AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK ESTABLISHING
AN INTERIM ZONING MORATORIUM RELATIVE
TO MOBILEHOME PARKS URGENCY)
WHEREAS, the City Council of the City of Baldwin Park desires to have
the Planning Commission consider and study the question of guidelines1for
the development of mobilehome parks within the City of Baldwin Park; and
WHEREAS, it is the desire of the City Council to provide for a
moratorium with respect to the establishment of any of the uses being studied
during the period of time necessary to consider the Planning Commission pro-
posals and to consider the adoption of an ordinance.
NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN
AS FOLLOWS:
SECTION 1. Mobilehome" means a vehicle other than a motor vehicle
used as a semi-permanent housing, designated for human habitation, for carry-
ing persons and property on its own structure, and for being drawn by a
motor vehicle and shall include a trailer coach. Mobilehome" park means
any area or tract of land where one or more mobilehome sites are rented or
held out for rent and shall include a trailer park. As used in this section,
site means any area of land designated or used for the occupancy of one mobile
or camp car.
SECTION 2. No mobilehome park shall be constructed, erected, recon-
structed, altered, changed or the nature of its use expanded for a period of
four months from the date of adoption of this ordinance or until this ordinance
is repealed, whichever first occurs.
SECTION 3. In the event the planning study referred to herein is not
completed within the four month period referred to, the moratorium provided
for herein may be extended as provided by Section 65858 of the Government Code
of the State of California.
SECTION 4. This ordinance shall take effect immediately pursuant to the
provisions of Section 36937 and 65858 of the Government Code, and shall con-
stitute an urgency ordinance. The reasons for the urgency are that the public
health, safety and welfare require the City Council and Planning Commission
to consider development guidelines for the use of property within the City of
Baldwin Park for mobilehomes or mobilehome parks and the installation of such
uses during the period of the study could frustrate the ability of this City
to accomplish the purposes for which the study was initiated.
