ORDINANCE NO. 808
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK ADDING TO AND AMENDING
CERTAIN SECTIONS OF THE BALDWIN PARK
MUNICIPAL CODE RELATING TO HOUSE MOVING
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
ORDAIN AS FOLLOWS:
SECTION 1. That subsection e) of Section 7400 of the
Baldwin Park Municipal Code is hereby amended to read as
follows:
e) Director shall mean the Director of
Community DcTvelopment, or his authorized represen-
tative.
SECTION 2, That subsections
a)(8) of Section 7702 of the Baldwin
amended to read as follows;
a) 1) a) 4)

SECTION 3. That subsection a) of Section 7704 of
the Baldwin Park Municipal Code is hereby amended to read as
follows:

by the zoning laws of the City; or
vi) if the structure is of a type
proln bited at the proposed 1ocafcion, by any other
law; or
vii) not architectually compatible with
other existing buildings and structures located
in the immediate area of its proposed site;
provided, however, that if the condition of the building
or structure, in the j udgment of the Director, is such
that it can be practicably and effectively repaired, so
as to meet the requirements of this Section, the permit
may be issued subject to appropriate conditions as
hereinafter provided."
SECTION 4. That subsection b)(2) of Section 7704 of
the Baldwin Park Municipal Code is hereby amended to read as
follows:
b) Insurance, Performance Bonds, Street Permits
2) Where the buiIding is to be moved or removed
to property within the City, the applicant shall file
a performance bond in an amount to be determined by
the Director, but in no event less than Twenty-five
Thousand Dollars $25,000), in the form of cash, surety
bond or certificate of credit guaranteeing the per-
formance within ninety 90) days of all labor and
materials necessary to make said building or structure,
when moved to such location, comply with all applicable
laws and ordinances including, but not limited to,
the various health, building and zoning regulations of
the City. In the event the building is to be moved or
removed out of the City, such performance bond shall
be filed, guaranteeing the completion of such
removal as prescribed by the terms of the permit issued
hereunder, in an amount not to exceed Five Thousand
Dollars $5,000).
SECTION 5. That Section 7710 is hereby added to the
Baldwin Park Municipal Code to read as follows:
7710. Exception„ The provisions of this
Chapter shall not apply to new modular or prefabri-
cated butIdinqs or structures."
SECTION b. That the City Clerk shall certify to the
adoption of this Ordi nance and shall cause the same to be
published in the manner as prescribed by law.
