HomeMy WebLinkAboutORD 1123ORD 1123pT3(퓬 ORDINANCE NO. 1123 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 153.385 ET SEQ., SIGN REGULATIONS", AND RELATED SECTIONS OF THE BALDWIN PARK MUNICIPAL CODE APPLICANT: CITY OF BALDWIN PARK: CASE NO.: AZC-141). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin park does hereby find, determine and declare as follows: a) That the City of Baldwin Park hereinafter Applicant") heretofore initiated a study to amend Sections 153.385 through 153.396, Sign Regulations", of the Baldwin Park Municipal Code; and b) That on January 22, 1997, the Planning Commission conducted a duly noticed public hearing upon said Application and recommended that the amendments be approved: and c) That the Planning Commission recommends that the City Council approve the amendments Case No.: AZC-141) and also consider the following changes: i) A reduction in the amount of time a temporary sign can be displayed from 180 days as proposed: and ii) An increase in the sign height and sign face area for freeway oriented freestanding signs, which have been incorporated as changes proposed to the City Council; and iii) A reduction in the abatement period for signs that may become nonconforming as a result of the proposed changes to less than five(S) years as proposed; and iv) A reduction in the amount of window coverage for temporary signs to less than 90% as proposed; and SECTION 2. That on February 19, 1997, the City Council conducted a duly noticed public hearing upon said Application: a) That the proposed changes provide for the protection of health, safety and welfare of the residents of Baldwin Park; and b) That the proposed changes are not detrimental to the properties within the City; and c) That the proposed changes are consistent with the spirit and intent of the General Plan; and d) That the City Council conducted a duly noticed hearing upon said matter, and based upon the evidence presented, it was determined that the public interest, necessity, convenience and general welfare require the approval of the amendments to the Sign Regulations of the Code. SECTION 3. That Sections 153.385 through 153.396 of the Municipal Code should be amended to read as shown on Exhibit A", attached. SECTION 4. That Sections 153.153 B), 153.183 B), 153.198 C), and 153.213 B), of the Municipal Code are hereby rescinded. SECTION 5. That Section 153.656 A) of the Municipal Code should be amended to read as follows: A) Prior to the issuance of any permits for the construction, or exterior alteration of any building or structure in the RG, R-3, C-I, F-C, C-2, 0-I, C-M, I-C, I, or 0 Zones, or the issuance of permits for the construction or exterior alteration of any freestanding sign which exceeds a height of forty 40) feet or exceeds a sign area of three hundred 300) square feet, an application shall be made for design review." That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration of Environmental Impact. That the City Council, based upon its public review, does hereby find that said Negative Declaration has been prepared and was considered pursuant to the provisions and guidelines of the California Environmental Quality Act and hereby adopts the Negative Declaration since there is no substantial evidence that the project will have a significant impact on the environment. SECTION 7. That the City Council hereby approves said amendments. SECTION 8. The City Clerk shall certify to the adoption of this Ordinance and shall forward a copy hereof to the Secretary of the Planning Commission.
