AN ORDINANCE OF THE CITY OF BALDWIN
PARK AMENDING CHAPTER 111 RELATING
TO BUSINESS LICENSE TAXES
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: Sections 111.05,111.06, 111.08,111.09,111.10, 111.13,111.15,111.16,
111.17,111.18,111.21, 111.22,111.35,111.36, 111.37,111.38, 11139,andlll.51(c)of Chapter 111 are
amended by substituting the term City Clerk" in place of the terms City Manager" in each of those
Sections.
SECTION 2: Section 111.12 of Chapter 111 is amended to read in its entirety as follows:
111.12 License Issued Annually; Tax Due and Payable
A) Unless otherwise specifically provided in this Chapter,
all business licenses issued under the provisions of this
chapter shall be annual business licenses, and the business
license tax thereon shall be due and payable annually in
advance on the first day of the anniversary month of the
issuance of the license.
B) All business license taxes shall be payable in advance,
in lawful money of the United States, at the office of the City
Clerk of the City.
SECTION 3 The annual anniversary dates for businesses established in the City prior
to January 1, 1996 shall be adjusted, depending upon the amount of business license tax each pays, as
follows:

$215.00 $379.99 August 1,1996
$145.00 $214.99 September 1, 1996
$100.00 $144.99 October 1,1996
$95.00 $99.99 November 1, 1996
$88.00 $ 94.99 December 1, 1996
$ 5.00 $49.00 January 1,1997
$ 87.50 $87.99 February 1,1997
$ 80.00 $87.49 March 1,1997
$ 50.01 $79.99 April 1,1997
$ 49.01 $50.00 May 1, 1997
SECTION 4: Notwithstanding Section 3 of this Ordinance, businesses subject to an
annual anniversary date adjustment as set forth therein shall have the option of a) maintaining their current
anniversary dates of January 1 and paying their annual tax based upon that date, or b) adjusting their
anniversary dates, paying the pro rata amounts of their business license taxes based upon their new
anniversary dates, and thereafter paying their annual business license taxes on the adjusted annual
anniversary dates.

ORD 1109 pT3 (Ìì ¨ € SECTION 5: SEVERABILITY.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason
deemed to be or held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of
the City of Baldwin Park hereby declares that it would have adopted this Ordinance and each section,
subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses, phrases, or other portions might subsequently be declared
invalid or unconstitutional.
SECTION 6: EFFECTIVE DATE.
This Ordinance shall take effect on January 1,1996 under Government Code Section 36937 as
an Ordinance relating to taxes for the usual and current expenses of the City.
