HomeMy WebLinkAboutORD 1073ORD 1073pT3(Ìì¿  ORDINANCE No. 1073 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AMENDING CHAPTER 8.08 OF THE MUNICIPAL CODE REGARDING REAL PROPERTY CONSTITUTING PUBLIC NUISANCES THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOW: SECTION 1: Subsections C and D of Section 8.08.010 of Chapter 8.08 of the Baldwin Park Municipal Code are hereby repealed. SECTION 2: Subsections C, D, E, F, G, H, I, J, K, and L of Section 8.08.010 of the Baldwin Park Municipal Code are hereby added to read in their entirety as follows: C. To maintain upon such property clotheslines in front yard areas visible from a public street or in backyard areas which are not surrounded by a six foot solid fence; or D. To maintain upon such property trash, garbage or refuse cans, bins, boxes or other such containers stored in front or side yards and visible from public streets and rear yards where such trash, garbage, etc., is visible to adjacent properties, except as may be allowed by the City Code, or so as to cause offensive odors to neighbors; E. To maintain upon such property lumber, junk, trash, debris or salvage materials visible from a public street, alley, or adjoining property, except as may be allowed by City Code; or F. To maintain upon such property an attractive nuisance dangerous to children, including abandoned, broken, or neglected equipment and machinery, refrigerators and freezers, hazardous pools, ponds, or excavations; or G. To maintain upon such property abandoned, discarded or unused furniture, stoves, sinks, toilets, cabinets, or other household fixtures or equipment stored 50 as to be visible from a public street, alley, or from adjoining properties except as may be allowed by the City Code; H. To maintain upon such property unpainted buildings or buildings having dry rot, warping or termite infestation, or peeling, chipped, or cracked paint; or I. To maintain upon such property overgrown vegetation; dead, decayed, diseased or hazardous trees; weeds and other vegetation likely to harbor rats, vermin or nuisances or which may be a fire hazard; or J. To maintain the property as a dumping ground. Whenever it has been determined that any unimproved real property within the City has become a dumping ground for litter, garbage, junk, debris, illegal vehicle parking, or discarded vehicles, vehicle parts and/or vehicle hulks, the director may order the property owner(s) to secure the property to prevent further dumping on the property by requiring the owner(s) to erect and maintain chain link fencing with gate(s) a minimum of six feet in height to reduce or eliminate accessibility to the property; or K. To maintain upon such property fences or walls which violate zoning regulations regarding height or setbacks, or which are in a hazardous condition, or which are in disrepair, or which hinder free access to public sidewalks; or" SECTION 3: Current Subsections E, F, G, H and I are hereby relabeled as Subsections M, N, 0, P, and Q. SECTION 4: The City Clerk shall certify to the passage of this Ordinance and cause the same to be published as required by law, and the same shall take effect thirty 30) days after the date of its adoption by the City Council of the City of Baldwin Park. PASSED, APPROVED AND ADOPTED by the City Council of the City of Baldwin Park at a regular meeting held on the 15th day of September 1993.
