HomeMy WebLinkAboutORD 1115ORD 1115pT3(퓬e ORDINANCE NO. 1115 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK REPEALING SECTION 132.04, BILLIARD AND POOL FACILITIES", AND ADDING SECTIONS 153.520 THROUGH 153.524, BILLIARD AND POOL HALL REGULATIONS OF THE BALDWIN PARK MUNICIPAL CODE APPLICANT: CITY OF BALDWIN PARK: CASE NO.: AZC-137). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 132.04, Billiard and Pool Facilities" of the Municipal Code is hereby repealed. SECTION 2. Sections 153.520 through 153.524, Billiard and Pool Hall Regulations" of the Municipal Code are amended to read as follows: BILLIARD AND POOL HALL REGULATIONS 153.520 PURPOSE The purpose of the provisions contained within this subchapter is to establish a comprehensive set of regulations applicable to the operation and location of billiard halls and to assure compatibility with surrounding properties. 153.521 DEFINITIONS Billiards. Billiards shall mean any of the several games played on a table, surrounded by an elastic ledge or cushions, with balls that are impelled by cues. Billiard and Pool Halls. Billiards and pool halls shall mean a place of business employing two or more billiard tables. 153.522 BILLIARD AND POOL HALLS CONDITIONALLY PERMITTED. Billiard and pool halls shall be conditionally permitted pursuant to this subchapter only if: A) A conditional use permit therefor is first obtained pursuant to the provisions of 153.642; and B) The real property upon which use is proposed to be located is classified pursuant to this code in the C-i, CBD, C-2, FC, CM, 01, IC, or I Zone; and C) Each application for a billiard or pool hall shall include a complete description of all aspects of the proposed operation, including but not limited to: hours of operation: number of employees on each shift: proposed interior and exterior improvements, including colors and materials samples, interior and exterior renderings: exterior lighting: security devices including cameras and Systems: and signs: in sufficient detail to provide a sense of the quality and character of the establishment. 153.523 DEVELOPMENT STANDARDS A) In general. The development standards as set forth in 153.090 et seq. shall apply except as this section specifically other"wise provides. All such development standards shall be observed at all times in the operation of any billiard or pool hall in the City. B) Location. All billiard halls established after the effective date of this ordinance shall comply with the following location criteria: 1) No Billiard or pool hall shall be located within 1,500 feet of a public park or a public or private school conducting classes between kindergarten and twelfth grades, or child care facility; and BIB] 37643-U01 ORD-U02 1115-U02 LI2-U03 FO4263-U03 FO4283-U03 DO4289-U03 C5-U03 ORDINANCES-U03 10/11/2001-U04 ADMIN-U04 ORD-U05 1115-U05 JUN-U05 5-U05 1996-U05 ORD 1115pT3(퓬eOrdinance No.: 1115 Page 2 2) No billiard or pool hall shall be located within 150 feet of a residentially zoned property, and 3) No billiard or pool hall shall be located within 1,000 feet of another billiard or pool hall. C) Age Restrictions 1) No person twenty 20) years of age and under shall be permitted in any billiard or pool hall which has been authorized to serve alcoholic beverages. 2) No person seventeen 17) years of age and under shall be permitted in any billiard or pool hall after 10:00 p.m. 3) No person sixteen 16) years of age and under shall be permitted in any billiard or pool hall between the hours of 8:00 a.m. and 3:00 p.m., Monday through Friday. This restriction shall not apply during school holidays and school vacations recognized by the public schools within the City. 4) No person, whether as owner, operator, or person in charge of any billiard or pool hall, shall permit any person to violate the age restrictions specified in Section 153.523(C). D) Hours of operation. Hours of operation shall be set as a condition of approval of the conditional use permit by the hearing body based upon the sensitivity of the area surrounding the proposed billiard hall. E) Supervision. Each billiard or pool hall operator shall maintain at least one adult attendant 21 years of age or older on the premises during all hours of operation. The precise number of adult attendants shall be set by the hearing body as a condition of approval of the conditional use permit. F) Security. 1) A security plan shall be submitted, for review and approval by the Police Department as a part of the conditional use permit application. 2) At least two interior security surveillance/recording cameras, and one exterior camera shall be installed and permanently maintained. All video tapes from said cameras shall be retained and made available for viewing by the Police Department for a minimum of seven days. 3) An electronic intrusion alarm system shall be installed and permanently maintained. 4) The interior and exterior of the building shall be brightly lighted with no dark areas. G) Interior signage. Signage informing the public of the prohibition on the use of drugs, smoking, loud cc conduct, age restrictions, and hours of operation shall be posted and plainly visible to customers within the establishment in at least two locations. H) Open view. 1) Windows and glass doors shall be maintained so that a clear and substantially unobstructed view of the interior from outside exists to the satisfaction of the hearing body, but in no circumstance shall more than ten percent of each individual glass door and/or window be covered in any manner. 2) No partitions forming rooms, stalls, or other enclosures where the public congregates shall be permitted. This provision, however, shall not be construed to preclude the maintenance of washrooms, toilet rooms for proper purposes or the maintenance of closets for storage purposes exclusively. J) Billiard and Pool halls which have been authorized to serve alcoholic beverages shall enforce a customer dress code, which shall at a minimum prohibit gang attire. Said dress code shall be posted at all public entrances. K) Any form of gambling is prohibited. 153.524 DESIGN REVIEW REQUIREMENTS. All billiard or pool halls established pursuant to this subchapter shall be subject to the provisions contained in 153.655 et seq. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council based upon its public review, does approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant impact on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this ordinance and shall cause the same to be published in the manner prescribed by law, and shall forward a certified copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Negative Declaration of Environmental Impact in the manner prescribed by law.
