HomeMy WebLinkAboutORD 1054ORD 1054$Í;¢f4À  ORDINANCE NO. 1054 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CHAPTER 5.08 OF DIVISION I OF TITLE 5 OF THE BALDWIN PARK MUNICIPAL CODE REGARDING BUSINESS LICENSE TAXES ON WAREHOUSES, RENTALS OF REAL PROPERTY, FILMMAKING, AND MISCELLANEOUS BUSINESSES THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Chapter 5.08 of Division I of Title 5 of the Baldwin Park Municipal Code is hereby amended by deleting Section 5.08.040 A Apartments) in its entirety. SECTION 2. Chapter 5.08 of Division I of Title 5 of the Baldwin Park Municipal Code is hereby amended by adding Section 5.08.095 to read as follows: 5.08.095 Filmmaking, motion pictures, television productions. a. Persons or organizations engaged in the business of filmmaking, motion pictures, or television productions shall pay a business license tax of One Hundred Dollars $100.00) for each day that such personnel and/or equipment, including props and temporary sets, into the city, and including the photographing and recording of exterior and/or interior scenes." b. For the purpose of this section, filmmaking, motion pictures, and television productions" include the development of a screen story, whether based on fact or fiction, the photographing of said story by means of photographic film, magnetic tape, or other device, and the cutting, scoring, editing and final preparation of the picture. SECTION 3. Chapter 5.08 of Division I of Title 5 of the Baldwin Park Municipal Code is hereby amended by adding Section 5.08.175 to read as follows: 5.08.175 Rentals residential and nonresidential. a. Every person conducting, managing or carrying on the business of operating apartments, or multiple dwelling units, as defined in the zoning regulations of this Code, containing two or more such units which are offered for rental or lease, located in a single structure or multiple structures, under common ownership, regardless of zone, shall pay an annual license fee of Fifteen Dollars $15.00) per unit. b. Every person who owns a single family unit one house per lot) and who rents out or leases said single family unit to another shall pay an annual license tax of Thirty Dollars $30.00) for each single family unit offered for rent or lease. Every person engaged in the business of rental of nonresidential property shall pay an annual business license tax of Fifty Dollars $50.00) plus Ninety-Five Cents $.95) per every One Thousand Dollars $1,000.00) in rental income in excess of Twenty-Five Thousand Dollars $25,000.00) annually. For the purposes of this section, rental of nonresidential property" means any business conducted or carried on by any person engaged in the business of renting or letting a building or structure of any kind, including, but not limited to, office buildings, warehouses, commercial spaces, and industrial spaces, to a tenant for purposes other than dwelling, sleeping or lodging." SECTION 4. Chapter 5.08 of Division I of Title 5 of the Baldwin Park Municipal Code is hereby amended by adding Section 5.08.225 as follows: 5.08.225 Warehouse, distribution, storage. a. Every person engaged in the business of maintaining a warehouse, distribution facility, and/or centralized record storage in the City of Baldwin Park shall pay an annual business license tax of One Hundred Dollars $100.00) plus Three Cents $.03) per square foot of chargeable covered and enclosed space. Chargeable covered and enclosed space," for this purpose, means the covered and enclosed space determined to be within the perimeter of a commercial or industrial structure. The determination of the chargeable covered and enclosed space within the perimeter of a commercial or industrial structure shall be made by the building department of the city. b. For purposes of this section, warehouse, distribution center, storage facility and/or centralized record storage" shall mean any building or structure, or portion thereof, used primarily for the deposit, storage or safekeeping of goods regardless of whether the goods are offered for sale. SECTION 5. Chapter 5.08 of Division I of Title 5 of the Baldwin Park Municipal Code is hereby amended by amending Section 5.08.240 to read in its entirety as follows: 5.08.240 Business not expressly provided for. Every person engaged in a business, as to which a business license tax is not specifically set forth in this Division,shall pay an annual license fee of Fifty Dollars $50.00), plus Nine Dollars $9.00) for each employee in excess of three 3)." SECTION 6. This Ordinance is for the purpose of raising revenue for the general fund of the City, to be utilized for general governmental purposes. It is an Ordinance. relating to taxes, and is for the purpose of meeting the usual and current expenses of the city. It shall be effective immediately upon passage pursuant to Government Code Section 36937(d). SECTION 7. The City Clerk shall certify to the passage of this Ordinance and cause the same to be published as required by law.
