AZC-78) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 9410 is hereby added to the Baldwin Park Zoning Code, to read as.follows: 9410. Re-Designation of Zone Titles, Whenever in th is Code reference is made to the zoning classi- fications: 1) R-2", the same shall be deemed to read, R-G Residential-garden)"; and 2) R-3", the same be deemed to read, R-3 High Density Residential)". SECTION 2. That Section 9430(L) of the Baldwin Park Zoning Regulations is hereby amended by adding thereto as subsection 14, the following: 14. Lot, Flag, shall mean a lot, created after the effective date of Section 9552.1 of this Code, which is located to the rear of another lot, except for an extension thereof, not less than fifteen 15) feet in width, which is utilized for direct access to a public street for such flag lot." SECTION 3. That Section 9552.1 is hereby added to the Baldwin Park Zoning Code to read as follows: 9552.1. Flag Lots. a) Creation. A flag lot may be created from any lot which meets the following criteria: 1) that the same is classified in Zone R-l; and 2) that the same contains not less than 13,500 square feet of lot area; and 3) that the same has not less than 75 feet of street frontage. b) Standards for Flag Lots. Each flag lot shall observe the following minimum required yard areas: 1) rear yards, not less than ten 10) feet in depth; and 2) side yards, not less than 5 feet in depth; and 3) front yards not less than twenty 20) feet in depth. Attached hereto, marked Append ix 9552.1" is that certain drawing, described as P'lag Lot-Typical Development". Said drawing shall be utilized for guidance in interpreting the provisions of this section. SECTION 4. That subsections 1 and 2 of Section 9562 of the Baldwin Park Zoning Code, are hereby amended to read, respectively, as follows: 1 Lot Areas. a) Lot Area. No lot, classified in this zone shall be created after the effective date hereof, having less than 6,000 square feet in lot area. b) Lot Area per Dwelling Unit. One dwelling unit shall be permitted on such lot for each 3,000 square feet of lot area 14.52 dwelling units per acre). 2 Lot shall be Width. That attached hereto, marked Appendix 9562", is that certain drawing, described as Proposed R-G yard requirements for Typical Development". Said drawing shall be utilized for guidance in interpreting the provisions of this section. SECTION 5. That subsection 3(b) of Section 9571 of the Baldwin Park Zoning Code is hereby amended by adding thereto, the following, as subsection 4): 4) Additional side yard requirements. Whenever any lot in this zone has a common lot line with a lot classified in Zone R-l, the side yard requirements, above set forth, shall be increased by one foot 1') for each two feet 2') of building heighth of the building located upon such R-3 zoned lot, over ten feet 10')." SECTION 6. That Part XI of Chapter 4 of Article IX of the Baldwin Park Municipal Code, consisting of Sections 9580 through and including inclusive, is hereby amended to read as follows: Part XI" RESIDENTIAL PLANNED DEVELOPMENT ZONE OVERLAY) 9580. Purpose and Intent. The purpose of the City Council in the enactment of this Part is to provide for flexibility and creativity in the use and design of residential developments in order to encourage a variety of housing types and environments 9581. Applicability. Planned development districts shall be created in the same manner as property is re class if ied from one zone classi ficat ion to another, in the manner set forth in Section 9610 et seq. hereof. When a planned development district has been so created, it shall be designated upon the zoning map of the City, as an overlay zone, by adding the parenthetically enclosed letters PD" after the zoninq symbol indicating the underlying zone in which the subject property is classified. 9582. Effect of Creation of Planned Development Districts. No building permit shall be issued for the construction, reconstruction or relocation of any building or structure, nor shall any use of land be commenced or permitted on any lot within the City which is classified a Residential Planned Development District, unless a development plan therefore herein- after referred to as Plan") has been approved, in the time and manner set forth herein. Development plan Submittal. Concurrently with an application for reel assification to a PD Zone, a plan therefor shall be submitted, which includes all of the following: 1. The number of the lots involved, if more than one, the lot dimensions and total area; and 2. The location, proposed use, size, height, floor plans, elevations of all proposed and existing buildings on the subject lot or lots, type and color of materials to be used on building exterior; and 3. The location, height and type of all walls and fences; and 4. The location and dimension of public and private streets, accessways, pedestrian walkways and loading areas; and 5. A vicinity map locating subject site relative to street intersections in the general vicinity; and 6. The location, height, and design of outdoor lighting fixtures; and 7. A schematic plan for the landscaping of the development, including the location and size and type of planting, and a statement setting forth the method by which such landscaping shall be maintained after installation; and 8. Proposed covenants and restrictions; and 9. A phasing plan if said development is to occur in increments; and 10. Any other information as may be deemed necessary by the Planning Division. 9584. Uses Permitted, No person shall use any property classified in PD Zone for any use other than the following: 1. Principal Uses, Dwelling units. 2. Accessory Uses. Permitted accessory uses, buildings or structures, including but not limited to, related recreational and community facilities designed for the exclusive use by residents within a planned development. 9585. Property Development Standards Areat Minimum project size: 15,000 square feet gross) Density. Maximum density permitted: the maximum density per acre of a planned development shall not exceed the density of the General Plan and the underlying zone classification and the formulas hereinafter set forth. Lots classified in Zone C-M are subject tothe provisions of Article IX, Chapter IV, Part IV of this Code, commencing with Section 9460, relating to precise plan review. SECTION 9. That Part XVII, Chapter One, Article IX of the Baldwin Park Zoning Code is hereby amended to read as follows: 9640. Purpose and Intent. The purpose and intent of the City Councilis to establish and provide recreational and open space resources, and to prevent incompat ibie development of areas that should be preserved or regulated for scenic, recreational, historic, conservation, aesthetic or health and safety purposes. 9641. Permitted Uses. 1. The following uses may be permitted within the Open Space Zone: a) public buildings, auditoriums and similar public structures. b) public school buildings and recrea- tional uses. c) Public utility rights-of-way, d) Flood control channels and similar flood control structures, e) Creeks, rivers, spreading grounds and other similar water courses. f) Any other publicly owned and and operated use. 2. The following uses shall also be permitted, provided a conditional use permit has first been approved as provided in Section 9427 et seq. hereof: a) Agricultural and horticultural cultiva- tion b) Hiking or equestrian trails. SECTION 11. That Sections 9642 and 9643 of the Baldwin Park Zoninq Code are hereby repealed and rescinded. i SECTION 12.
