HomeMy WebLinkAbout1956 048 CC RESO1956 048 CC RESO ZX ZPJ8RESOLUTION NO. hS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK GRANTING A CONDITIONAL CHANGE OF ZONE AND ESTABLISHING THE CONDITIONS UPON WHICH C-l USES MAY HS PERMITTED. WHEREAS, the City Council of the City of Baldwin Park, did on the l6th day of July 19^6, hear, as a matter de Novo, Zoning Case No, 7, Zone change from A-l to C-l, A, W, Cole, Jr., and WHEREAS, the City Council desires to permit C-l uses within certain A-l zones area, subject to various conditions^ NOW, THEREFORE, be it DETEFmiNffl, RESOLVED, and ORDERED as follows: Section 1. The City Council of the City of Baldwin Park hereby finds that 5 A. Due Notice of the Public hearing in Zoning Case No. 7 9 A. W« Cole, Jr., et al as a de Novo hearing for July l6, 19^6, at 8:00 o1clock P«M» of the said hearing on appeal,was given. B. That the Planning Commission of the City of Baldwin Park had on the 26th day of March, 19^6, recommended denial of the requested Zone Change from A-l to C-l, C, That the applicant had appealed from said recommendation and that July l6y 19$6, 8:00 o1clock P.M», at the Old Central School Auditorium was the time and place set for hearing the matter before the City Council upon appeal* D« That the legal description of the property is; / NORTHEAST CORNER; The Southerly 160 feet of the westerly 1^3»9U v feet of P1-U3-!A, Rancho La Puente Tract, SOUTH|AST CORNER; Lots 1 and 2 of Tract No. 13079, Map Book 2$0, page 23^. \ j SOUTHWEST CORNER: A.C» commencing south Ul0^?1 west 10 feet from most easterly comer of Lot 126, then h6° $' west 118,37 feet, then south Uio l^ west 139.10 feet, then southeast to the southeast line of S»B» lot, then northeast thereon 139.10 feet to the point of be- ginning, AND the southerly $$ feet of the northerly 19U feet of the easterly 118.37 feet of Lot 126, Tract 962, Map Book 21, pages 7U and 7?» NORTHWEST CORNER; The easterly 120 feet of the southerly 190 feet of Lot 125, Tract 962, Map Book 21, pages 7i+ and 7$. E« That after consideration of the evidence, both oral and written, favoring and opposing the requested change, the said re- quested change to C-l uses would} l) Not adversely affect the comprehensive Zoning Plan of the City of Baldwin Park» BIB] 38238-U01 1956-U02 048-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52657-U03 DO52705-U03 C6-U03 RESO-U03 9/8/2004-U04 ROBIN-U04 1956 048 CC RESO ZX ZPJ8RESOtWIOM MO. 48 2) Not be materially detrimental to the public welfare* 3) Would be materially detrimental to the property of other persons located in the vicinity unless the proposed C-l uses are made sub- ject to the following conditions: a) Change of Zone shall apply to all four corners of the intersection of Holt Avenue and Puente Avenue* b) Curbs and gutters shall be installed according to City specifications upon the subject property wherein the change to C-l uses is granted. c) Upon the installation of curbs and gutters the existing pavement shall be hooked up in conformity with City specifi- cations for like streets as determined ly the City Engineer* d) Sidewalks shall be installed upon all frontages. Location of said sidewalks shall be determined by the City Engineer o afford the greatest possible safety for pedestrians. e) Wherever the subject C-l property shall adjoin residential property there shall be erected a solid six 6) foot masonry wall in such a manner as to prevent access to the said residen- tial property across a real property line* Said wall shall not exceed four U) feet in height in front of any set-back line, f) All flood lights, or other lighting, shall be installed to deflect away from adjoining residential property and shall be so constructed as not to substantially illuminate adjoining residential property* Section 2 Subject to the conditions numbered E, 3), a), W, c), d), e), and f), above, the City Council determine to grant a change of zone from A-l to C-l uses to the following described real property, to wit: NORTHEAST CORNER; The southerly 160 feet of the westerly 1$3-9U feet of P1-U3-1^, Rajncho La Pnente Tract, SOUTHEAST. CORNER: Lots 1 and 2 of Tract No. 13079, Map Book 2$0, page 23$. SOUTHWEST CORNER: A,C. commencing south bl° $71 west 10 feet from most easterly corner of Lot 126,- then U8° c?1 west 118.37 feet, then south lil° $6' 1^ west 139.10 feet, then southeast to the southeast line of S.B. lot, then northeast thereon 139.10 feet to the poic of beginning, AND the southerly $$ feet of the northerly 19U feet of the easterly 118 3 7 feet of Lot 126, Tract 962, Map Book 21, pages 7U and 75» NORTHWEST CORNER; The easterly 120 feet of the southerly 190 feet of Lot 125, Tract 962, Map Book 21, pages 7U and 7$. Section 3.
