HomeMy WebLinkAboutORD 1049ORD 1049$Í;¢f4À# ORDINANCE NO. 1049 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM FC FREEWAY COMMERCIAL, TO FC SV) FREEWAY COMMERCIAL SIERRA VISTA OVERLAY ZONE ON APPROXIMATELY 62 ACRES OF REAL PROPERTY LOCATED WITHIN THE SIERRA VISTA REDEVELOPMENT PROJECT AREA APPLICANT: CITY OF BALDWIN PARK; CASE NO.: Z-502) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin ark does hereby find, determine, and declare as follows: a) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq. of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park to reclassify certain real property, as described in Exhibit A" attached hereto from FC, Freeway Commercial to FC SV), Freeway Commercial Sierra Vista Overlay zone and b) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the reclassification to FC SV); and c) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, convenience, and general welfare require the change in zone classification, herein described. SECTION 2. That notwithstanding the provisions of Section 12.54 of the Baldwin Park Municipal Code, the Zoning classification of the property described on Exhibit A" attached hereto and incorporated herein, is hereby reclassified from zone FC to FC SV). SECTION 3. That the City Council at the time of the public hearing for the above matter, reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve, adopt and order filed the proposed Negative Declaration since there is no substantial evidence that the project will have a significant adverse effect on the environment. SECTION 4. That in conjunction with the Negative Declaration, the City Council considered and does hereby approve, adopt and order filed the California Department of Fish and Game, Certificate of Fee Exemption for De Minimis Impact Finding, as the environmental analysis offers no substantial evidence that the proposed zone changes will have potential for an adverse effect, either individually or cumulatively, on wildlife resources, as defined in Section 711.2 of the Fish and Game Code. That the City Clerk shall certify to the adoption of this ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Negative Declaration of Environmental Impact and Certificate of Fee Exemption for De Minimis Impact Finding in the manner prescribed by law.
