HomeMy WebLinkAbout1956 031 CC RESO1956 031 CC RESO ZX ZPIõ8RESOLUTION NO. / A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK PERTAINING TO THE ACQUISITIGi OF PROPERTY FOR A CIVIC CENTER. WHEREAS, the City of Baldwin Park is in need of and desirous of obtaining property suitable for development as a Civic Center; and WHEREAS, the Baldwin Park School District and State of California has available for disposal approximately 3«1 acres, commonly known as Old Central School, the legal description of which is as follows, to wit: Lots 1, 67, 68, 69, 70, 71 and 72 of Tract 899, in the Rancho La Puente, in the County of Los Angeles, Stafce of California, as per map recorded in book l8 page 9$ of Maps, in the office of the County Recorder of said County, and WHEREAS, under the provisions of Section 18661 of the State Educational Code, this property may be acquired by the City of Baldwin Park at its fair market value; and WITEGREAS, this nroperty may be acquired oy monthly payments over a lon^' period of years, the minimum bein^- ten 10) years, and WHEREAS, it may be possible to secure this property on the afore- said terms without payment of interest 5 and l-JHEREAS, this property can be secured for immediate possession on an interim arrangement at a rental of $312•00 per nonth, to be in effect only until a final determination has been made of the value of the property and terms of sale, and all payments thereunder to be applied to the pur- chase price or annual payment due n any one year. NOW, THEREFORE, the City Council of the City of Baldwin Park does hereby RESOLVE, DETERMINE and ORDER, as follows: Section The City Administrator be authorized to proceed with negotiations with the Baldwin Park School District and the State of Cali- fornia to acquire the Old Central School property for City use as a Civic Center. Section 2. The agreement to be on the basis of a lease agreement with option to buy and to provide: a. That the City may have immediate occupancy of the property under the condition that the property is accepted as is" and agrees to indemnify and hold harmless the School District and the State of Cali- fornia; b. That the purchase price may be paid in equal monthly install- ments over a long period of years, the mi-nijnum of which willbe ten 10) years; c« That, if possible, interest will not be paid on any unpaid bal- ance of the purchase price; d. That. the purchase price payment could be accelerated by the City at any time, and upon payment of the total purchase rice, the City will agree to take title to the school property. Section 3« Any agreement between the City of Baldwin Park and tne Baldwin Park School District to be submitted to the State Board of Alloca- tion for approval before final Q.p^ro'vo.l. by ooth contracting parties.
