HomeMy WebLinkAboutORD 1106ORD 1106pT3(Ì쨍 ORDINANCE NO.1106 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADDING SECTION 130.025 TO THE BALDWIN PARK MUNICIPAL CODE TO PROHIBIT DAYTIME LOITERING BY MINORS DURING SCHOOL HOURS WHEREAS, the City Council of the City of Baldwin Park believes that students under the age of 18 must attend school to receive the necessary education; WHEREAS, students under the age of 18 are required to attend classes between the hours of 8:30a.m. and 1:30 p.m. or during other hours as designated by the respective school district; WHEREAS, some students attend compulsory continuation or independent studies education and should be involved in those related activities between 8:30 a.m. and 1:30 p.m.; WHEREAS, students who are truant during the school day create a law enforcement problem while loitering in public places or places where they are not under adult supervision; WHEREAS, such students who are truant realize no risk or legitimate consequence to their actions; and WHEREAS, the school district's suspension of such students places those same students back on the streets, resulting in additional law enforcement service costs. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. Section 130.025 is hereby added to the Baldwin Park Municipal code to read as follows: Section 130.025. Daytime Loitering by Minors a) In addition to the provisions of Section 130.02 of this code and except as provided in subsection b), it is unlawful for any person under the age of eighteen, who is subject to compulsory education or to compulsory continuation education, to loiter, idle, wander, or be in or upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places, public buildings, places of amusement and eating places, vacant lots or any unsupervised place, during the hours of 8:30 a.m. and 1:30 p.m. or during other hours as designated by the respective school district on days when school is in session. b) The provisions of this section do not apply in the following situations: 1) when the minor is accompanied by his or her parent, guardian or other adult person having the care and custody of the minor; 2) when the minor is on an emergency errand directed by his or her parent or guardian or other adult person having the care and custody of the minor; 3) when the minor is going directly to, or coming directly from, his or her place of gainful employment or to and from a medical appointment; or 1- BIB] 37643-U01 ORD-U02 1106-U02 LI2-U03 FO4263-U03 FO4300-U03 DO4307-U03 C5-U03 ORDINANCES-U03 10/11/2001-U04 ADMIN-U04 ORD-U05 1106-U05 AUG-U05 16-U05 1995-U05 ORD 1106pT3(Ì쨍 4) Z the minor is going directly to, or coming directly from, lunch or a school- related activity, and the minor has permission to leave campus for lunch or the school- related activity and has in his or her possession a valid, school issued, oft-campus permit. c) Violation of this Section shall constitute an offense for which the minor may be cited into the Juvenile Traffic Court System. SECTION 2. This ordinance shall be effective thirty 30) days from the date of adoption SECTION 3. The City Clerk shall certify to the passage and adoption of this ordinance and cause it to be published in the manner prescribed by law.
