AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK, CALIFORNIA, DESIGNATING ALL
PUBLIC PARKS AND LIBRARIES UNDER THE JURISDICTION
OF THE CITY OF BALDWIN PARK TO BE DRUG-FREE ZONES
PURSUANT TO SECTION 11380.5 OF THE HEALTH AND
SAFETY CODE
WHEREAS, Section 11380.5 of the California Health and Safety Code authorizes the City to designate
the grounds of public parks and public libraries, including adjacent public parking lots and sidewalks. over
which it has jurisdiction as drug-free zones";
WHEREAS, the effect of such designation is the addition of one year to the punishment of
imprisonment imposed on any person convicted of possession for sale or the sale of heroin, cocaine base,
methamphetamine, or phencyclidine PCP) at such a designated place; and
WHEREAS, strong penalties are necessary to deter the sale or possession for sale of drugs within
the City of Baldwin Park and to minimize the adverse effects such crimes have on its residents.
NOW THEREFORE, the City Council of the City of Baldwin Park does hereby ordain:
SECTION 1. All public parks and public libraries over which the City of Baldwin Park has jurisdiction,
including adjacent public parking lots and sidewalks, are hereby designated drug free zones" pursuant to
California Health and Safety Code Section 11380.5. Signs shall be posted at such designated drug free zones
which shall provide notice of California Health and Safety Code Section 11380.5.
SECTION 2. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this
Ordinance or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the
validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have
passed each section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance
irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or
phrase be declared unconstitutional.
SECTION 3. This Ordinance shall become effective thirty 30) days from the date of adoption.
