AN ORDINANCE OF THE CITY COUNCIL PiF THF
CITY OF BALDWIN PARK AMENDING A CERTAIN
SECTION OF THE BALDWIN PARK ZONING CODE
RELATING TO THE UNCERTAINTY OF BOUNDARIES
CASE NO. AZC-72)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN
AS FOLLOWS:
SECTION 1. That Section 9452 of the Baldwin Park Zoning Code
is hereby amended to read as follows:
SECTION 9452. UNCERTAINTY OF BOUNDARIES
1. Where uncertainty exists as to the boundaries of any zone
shown on the official zoning map of the city, the following
shall apply:
a. Where boundaries are indicated as approximately following
street lines, alley lines, or lot lines, the centerline
of the roadway shall be construed to be the boundary of
the zoning of the adjacent parcels.
b. Railroad and flood control rights-of-way are considered
to be the same zoning as abutting or adjacent properties,
to the centerline of the right-of-way; unless otherwise
specifically zoned.
2. Lots with mixed zoning designations.
a. Where a single lot other than railroad and flood control
rights-of-way is zoned with more than one zoning designation,
any new or expanded use shall conform to the zone most
closely designated by the General Plan for the property.
Such conformance shall be accomplished by Change of Zone
procedures.
b. Where development of through lots with more than one
zoning designation is desired, it shall, be permitted
upon division of the lot by Parcel Map procedure.
3. Where any further uncertainty exists as to the boundaries
of any zone, the Planning Director shall determine the
boundaries subject to right of the property owner to
appeal the decision to the Planning Commission.
SECTION 2. That the City Clerk shall certify to the adoption of
this Ordinance and shall cause the same to be published in the manner required
by law.
