HomeMy WebLinkAboutORD 1254ORD 1254LÐL³¨URGENCY ORDINANCE NO. 1254 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADDING SECTION 123.32 TO AND REPEALING SECTION 123.21 OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO TAXICAB DRIVER SAFETY AND TAXI EMERGENCY NOTIFICATION SYSTEMS AND DECLARING THE URGENCY THEREOF WHEREAS, pursuant to State law, the City of Baldwin Park regulates aspects of taxi service for taxi companies located within its boundaries; and WHEREAS, recently a taxi driver was murdered within the boundaries of the City; and WHEREAS, there are measures which can be taken to modify taxicabs so as to increase the safety of taxi drivers. Such measures, however, may require a significant lead time to implement. It is therefore incumbent upon the City in connection with its licensing powers to reduce to the greatest extent possible the time required for such measures to be implemented. NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. Section 123.32 in hereby added to the Baldwin Park Municipal Code to read as follows: 123.32 Taxi Emergency Notification System A) Every taxicab shall be equipped at all times with one or more of the following safety/warning devices: 1) a warning light system mounted on the roof which is operable from the interior of the taxicab; 2) an emergency signal on the taxicab's radio which transmits to the taxicab's dispatcher; 3) an automobile vehicle locator system e.g.. On- Star or equivalent); 4) a Lojack locating device, or its equivalent; BIB] 38356-U01 ORD-U02 1254-U02 LI2-U03 FO8535-U03 FO38917-U03 DO59382-U03 C5-U03 ORDINANCES-U03 1/3/2005-U04 ROBIN-U04 ORD 1254LÐL³¨Ordinance No. 1254 Page 2 5) a shield separating the front seats of the taxicab from the back seats. 6) Other safety device, or safety policy consistent with the ordinance's intent to protect the taxi operator subject to approval by the police department. B) The devices required by this Section 123 shall be implemented in every taxicab subject to Chapter 123 of this Code not later than December 1, 2005. SECTION 2. The City Council further finds that Section 123.21 of the Baldwin Park Municipal Code, mandating the wearing of hats and badges by taxicab drivers, is not consistent with current practice, and may act to the detriment of taxicab drivers. Section 123.21 of the Baldwin Park Municipal Code is therefore hereby repealed. SECTION 3. The City Council finds that the facts set forth in the recitals above are true and correct and that the safety devices mandated by this ordinance are necessary for the immediate preservation of the public peace, health, or safety. The City Council therefore declares that this ordinance is an urgency measure and shall take effect immediately upon adoption. SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall have it published in accordance with the provisions of state law. PASSED AND APPROVED this 1st day of December, 2004.
