards. 9612. PRECISE PLAN REVIEW. Lots classified in Zone C-2 are subject to the provisions of Part 4 of this Code, commencing with Section 9460, relating to precise plan review." A new Part 14.5, consisting of Sections 9613 through 9619 Is hereby added to the Baldwin Park Zoning Code reading In words and figures as follows: PART 14.5" DEVELOPMENT STANDARDS-COMMERCIALLY ZONED PROPERTIES" 9613. APPLICATION OF THIS PART. The provisions of this Part shall apply to the development and redevelopment.of all lots which are classified In Zones C-P, C-l, C-l(A), C-2 or C-2(A) hereinafter referred to In this Part as C1 zoned lots)." 9614. PURPOSE OF THIS PART. The pro- visions of this Part are adopted for the purpose of establishing standards for the development, redevelopment and continued usage of commercially zoned properties within the City, so as to render the same consistent with the City's existing and proposed General Plan, and compatible with surrounding and adjacent uses of other properties." 9615. CREATION OF NEW LOTS. Lots created after the effective date of this Part shall conform to the following: 1) Lot Area. The minimum required lot area of each such lot shall be 5,000 sq. ft., except for those lots classified In Zones C-l(A) or C-2(A), as to which the minimum lot area shall be not less than one 1) acre. 2) Lot Width. The minimum width of each such lot shall be not less than fifty 50') ft., except for those lots classified In Zones C-l(A) or C-2(A), as to which the minimum lot width shall be not less than 100 feet." 9616. STANDARDS FOR CONSTRUCTION. The provisions of this Section shall apply to the construction of new buildings and structures only, and shall have no application to the remodeling or rehabilitation of any existing building or structure. 1) Underground Utilities. Utilities shall be underground in accordance with the provisions of Section 9800 et seq. of this Code. 2) Height Limit. Each building or structure located upon any such lot shall observe the following height limitations: 2- BIB] 37950-U01 ORD-U02 654-U02 LI2-U03 FO31548-U03 FO31816-U03 DO31817-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 654x ôÎÃORDINANCE NO. 654 a) Twenty-five 25') ft. for any building or structure, any portion of which is located within 25 ft. of a lot line of a lot classified in Zones R-l or R-2; b) Thirty-five 35') ft. in height for any portion of such building or structure located within 50 ft. of a lot line of a lot classified in Zones R-l or R-2; c) All others 45 ft.; d) Buildings or structures may exceed the height limits set forth above only if a conditional use permit therefor is first obtained. 3) Yards. Each such lot shall observe and maintain the following required yard areas: a) Front Yard Area. Each such lot shall have ana maintain a front yard area not less than ten 10') feet in depth, except for those lots described and depicted upon Exhibit A", attached hereto and incorporated herein by this reference; those lots referred to on said Exhibit A", shall observe the front yard areas as shown thereon. b) Side Yards. Any such lot which has a common side lot line with any lot classified in any of the R' zones shall observe, immediately adjacent to that side lot line, a side yard area not less than ten 10 ft. in width. c) Rear Yards. Any such lot which has a common rear lot line with any lot classified in any of'the R' zones shall observe a rear yard area not less than twenty 20') ft. in depth. 4) Placement of Buildings and Structures. Permitted buildings and structures may be located as follows: a) General. On any part of a lot except a required yard area. b) Required Yard Areas. 1) Ho building or structure may be located in any part of a required front yard area; 2) Buildings and structures, or portions^thereof, may be located in required rear or side yard areas if the portion of the building or structure so located, complies with the following: 3- BIB] 37950-U01 ORD-U02 654-U02 LI2-U03 FO31548-U03 FO31816-U03 DO31817-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 654x ôÎÃORDINANCE NO. 654 i) that the height of such building or structure is less than twelve 12') ft; ii) that there are no door openings or exterior mechanical equipment located in or upon such building. c) Off-Street Parking. Off-street parking facilities may be located on any part of a lot, except in those portions of front yard areas required, pursuant to Subparagraph 8) hereof, to be devoted to landscaping. 5) Loading Facilities. All loading facilities located within loo feet of any R' zoned lot shall be situated and designed to prevent unreasonable noise emission. 6^ Signs. On-premise signs shall comply with the provisions of Division B, Part XXI of this Code, commencing with Section 9830 et seq, 7) Off"Street Parking. Off-street parking shall be provided in accordance with the provisions of Part 7 of this Code» commencing with Section 9500. 8) Landscaping Required. Landscaping shall be provided and continuously maintained in accordance with the following; a) Side Yards. Landscaping shall be required in all open side yard areas and shall be continuously maintained as such. b) Rear Yards. Landscaping shall be required in the rear 5 feet of each open required rear yard area. c) Front Yards. Landscaping shall be required in not less than 50% of any required front yard area which is located directly across an intervening street from a lot classified in any of the R1 zones. All other required front yard areas shall have not less than 25% of the gross area thereof devoted to landscaping. d) Parking Areas. Any open unused space, containing 24 or more sq. ft., located in an off-street parking facility, shall be landscaped; such areas may be utilized to comply with the provisions of Section 9507 hereof. Landscaping required pursuant to Section 9507, shall include at least one 1) 15-gallon size tree for each ten 10) off-street parking spaces located on the lot. 4- BIB] 37950-U01 ORD-U02 654-U02 LI2-U03 FO31548-U03 FO31816-U03 DO31817-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 654x ôÎÃORDINANCE NO. 654 9) Non-Conformity Uses, buildings or structures existing as of March 1, 1973, shall not be deemed non-conforming by reason of failure to comply with the Standards of Con- struction' as set forth in this Section 9616) if such uses, buildings or structures conformed to the zoning regulations existing at the time of their construction or establishment." 9617. OPERATION AND MAINTENANCE STANDARDS. 1) Walls and Fences. Walls, fences and hedges shall be required in accordance with the following: a) The following shall be provided on any side or rear lot line of any such lot which has a common lot line with any R1 zoned lot: 1) Side Lot Line: a six foot high masonry wall or solid hedge; 2) Rear Lot Line: a six foot solid fence, wall or hedge. b) Any such lot which is separated by an alley from any R* zoned lot, shall be provided with a 36-inch masonry wall or hedge or a planter not less than three 3) feet in width. c) The side of any required front yard area on any such lot which abuts any R' zoned lot, shall be provided with a solid masonry wall 36 inches in height. Notwithstanding any other provision to this Code, each use, building or structure existing as of the effective date of the adoption of this Section shall be made to comply with the pro- visions of this Subparagraph as of March 1, 1974. 2) Refuse Storage. All outdoor trash, garbage and refuse storage areas shall be completely screened on all sides by masonry walls and view-obscuring gates. Such storage areas shall be located so as to be easily accessible for trash pick up. No refuse shall be stored so that it is visible above the wall. Notwithstanding any other provision to this Code, each use, building or structure existing as of the effective date of the adoption of this Section shall be made to comply with the provisions of this Subparagraph as of tfarch 1, 1974. All uses, including storage of merchandise and supplies, shall I e within a completely enclosed building, or within an area enclosed by a six-foot masonry wall, except for the following: a) Florist displays; b) Garden supplies and plants; c) Outdoor restaurants; d) Vehicle sales; e) Automobile washing facilities; f) Recreational uses; g) Storage or rental of vehicles or other large equipment. Notwithstanding any other provision to this Code, each use, building or structure existing as of the effective date of the adoption of this Section shall be made to comply with the pro- visions of this Subparagraph as of March 1, 1974. 4) Lighting. All exterior lighting shall be arranged to reflect the light away from adjoining properties. Notwithstanding any other provision to this Code, each use, building or structure existing as of the effective date of the adoption of this Section shall be made to comply with the provisions of this Subparagraph as of March I. 1974. 5) Mechanical Equipment. All exterior mechanical equipment, except window air con- ditioners and similar equipment, shall be Screened from view. Notwithstanding any other provision to this Code, each use, building or structure existing as of the effective date of the adoption of this Section shall be made to comply with the provisions of this Subparagraph as of March 1, 1975. 6) Public Amplifying Systems. Amplifying systems used to broadcast sound or music on to a public right-of-way are prohibited unless a Temporary Use Permit is obtained allowing such broadcast for a limited time, in conjunction with a special event. Notwithstanding any other pro- vision to this Code, each use, building or structure existing as of the effective date of the adoption of this Section shall be made to comply with the provisions of this Subparagraph as of March 1, 1974. 6- BIB] 37950-U01 ORD-U02 654-U02 LI2-U03 FO31548-U03 FO31816-U03 DO31817-U03 C5-U03 ORDINANCES-U03 11/24/2003-U04 ROBIN-U04 ORD 654x ôÎÃORDINANCE NO. 654 7) Landscaping Maintenance, All required landscaped areas shall be continuously and adequately maintained as such. Notwithstanding any other provision to this Code, each use, building or structure existing as of the effective date of the adoption of this Section shall be made to comply with the provisions of this Subparagraph as of March 1, 1974." 9618. CONVERSION OF RESIDENTIAL STRUCTURES. Notwithstanding any other provision of this Code to the contrary, no person shall cause or permit the conversion of any existing residential building or structure for a commercial use." 9619. ABATEMENT OF NON-CONFORMING USES. Non-conforming uses, buildings or structures shall be abated in the manner set forth in Part 8 of this Code, commencing with Section 9520." SECTION 6. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the manner required by law. 1973.
