A JSSGLVSIGS OF THE CITY COUNCIL OF THE CITY OF
BALDWIN I&EK, CALIFORNIA, UHBEMAKING TO COOPEBATE
WITH THE GITI OF WEST COV3M IN THE MATTER CF A
CERTAIN AOCEEMSNT FOR THE INSTAIIATION OF SEKEES.
WHEREAS, toy the terms of Eeimburseronfc Agreement No* lU of the
City of West Covina there is proposed to be constructed a ten 10)
inch sanitary sewer rom the easterly side of Poeote Avenue in Baldwin
Park and along the proposed extension of Badillo Street to a point in
the aartaal boundary Hnft of the cities of Baldwin Bark and Vest
CoTiaa as sham on the attached map of the City of West Covina,
aarked Reimbxirseaent Map No. 11^5 and
WHEREAS, the construction of the said ten 10) inch sanitary
sewer will directly benefit those properties which front on the said
sewer by providing them with onsite sanitary sewage facilities; and
WHEREAS, those properties in the City of Baldwin Park having
frontage along said sewer, as shewn on said map, have not participated
in the construction cost thereof; and
WHEREAS, by the terms of said agreement it is provided that the
owners of property within the City of BaLd-uLn Park fronting on said
proposed sewer line, as shown on said map, shall pay a connection charge
for said sewer facilities equal to $3*00 per front foot and If applica-
tion is Bade for connection from the property outside of the reimburse-
Beat district and lying immediately north of the property fronting on
said proposed sewer, said property shall pay an area connection charge
equal to the charge in said agreesient for similar acreage;
NW, THEREFORE, BE IT RESOLVED, UETEBKEKED ATO OU3ERED AS
FOLLOWS;
Section 1» That the City Coxmcil of the City of Baldwin Park
will not issue acy permit for a connection to the said proposed
sanitary sewer within the territorial limits of Baldwjm Park xmtil there
has been paid to the City of West Covina the charges for connections
specified in the aforesaid reimbursement agreement. That whenever
an application is made to the City of Baldwin Park for such a sewer
connection the City Clerk of the City of Baldwin Park will notify the
City of West Covina of the filing of such an application and will
withhold the issuance of a permit until such tiros as the City Clerk
has been advised by the City of West Covina that the appropriate charges
have been paid to the City of West Covina.
Section 2. The City Clerk shall certify to the adoption of this
fiesolution.
