AN ORDINANCE OF THE CITY OF BALDWIN
PARK AMENDING SECTION 15.04.040 OF
THE BALDWIN PARK MUNICIPAL CODE
RELATING TO APPEALS OF ORDERS,
DECISIONS OR DETERMINATIONS MADE BY
THE CITY'S BUILDING OFFICIAL
WHEREAS, the City of Baldwin Park has adopted the 1991 Edition of the
Uniform Building Code as the building regulations for the City of Baldwin Park: and
WHEREAS, Section 204 of the Uniform Building Code provides for a right
of appeal to any person affected by any decision of the Building Official with regard to
enforcement of the building regulations; and
WHEREAS, the City of Baldwin Park has amended Section 204 the
Amendment") to provide that the City Council act as the Board of Appeal in any such
appeal; and
WHEREAS, the language of the Amendment should be clarified as to the
scope of the City Council's role in said appeals.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN
PARK DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Section 15.04.040 of the Baldwin Park Municipal Code
is hereby amended to read in its entirety as follows:
15.04.040 Section 204 amended Right to
Appeal. Section 204 of the Uniform Building
Code is amended to read as follows:
Section 204 Right to Appeal. The City
Council shall hear and decide appeals of orders,
decisions or determinations made by the
Building Official relative to the application and
interpretation of this Code. The decision of the
City Council with respect to any appeal shall be
made by a majority of a quorum of the Council,
shall be in writing to the appellant with a
duplicate copy to the Building Official, and shall
be final and conclusive."
SECTION 2: The provisions set forth in Section 15.04.040 as
amended are declarative of existing law, and clarify the intent and scope of the City
Council's role in the appeal of any decision by the Building Official with regard to
enforcement of the building regulations of the city.
SECTION 3: This Ordinance shall be in full force and effect thirty 30)
days from and after its adoption.
