HomeMy WebLinkAboutORD 1124ORD 1124pT3(퓬  ORDINANCE NO. 1124 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING SECTION 153.152, FREEWAY COMMERCIAL ZONE" OF THE BALDWIN PARK MUNICIPAL CODE TO ALLOW CONVALESCENT CARE FACILITIES IN THE FC ZONE WITH A CONDITIONAL USE PERMIT. APPLICANT JOHN L. SORENSEN FOR NORTH AMERICA HEALTH CARE, INC.; CASE NO.: AZC-140). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That John L. Sorensen, for North American Health Care, Inc. hereinafter Applicant") heretofore filed an application Application") requesting approval of an amendment to the Baldwin Park Municipal Code beginning with Section 153.150, F-C Freeway Commercial Zone"Z to allow convalescent facilities within the FC zone; and b) That on February 26, 1997, the Planning Commission conducted a duly noticed public hearing upon said Application and recommended that the Code be amended to allow convalescent care facilities in the FC Zone with a Conditional Use Permit: and c) That on March 19,1997, the City Council conducted a duly noticed public hearing upon said Application: and d) That the conditional use permit process will assure that any new or expanded convalescent facility would not be detrimental to the health and welfare of the residents of Baldwin Park; and e) That individual review through design review and the conditional use permit process over new facilities that would be allowed as a result of this amendment would assure that they will not be detrimental to the properties within the City; and f) That the proposed changes will help preserve jobs and are therefore consistent with the spirit and intent of the General Plan: and 9) That the City Council conducted a duly noticed hearing upon said matter, and based upon the evidence presented, it was determined that the public interest, necessity, convenience and general welfare require the approval of the amendments to FO Freeway Commercial Zone Section of the Code. SECTION 2. That Section 153.152(U) FC Freeway Commercial Zone Conditional Uses" of the Municipal Code should be added to read as follows: U) Nursing, convalescent or rest homes; provided that the home is located upon a lot having a lot area of at least one-half %) acre." SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration of Environmental Impact. SECTION 4. That the City Council hereby approves said amendments. SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and shall forward a copy hereof to the Secretary of the Planning Commission PASSED AND APPROVED ON March 19 1997 MAYOR STATE OF CALIFORNIA COUNTY OF LOS ANGELES ss: CITY OF BALDWIN PARK I, LINDA L.
