HomeMy WebLinkAboutORD 1078ORD 1078pT3(Ìì¿‘ ORDINANCE NO. 1078 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, AMENDING CHAPTER 17.08 OF THE MUNICIPAL CODE REGARDING GENERAL REGULATIONS FOR RESIDENTIAL ZONES THE CITY COUNCIL OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: Section 17.08.080, Subsection A is amended in its entirety to read as follows: A. Definitions. The following words or terms, for purposes of this section, shall be defined as follows: 1. Park" means the standing of a motor vehicle, other than for the purpose of loading or unloading merchandise or passengers. 2. Repair" means the act of putting in working order and shall include to fix, recondition, replace, adjust, rebuild, patch, install, maintain or service. 3. Minor Repairs" mean the following activities on a motor vehicle: a) Installation or replacement of fan belts, hoses or filters. b) Installation or replacement of fluids, lubricants or oil products. c) Installation or replacement of brake pads. d) Installation or replacement of an alternator, fuses, radio, spark plugs or a battery. e) Installation, replacement or rotation of tires. f) Installation or replacement of lighting devices/bulbs or antennas. g) Installation or replacement of any sound reproductive system, cellular phone, television system, or short wave radio system. h) Installation or replacement of interior cabin fixtures or components with the exception of seats. i) Servicing a transmission, radiator or carburetor. j) Installation or replacement of the electrical or fuel system. k) The patching of any seat cover. 4. Major Repairs" mean the following activities on a motor vehicle: a) To disassemble, install or rebuild an engine block. b) To disassemble, install or rebuild a transmission. c) To disassemble, install or rebuild any seats. d) To re-upholster or otherwise cover any seats. e) To disassemble, fix, rebuild, install, refinish, or paint any body parts and which consist of any of the following: front or rear hoods, door panels, roof or side panels or bumpers. f)To disassemble, fix, rebuild, or install a suspension system. g) To disassemble, fix, rebuild, or install an emission control system or a drive train. h) The undertaking or performance of any minor repair which, by its nature, requires, necessitates or involves any activity which is defined as a major repair. i) Any repair which is not defined as a minor repair. Store" means to keep or locate for future use. 6. Vehicle or motor vehicle" means and includes motor vehicles as defined in this section, motor driven cycle, motor truck, passenger vehicle, recreational vehicle, station wagon, truck, tractor, and vehicle, as these phrases are defined in the Vehicle Code of the state, and all similar types of vehicles. SECTION 2: Section 17.08.080, Subsection C is amended in its entirety to read as follows: C. Repair of Motor Vehicles In Any Residential Zone. 1) Minor Repairs Minor repair of a motor vehicle on private property in a front, side or rear yard which is visible to a street, alley, public way or to any adjoining private property, is a permissible use in any residential zone subject to the following limitations: a) The repair shall be made only on a paved driveway or on a parking space as respectively defined Section 17.04.195 and 17.04.500 of the municipal code. The repair of a motor vehicle on any front or side yard is expressly prohibited. b) The repair may be conducted in completely enclosed garage or outdoors in a rear yard provided that said yard is completely enclosed by a lawfully constructed six foot(6') high fence which screens the yard from view of any public right of way and all adjoining property. c) The repair to any one vehicle shall not exceed two calendar days in any thirty day period. 2) Major Repairs Major repair of a motor vehicle on private property in any residential zone is a permissible use subject to the following limitations: a) The repairs shall only be conducted in a completely enclosed garage or outdoors in a rear yard provided that said yard is completely enclosed by a lawfully constructed six foot(6') high fence which screens the yard from view of any public right of way and all adjoining property. The major repair of a vehicle in any other area is expressly prohibited. b) Major repair to any one vehicle shall not exceed five calendar days in any thirty day period. 3) Conditions and Limitations Applicable To All Repairs a) No more than one vehicle shall be repaired at a time. b) The vehicle being repaired must be registered with the California Department of Motor Vehicles at the: property where the repair is being undertaken or performed. Registration must be current and valid. Repairs made to any other vehicles, whether or not for compensation of any kind, are expressly prohibited. c) No repair activity shall be undertaken before 7:00 a.m. or continued after 10:00 p.m. d)No tools, motor vehicles parts, supplies or equipment shall be left, stored or maintained outdoors(which are visible from a public right of way or an adjoining property] upon any interruption or cessation of repair work e) All fluids, liquids and oil or other petroleum products which are taken out of a motor vehicle or used in conjunction with any repair work shall be lawfully disposed of. In no instance shall these products or substances be allowed to drain or spill onto adjoining real property or into a public right of way, storm drain, plumbing or sewer system. f) Notwithstanding any provision of this section to the contrary, no minor or major repair work shall be permitted or conducted in any manner which violates any other provision of this code. 2) BIB] 37650-U01 ORD-U02 1078-U02 LI2-U03 FO4263-U03 FO4331-U03 DO4351-U03 C5-U03 ORDINANCES-U03 10/11/2001-U04 ADMIN-U04 ORD-U05 1078-U05 MAY-U05 4-U05 1994-U05 ORD 1078pT3(Ìì¿‘ g) Storage of inoperable vehicles is prohibited at any time except in an approved enclosed storage facility. 4) Violation of Law. A violation of any provisions of this section is declared to be unlawful and is punishable pursuant to Section 1.20.010 of this Code. SECTION 3: Section 17.08.080, Subsection D of the Baldwin Park Municipal Code is hereby repealed. SECTION 4: Section 17.08.090 of the Baldwin Park Municipal Code is amended in its entirety to read as follow: Storage of Boats, Trailers, Camper Shells and Recreational Vehicles" No person shall store, park or maintain any boat, trailer, camper shell or recreational vehicle, or parts thereof, in any required front yard area on any R" zoned lot. The boat, trailer, camper shell or recreational vehicle, or parts thereof, may be stored or parked in a side yard provided that a lawfully installed and permanently maintained wall or fence six feet in height screens such boat, trailer, camper shell or recreational vehicle, or parts thereof, from abutting property and from the public right of way. SECTION 5: The City Clerk shall certify to the passage of the Ordinance and cause the same to be published as required by law, and the same shall take effect thirty(30) days after the date of its adoption by the City Council of the City of Baldwin Park.
