HomeMy WebLinkAboutORD 663ORD 663x ôÎÃ&ORDINANCE NO. 663 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMEND- ING CERTAIN PROVISIONS OF THE BALDWIN PARK MUNICIPAL CODE RE- LATING TO BICYCLES THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 3400 through and including Section 3407 of the Baldwin Park Municipal Code are hereby amended to read as follows: 3400. License Required, No person shall operate a bicycle propelled wholly or in part by muscular power, upon any street of the City, without first obtaining a license therefor. 3401. Duration of License. The Police Chief or such other person as may be designated by Cicy Council is hereby authorized and directed to issue, upon written application therefor, bicycle licenses which shall be effective until June 30, 1975, and will en- title said bicycle to be operated upon all the streets, exclusive of the sidewalks thereof, in the City. 34 02. License Plates and Registration Cards. The City shall provide reflective metallic decal-ty-pe license plates, together with registration c<irds, said licenses and registration cards having numbers stamped thereon in numerical order. Such licenses shall be suitable for attachment upon the frames of bicycles, and the Police Chief or such other person who may be designated by the City Council shall attach one such license to the frame of each bicycle, and shall issue a corresponding registration card to the owner thereof upon the payment of the license fee herein provided for. Such license shall remain attached during the existence of such license. The Police Chief or other such per- son who may be designated by the City Council shall also keep a record of the date of issue of e.sch license, the number thereof, the name and address of he licensee and the make, type and model of the licensed bicycle. 3403. Buying and Selling Bicycles. All persons engaged in the business of buying Second-hand bicycles are hereby required to make a weekly report 1:0 the Chief of Police, giving the name and address of the person from whom each bicycle is purchased; year, make and serial number of bicycle; general description of bicycle; and the number of the license foi-md there- on, if any. All persons engaged in the business of selliiTg new or second-hand bicycles are hereby re- quired to make a weekly report to the Chief of Police, giving a list of all sales made by such dealers, which list shall include the name and addres;s of each person to whom sold; year, make and serial n'jmber of bicycle; general description of bicycle; and the num- ber of the license attached thereto, if any. Every person who sells/ or transfers ownership of, any bicycle, shall report such sale or transfer to the Chief of Police and return to the City Clerk or such other person who may be designated by the City Council the registration card issued to such person, together with the name and address of the person to whom said bicycle was sold or transferred/ and such report shall be made and said registration card returned within ten 10) days of the date of said sale or transfer. The purchaser or transferee of such bicycle shall apply for a transfer or registration therefore, within ten 10) days of said sale or transfer, and a new registration card shall be issued to him. 3405. Removing or Altering Plates, Etc. No person shall willfully or maliciously remove, destroy or alter the number of the frame of any bicycle licensed pursuant to this Chapter. No person shall remove, de- stroy or alter any license or registration card during the time in which such license or registration card is valid; provided, however, that nothing in this Chapter shall prohibit the Chief of Police from stamping numbers on the frames of bicycles on which no serial number can be found, or on which said number is illegible or in- sufficient for identification purposes. 3406. License Fee. The license fee to be paid for each bicycle shall be One Dollar and Twenty-Five Cents $1.25) and shall be paid in advance, licenses issued hereunder shall not be transferable from one bicycle to another. All license fees collected under this Chapter shall be paid into the General Fund of the City. 3407. Existing Licenses. Any bicycle license issued by the City before the effective date of this Ordinance shall expire one year after its issuance or 180 days after the effective date of this Ordinance, whichever is later. SECTION 2. That Section 3408 be added to the Baldwin Park Municipal Code to read as follows: 3408. This Chapter shall be operative until June 30, 1975, and as of that date is repealed. SECTION 3. That the City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law.
