AN ORDINANCE OF THE CITY OF
BALDWIN PARK AMENDING CHAPTER
91 RELATED TO ALARM SYSTEMS
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: Section 91.06, of Chapter 91 is amended to read in its entirety as follows:
91.06 False Alarm; Assessment Fees
Any subscriber who maintains or has an alarm connected to the Police
Department alarm board and any person who maintains any alarm system
regulated by this chapter shall be required to pay a prevention assessment
in an amount to be determined by resolution of the City Council for each
false alarm in excess of three false alarms in a calendar year.
SECTION 2: Section 91.14, of Chapter 91 is amended to read in its entirety as follows:
91.14 Failure to Pay Assesment Fee
When a prevention assessment has been levied against an alarm location,
and the subscriber fails to pay the prevention assessment within 30 days
following notification of the levy of the prevention assessment, the City
may file a small claims action against the subscriber.
SECTION 3. SEVERABILITY.
If any section. subsection sentence clause, phrase, or portion of this Ordinance is for any reason
deemed to be or held to be invalid or unconstitutional by the decision of any court of competent jursdiction,
such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of
the City of Baldwin Park hereby declares that it would have adopted this Ordinance and each
section,subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses, phrases, or other portions might subsequently be declared
invalid or unconstitutional.
SECTION 4. EFFECTIVE DATE.
This Ordinance shall take effect 30 days after adoption.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Baldwin Park at a regular
meeting held on the 21st day of February, 1996.
