HomeMy WebLinkAboutORD 760ORD 760pT3(ÌìÑÔORDINANCE NO. 760 F^r 9/^/7^ j SE:co;r /^/^fi AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADDING CERTAIN SECTIONS TO THE BALDWIN PARK ZONING CODE RELATING TO THE DEVELOPMENT AND MAINTENANCE STANDARDS FOR MOBILE HOME PARKS AND CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT CASE NO. AZC-74) WHEREAS, the City Council has previously adopted Ordinance No. 756 establishing an interim moratorium on the construction of mobile home parks in the City; and WHEREAS, the Planning Commission of the City of Baldwin Park and the City Council have held public hearings concerning the adoption of standards for the development and expansion of mobile home parks. NOW, THEREFORE, the City Council of the City of Baldwin Park does ordain as follows: SECTION 1. Ordinance No. 756 is hereby repealed. SECTION 2. The Municipal Code of the City of Baldwin Park is hereby amended to add Part XXIII as follows: PART XXIII 9880. PURPOSE. In order to provide for the regulation and control of the construction, development or expansion of mobile home parks, the following regulations shall be applicable to the construction, development or expansion of mobile home parks. 9881. USES AND DEVELOPMENT PERMITTED. No person shall construct, develop or expand a mobile home park except as provided herein. The construction, development or expansion of a mobile home park shall be permitted upon the issuance of a Conditional Use Permit in R-3 Medium Multiple Residential) and C-2 General Commercial Zones). As used herein, mobile home park" shall mean any area or tract of land where one or more mobile home sites are rented or held out for rent, and shall include a trailer park. As used in this section, site" means any area or land designated or used for the occupancy of one mobile home or camp car. Mobile home parks shall also include all recreation buildings and facilities for the sole use of the occupants of the mobile home park and other accessory buildings appurtenant to the mobile home. 9882. DEVELOPMENT STANDARDS. The construction, development or expansion of mobile home parks shall conform to the following standards: 1) Density and Size. a) Initial mobile home park development shall be allowed on sites no smaller than five 5) acres in size. b) The mobile home lot shall be at least 3,500 square feet in size. c) The maximum density of dwelling units/acre shall not exceed seven dwelling units. BIB] 37960-U01 ORD-U02 760-U02 LI2-U03 FO31548-U03 FO32626-U03 DO32633-U03 C5-U03 ORDINANCES-U03 12/4/2003-U04 ROBIN-U04 ORD 760pT3(ÌìÑÔOrdinance No. 760 Page 2 2) Open Space and Recreation Areas. a) A recreation area of not less than 8% of the gross area of the site shall be provided. b) In addition to the area provided in 2(a) fifty 50) square feet per dwelling unit of recreation area shall be provided for facilities which permit children. c) Within each mobile home lot an open space of at least 300 square feet must be developed and maintained in landscaping. 3) Parking. a) Two 10" x 20' parking spaces are required at each mobile home space. At least one space must be covered. The parking spaces may be in tandem. b) Guest parking shall be provided at the rate of one space for each two mobile home spaces. The parking shall be distributed uniformly throughout the park, 4) Utilities. a) All utilities within the park, including but not limited to, electricity, telephone, and C.A.T.V. shall be placed underground. 5) Setbacks. a) There shall be maintained along all public street frontages a minimum 20 foot wide landscaped setback area. 6) Walts and Fences. a) Walls or fences will be required where necessary to aid in the creation of a controlled residential environment. Solid walls will be required to separate the park from the non-residential and single family uses. 7) Street Improvements. a) Public street improvements may include dedication of right-of-way and improvement per city standards for curbs and gutters, paving, sidewalk, driveway approach, street lights and street trees and such similar activities as found necessary by the City Engineer. b) Private on site) street widths must conform to state regulations as a minimum. 8) Grading Plans. a) A grading plan to assure proper site drainage and/or compaction of soil must be approved by the City Engineer. BIB] 37960-U01 ORD-U02 760-U02 LI2-U03 FO31548-U03 FO32626-U03 DO32633-U03 C5-U03 ORDINANCES-U03 12/4/2003-U04 ROBIN-U04 ORD 760pT3(ÌìÑÔOrdinance No. 760 Page 3 9) Landscaping. a) Attempts to retain existing and mature trees must be exhibited on the site plan. b) New trees, at least one per space, shall be at least 15 gallon size. c) All areas that are not devoted to automobile, pedestrian, or mobile home siting shall be landscaped, irrigated, and permanently maintained. 10) On Site Lighting. a) On site lighting shall be low profile and low intensity lighting fixtures. 11) Maintenance Facilities. a) Storage units of at least 9 cubic feet for each tenant shall be provided. b) An enclosed facility shall be required for the mobile home park maintenance equipment. c) Trash areas shall be located behind a view obscuring fence or wall. SECTION 3. This ordinance shall not apply to the initial construction and development of any mobile home park for which a Conditional Use Permit has previously been issued, but shall apply to the expansion of any such mobile home park. SECTION 4. The City Council, having held a public hearing hereon, has considered and hereby certifies a Negative Declaration of Environmental Impact with respect to said ordinance. SECTION 5. The City Clerk shall certify to the adoption of this ordinance and cause the same to be published in the manner prescribed by law. APPROVED AND ADOPTED this 6th day of October. 1977.
