AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, CALIFORNIA, AMENDING BALDWIN PARK
MUNICIPAL CODE SECTION 122.99(B) CONCERNING
VIOLATION OF SECTION 122.02, STREET VENDORS
NOW, THEREFORE, the City Council of the City of Baldwin Park does hereby
ordain as follows:
SECTION 1. That Section 122.99(B) is by amended to read as follows:
B) My violation of Section 122.02 shall constitute either
a misdemeanor or an infraction. If the violation constitutes a
misdemeanor, then a conviction shall be punishable by up to a
$1000 fine or by imprisonment for a term of not exceeding six
months in the county jail or by both such fine and imprisonment.
If the violation constitutes an infraction, then a conviction shall be
punishable as set forth at Section 10.99 D)."
SECTION 2. If any section, subsection, subdivision, paragraph, sentence, clause
or phrase of this ordinance or any part thereof is for any reason held to be
unconstitutional, such decision shall not affect the validity of the remaining portions of this
ordinance. The City Council hereby declares that it would have passed each section
subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance
irrespective of the fact that any one or more section, subsection, subdivision, paragraph,
sentence, clause or phrase be declared unconstitutional.
SECTION 3. This Ordinance shall become effective thirty 30) days from the date
of adoption.
