HomeMy WebLinkAboutORD 713ORD 713pT3(ÌìÑLWST r^ KCC^'O 0:^c; ORDINANCE NO. 713 AN ORDINANCE OF THE CITY OF BALDWIN PARK ADDING SECTIONS 3300-3306 TO THE MUNICIPAL CODE RELATING TO BICYCLES AN URGENCY ORDINANCE) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Sections 3300 through 3306, are hereby added to the Baldwin Park Municipal Code. to read as follows: PART B. BICYCLE REGULATIONS 3300 License Required. No person shall operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets, alleys or public highways of the City, without first obtaining from the Chief of Police a license therefor. 3301 Duration of License. The Police Chief or such other person as may be designated by City Council is hereby authorized and directed to issue, upon written application therefor, bicycle licenses which shall be effective for a period commencing on the date of issuance and expiring on December 31, 1978, and will entitle said bicycle to be operated upon all the streets, exclusive of the sidewalks thereof, in the City. 3302 Bicycle License Indicia. The City shall provide bicycle license indicia as distributed to the City by the Department of Motor Vehicles. 3303 Buying and Selling Bicycles. All persons engaged in the business of buying second- hand bicycles are hereby required to make a weekly report to the Chief of Police, giving the name and address of the person from whom each bicycle is purchased; year, make and serial number of bicycle? general description of bicycle; and the number of the license found thereon, if any. All persons engaged in the business of selling new or secondhand bicycles are hereby required to make a weekly report to the Chief of Police, giving a list of all sales made by such dealers, which list shall include the name and address of each person to whom sold; year, make and serial number of bicycle; general description of bicycle; and the number of the license attached thereto, if any. 3304 Report of Sales. Every person who sells or transfers ownership of any bicycle shall report such sale or transfer to the Chief of Police and return to the City Clerk or such other person who may be designated by the City Council the registration card issued to such BIB] 37960-U01 ORD-U02 713-U02 LI2-U03 FO31548-U03 FO31752-U03 DO32584-U03 C5-U03 ORDINANCES-U03 12/4/2003-U04 ROBIN-U04 ORD 713pT3(ÌìÑLOrdinance No. 713 person, together with the name and address of the person to whom said bicycle was sold or transferred, and such report shall be made and said registration card returned within ten 10) days of the date of said sale or transfer. The purchaser or transferee of such bicycle shall apply for a transfer of registration therefor, within ten 10) days of said sale or transfer, and a new registration card shall be issued to him. 3305 Removing or Altering Plates, Etc. No person shall willfully or maliciously remove, destroy or alter the number of the frame of any bicycle licensed pursuant to this Part. No person shall remove, destroy or alter any license or registration card during the time in which such license or registration card is valid; provided, however, that nothing in this Part shall prohibit the Chief of Police from stamping numbers on the frames of bicycles on which no serial number can be found, or on which said number is illegible or insufficient for identification purposes. 3306 License Fee. The license fee to be paid for each bicycle shall be as follows: 1) For licenses issued after the effective date of this ordinance and prior to January 1, 1976, the fee shall be $3.50. 2) For licenses issued between January 1, 1976, and June 30, 1976, the fee shall be $3.00. 3) For licenses issued between July 1, 1976, and December 31, 1976, the fee shall be $2.50. 4) For licenses issued between January 1, 1977, and June 30, 1977, the fee shall be $2.00. 5) For licenses issued between July 1, 1977, and December 31, 1977, the fee shall be $1.50. 6) For licenses issued between January 1, 1978. and December 31, 1978. the fee shall be $1.00. SECTION 2. This ordinance is hereby declared to be an urgency measure, and shall take effect immediately upon its adoption. That the said chapter. enated as Vehicle Code Sections 39000-39011 requires certain changes in the City's bicycle license procedures effective immediately. For the foregoing reasons the immediate adoption of this Ordinance is required to preserve the public peace, health and safety. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance. APPROVED and PASSED this 26th day of August 1975.
