AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF’fõœ±PIN PARK DESCRIBING THE PROGRAM FOR
THE USE OF EMINENT DOMAIN BY THE COMMUNITY
DEVELOPMEN¸êñŸ¸JISSION OF THE CITY OF
BALDWIN PARK THE CDC")
WHEREAS, Section 33342.7 of the California ݼo and Safety Code became
effective on January 1, 2007;
WHEREAS, the Central Business DistΠܤÕUedevelopment Plan CBD Plan") and
Merged Redevelopment Plan Merged Plan") were adopted bef½YÙð¿fnuary 1,#2007;
WHEREAS, the project areas governed by the Merged Plan are the:
San Gabr ,Þð§nver Project Area
Puente Merced Project Area
West Ramona Boulevard Project Area
Sierra ‚Ť”'Project Area
Delta Project Area
WHEREAS, pursuant to Section 33342.7 of the CalzÛ¢›na Health and Safety
Code, the City Council is required to adopt an ordinance on or beforeüõļŒ'1, 2007,
describing the CDC's program to acquire real property by eminent domain the
Proa+ν×. for any redevelopment plan adopted before Januaqy 1, 2007;
WHEREAS, the Program permits “÷ð¶CC to use eminent domain to acquire real
property, except i) real property in the San Gabrc<ýð§nver Project Area, Puente Merced
Project Area, West Ramona Boulevard Project Area and Delt?Ä¢šmect Area
components of the Merged Plan and ii) real property legally used for residentialùC⥇woses in the Central Business District Project Area of the CBD Plan; and
WHEREAS, this ord'ó¾–b does not change the Program as it currently exists
and is implemented.
THE CIWY COUNCILŒØð¡OE CITY OF BALDWIN PARK DOES ORDAIN AS
FOLLOWS:
Section 1. The Program to acquire real prÃ:û¢~ by eminent domain is as
follows:
a. The CDC shall comply with all applicable law in acq)®ã¹›` real property by
eminent domain, and

b. The CDC may use the power of eminent domain to acquire any real
property, except i) real property in the San Gabriel River Project Area, Puente
Merced Project Area, West Ramona Boulevard Project Area and Delta Project
Area components of the Merged Plan and ii) real property legally used for
residential purposes in the Central Business District Project Area of the CBD.
Section 2. The City Clerk shall certify to the adoption of this ordinance and shall
cause a copy of the same to be published in a manner prescribed by law.
