HomeMy WebLinkAboutORD 772ORD 772pT3(ÌìÑù//7/^... / /fP ORDINANCE NO. 772 AN ORDINANCE OF THE CITY COUNClLw-ftfr- CITY OF BALDWIN PARK AMENDING SECTIONS 1208 AND 2201 OF THE BALDWIN PARK MUNI- CIPAL CODE THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. Section 1208 of the Baldwin Park Municipal Code is hereby amended to read as follows: 1208. DEFINITIONS: a) Cash Deposit. Wherever this Code requires a cash deposit for any purpose, a valid and sufficient corporate surety bond may be deposited in lieu thereof, if approved by the City Manager. b) City shall mean the City of Baldwin Park. c) City Manager shall mean the duly appointed and acting City Manager of the City. d) Council shall mean the City Council of this City. e) County shall mean the County of Los Angeles. f) Director of Commercial and Industrial Development shall mean the the duly appointed and acting Director of Housing and Economic Development. g) Director of Finance shall mean the duly appointed and acting Director of Administrative Services. h) Director of Planning shall mean the duly appointed and acting Director of CommunTty Development. i) Director of Public Works shall mean the duly appointed and acting Director of Community Development. j) Director of Recreation and Parks shall mean the duly appointed and acting Director of Human Services. k) Fire Chief shall mean the Fire Chief of the City or his authorized deputy. 1) Gender. The masculine gender includes the feminine and neuter. m) Oath shall include affirmation. n) Office. The use of the title of any officer or employee of the City shall mean the then holder of such office. Owner as applied to a building, land, or personal property, shall mean any part owner, joint owner, tenant, of the whole or a part thereof. p) Person as used in this Code or in any uniform code adopted hereby, includes any person, firm, association, organization, partnership, business trust company or corporation, and any municipal, political or governmental corporation, district, body or agency, other than the City. q) Shall and May. Shall is mandatory and may is permissive. r) State shall mean the State of California. s) Tenant or Occupant, as applied to a building or land, shall include any person who occupies the whole or part of such building or land, whether alone or with others, or a person who is entitled to such occupancy. Section 2201 c) of the Baldwin Park Municipal Code is hereby amended to read as follows: 2201 c) Unciass i fi ed Servi ce Empioyees- The persons now, or hereafter, holding any of the following positions shall be deemed to be included within the Unclassified Service of the City. Unclassified Service employees shall not be subject to the provisions of this Chapter with reference to the City's Personnel System; nor shall such Unclassified Service employees be subject to, or governed by, the provisions of the City's Personnel Rules and Regulations. Appointments to, and dismissals from, positions in the Unclassified Service shall be governed, exclusively, by the provisions of this Section. 1) City Council Appointees. Persons holding any of the positions enumerated in this Subparagraph shall be appointed by, and serve at the pleasure of, the City Council. a. Any person employed by the City as an independent contractor for the purpose of performing a specific function or service; b. A11 persons serving on any City cormiission. committee, or board; c. The City Manager; d. The Fire Chief; e. The City Attorney. 2) City Manager Appointees Unclassified Service Employees. Persons holding any of the following offices shall be appointed by/and serve at the pleasure of, the City Manager, providing any action taken by the City Manager in the appointment of or dismissal of any person referred to in this Subparagraph shall not be effective unless such action is concurred in by not less than three 3) members of the City Council. a. Director of Administrative Services; b- Director of Community Development; c. Director of Housing and Economic Development; d. Director of Human Services e. Police Chief. 3) City Manager Appointees. Persons holding any of the following positions shall be appointed by, and serve at the pleasure of, the City Manager. a. All part-time employees; b. All temporary employees; c. Any position which is funded, in whole or in part, by a State or Federal grant." SECTION 3. That the City Clerk shall certify to the adoption of this Ordinance and shall cause the same to be published in the manner prescribed by law.
