AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK. AMENDING CERTAIN
SECTIONS OF THE BALDWIN PARK MUNICIPAL
CODE, RELATING TO FEES.
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS:
SECTION 1. That Section 9474 of the Baldwin Park Municipal Code is
amended to read as follows:
9474. Application for Variance or Conditional Use Permit;
Withdrawal thereof. Applications for a variance or conditional use
permit shall be filed with the Planning Department, on forms furnished
by said department, setting forth fully the nature of the proposed
use, and the facts deemed sufficient to justify the granting of the
variance or conditional use permit, in accordance with the provisions
of this part.
The applicant and/or appellant shall furnish to the Director a
certified copy of the names and addresses of all property owners to
whom notice must be mailed as hereinafter provided.
Any applicant and/or appellant may withdraw his application or
appeal any time during the processing of the same, by filing a written
request to do so; no refund of the filing fee shall be permitted in
case of withdrawal, unless the City Council orders a refund, based
upon a showing of good cause by the applicant and/or appellant."
SECTION 2. That Section 9492 of the Baldwin Park Municipal Code is
amended to read as follows:
9492. Amendments Initiated by Property Owners. The Director
shall prepare a suitable application form, entitled Request for
Amendment to the Baldwin Park Zoning Code', and shall assist any
applicant in preparing the Request form. Any such amendment shall
be accepted for filing by the Director only upon the payment by the
applicant of a filing and processing fee in the sum of $200 for the
first lot included in such application and $10 for each additional
lot included in said application. Any applicant and/or appellant
may, in writing, withdraw his request or appeal at any time during
the processing of such request or appeal; provided, however, that
there shall be no refund of any fees paid in connection therewith,
unless the City Council orders a refund, based upon a showing of
good cause by the applicant and/or appellant."
SECTION 3. That the City Clerk shall certify to the adoption hereof,
and cause this ordinance to be published in the manner prescribed by law.
