HomeMy WebLinkAboutORD 745ORD 745pT3(ÌìÑ™///^/^J /^/^/^.J Ff^'T \ ORDINANCE NO. 745 SLce^n AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING ANT)—'"———~ ADOPTING THE REDEVELOPMENT PLAN FOR THE SAN GABRIEL RIVER REDEVELOPMENT PROJECT WHEREAS, the Community Redevelopment Agency of the City of Baldwin Park, hereinafter referred to as the Agency", has formulated and prepared and approved the proposed Redevelopment Plan for the San Gabriel River Redevelopment Project and has recommended that this City Council approve said Redevelopment Plan; and WHEREAS, the Planning Commission of the City of Baldwin Park has sub- mitted its report and recommendation, recommending approval of said proposed Redevelopment Plan; and WHEREAS, the Agency has adopted rules for owner participation and reasonable preference for re-entry into business within the project area; and WHEREAS, the Agency submitted to the City Council said Redevelopment Plan; and WHEREAS, a duly noticed Joint Public Hearinq was conducted on November 23. 1976, and continued to November 30, 1976, by this City Council and the Agency as provided by law, and a full and fair public hearing was held; and WHEREAS, the City Council has also received a Report from the Agency pursuant to Section 33352 of the Health and Safety Code and a Draft Environ- mental Impact Report as well as an Economic Impact Analysis, a Planning Report and a copy of the Agency Relocation Plan for the project; and WHEREAS, the Environmental Impact Report was made available for review as required by law and all comments received thereon have been reviewed and answered when appropriate and incorporated in said Environmental Impact Report; and WHEREAS, pursuant to notice duly given, the Agency and this City Council have held a full and fair public hearing on such Environmental Impact Report and are fully advised with respect thereto; and WHEREAS, the Agency has adopted its Resolution entitled: A Resolution of the Community Redevelopment Agency of the City of Baldwin Park Approving Certain Revisions to the Proposed Redevelopment Plan and the Report to the City Council and Recommending Adoption of the Redevelopment Plan as Revised to the City Council and Requesting Concurrence in said Revisions by the Planning Commission" and WHEREAS, said Resolution was transmitted to this City Council; and WHEREAS, this City Council has adopted its Resolution entitled: Resolution of the City Council of the City of Baldwin Park Approving a Redevelopment Plan Report Relating to the Proposed San Gabriel River Re- development Project and Approving an Environmental Impact Report Contained Therein" and WHEREAS, all actions required by the Community Redevelopment Law and other applicable laws have been taken in an appropriate and timely manner; 1 BIB] 37960-U01 ORD-U02 745-U02 LI2-U03 FO31548-U03 FO32591-U03 DO32617-U03 C5-U03 ORDINANCES-U03 12/4/2003-U04 ROBIN-U04 ORD 745pT3(ÌìÑ™Ordinance No. 745 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. The purposes and intent of the City Council with respect to the Project Area of the San Gabriel River Redevelopment Project are to: 1. Eliminate the conditions of blight in the Project Area; 2. Insure, as far as possible, that the cause of blighting conditions will be either eliminated or protected against; 3. Provide participation for owners and business tenants in the Project Area; 4. Encourage and insure the rehabilitation, rebuilding and development of the Project Area; 5. Encourage and foster the economic revitalization of the Project Area; 6. Redevelop and rebuild the public facilities in the Project Area to provide safer and more efficient public services. SECTION 2. The Redevelopment Plan for the San Gabriel River Redevelop- ment Project, transmitted by the Agency and on file with the City Clerk is hereby incorporated herein by reference and made a part hereof as fully as if set out at length herein. SECTION 3. The City Council hereby finds and determines that: 1. The Project Area is a blighted area, the redevelop- ment of which is necessary to effectuate the public purposes declared in the Community Redevelopment Law; 2. The Redevelopment Plan for the San Gabriel River Redevelopment Project will redevelop the Project Area in conformity with the Community Redevelopment Law and in the interests of the public peace, health, safety and welfare; 3. The adoption and carrying out of the Redevelopment Plan for the San Gabriel River Redevelopment Project is ecnomically sound and feasible; 4. The Redevelopment Plan for the San Gabriel River Redevelopment Project conforms to the General Plan of the City of Baldwin Park; 5. The carrying out of the Redevelopment Plan for the San Gabriel River Redevelopment Project will promote the public peace, health, safety and welfare of the City of Baldwin Park and will effectuate the purposes and policy of the Community Redevelopment Law; 6. The condemnation of real property, as provided for in the Redevelopment Plan for the San Gabriel River Redevelopment Project is necessary to the execution of such Redevelopment Plan and adequate provisions have been made for payment for property to be acquired as provided by law; 7. The Agency has a feasible method and plan for the relocation of families and persons that may be displaced from housing facilities in the Project Area; BIB] 37960-U01 ORD-U02 745-U02 LI2-U03 FO31548-U03 FO32591-U03 DO32617-U03 C5-U03 ORDINANCES-U03 12/4/2003-U04 ROBIN-U04 ORD 745pT3(ÌìÑ™Ordinance No. 745 8. There are or are being provided in the Project Area or in other areas not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families and persons displaced from the Project Area, decent, safe, and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reasonably accessible to their places of employment; 9. There is no low or moderate income housing within the Project Area and no neighborhood impact element referred to in Health and Safety Code Section 33333.5 is required in the Redevelopment Plan. SECTION 4. The City Council is satisfied that permanent housing facilities will be available within three 3) years from the time occupants of the Project Area are displaced and that pending the development of such facilities there will be available to such displaced occupants adequate temporary housing facilities at rents comparable to those in the City of Baldwin Park at the time of their displacement. SECTION 5. A full and fair public hearing having been held on the Redevelopment Plan for the San Gabriel River Redevelopment Project and on the Report thereon, including the Environmental Impact Report, as stated in the recitals herein, and the City Council having considered a11 evidence and testimony for and against the adoption of said Redevelopment Plan and all written and oral objections thereto, and this City Council being fully advised in the premises, all written and oral objections to said Redevelop- ment Plan are hereby overruled. SECTION 6. The Redevelopment Plan for the San Gabriel River Redevelop- ment Project, incorporated by Section 2 above, is hereby approved and adopted and designated the official Redevelopment Plan for the San Gabriel River Redevelopment Project and for the Project Area described therein. SECTION 7. In order to implement and facilitate the effectuation of the Redevelopment Plan for the San Gabriel River Redevelopment Project hereby approved and adopted, certain official action must be taken by the City, and this City Council declares its intention to undertake and complete any proceedings necessary to be carried out by the City under the provisions of the Redevelopment Plan, including, without limitation, changes in zoning, the location and relocation of public facilities, and other similar public actions, and in pursuance thereof, and without limitation, the City Council hereby: a) Pledges its cooperation in helping to carry out such Redevelopment Plan; b) Directs the various officials, departments, boards and agencies of the City of Baldwin Park having administrative responsibilities in the premises likewise to cooperate to such end and to exercise their respective functions and powers in a manner consistent with such Redevelopment Plan; and c) Agrees that any agreements, deeds or leases submitted by the Agency to the City Council for its approval or disapproval will be deemed approved if not acted upon within thirty 30) days after submission to the City Council. 3. The City Council may expend funds of the City of Baldwin Park from time to time in accordance with the applicable provisions of the Redevelopment Plan for the San Gabriel River Redevelopment Project. SECTION 9. The City Clerk is hereby directed to send a certified copy of this Ordinance to the Agency and the Agency is hereby vested with the responsibility for carrying out the Redevelopment Plan for the San Gabriel River Redevelopment Project. SECTION 10. The City Clerk is hereby directed to record with the County Recorder of Los Angeles County a description of the land within the Project Area and a statement that proceedings for the redevelopment of the Project Area have been instituted under the Community Redevelopment Law. SECTION 11. The City Manager is hereby directed, for a period of two years after the effective date of this Ordinance, to advise all applicants for building permits within the Project Area that the site for which a building permit is sought for the construction of buildings or for other improvements is within a redevelopment project area. SECTION 12. The City Clerk is hereby directed to transmit, on or before January 1st next: i) a copy of the description and statement recorded by the Clerk pursuant to Section 10 of this Ordinance, ii) a copy of this Ordinance, and iii) a map or plat indicating the boundaries of the Project Area, to the Auditor and Tax Assessor of Los Angeles County, to the governing body of each of the taxing agencies which levies taxes upon any property in the Project Area and to the State Board of Equalization SECTION 13. The City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be posted or published as required by law. APPROVED AND ADOPTED this 2nd day of December 1976.
