HomeMy WebLinkAboutORD 1132ORD 1132ÜÂ;¢fì¨ç ORDINANCE NO.1132 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM C-2 GENERAL COMMERCIAL) TO R-1 SINGLE- FAMILY RESIDENTIAL ON APPROXIMATELY 99 ACRES OF LAND APPLICANT: ABELL-HELOU, DEVELOPERS; LOCATION: 12900-12916 RAMONA BOULEVARD; CASE NO.: Z-508). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That an application Application") for a change of zone was submitted on the behalf of the owner of certain real property, located at 12900-12916 Ramona Boulevard, in the City of Baldwin Park, described more particularly in the Application on file with the Secretary of the Planning Commission; and b) That the Application was sought to change the zoning on the subject property from C-2, General Commercial, to R-1, Single-Family Residential, pursuant to Section 153.630 of the City's Municipal Code; and c) That pursuant to the applicable provisions of the Planning and Zoning Law Sections 65800 et seq. of the Government Code of the State of California), studies were commenced for the purposes of amending the Zoning Map of the City of Baldwin Park; and d) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it was determined that the public necessity, convenience and general welfare warranted that it recommended the approval of the reclassification from C-2 General Commercial) to R-1 Single-Family Residential); and d) That the City Council conducted a duly noticed public hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, convenience, and general welfare warrant the change in zone classification, herein described. SECTION 2. That notwithstanding the provisions of Chapter 153.630 of the Baldwin Park Municipal Code, the Zoning Classification of the property be and is hereby reclassified from C-2, General Commercial to R-1, Single-Family Residential. SECTION 3. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration of Environmental Impact, and comments relating thereto. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk shall file the Notice of Determination and the Negative Declaration of Environmental Impact. PASSED AND APPROVED this 17th day of June 1998.
