A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK DECLARING A COTOIPIONAL CHANGE OF
ZONE, AND ESTABLISHING THE CONDITIONS UPON
WHICH C-l USES MAY BE PERMITTED,
WHEREAS, the City council of the City of Baldwin Park did, on
the l$sth day of October, 19^6, hear Zoning Case No. h3) zone change from
R-l to C-l, LUCIAN McCORMICK, et al., and
WHEREAS, the City Council desires to permit C--1 uses within
certain R-l zone areas, subject to various conditions;
NOW, THEREFORE, be it RESOLVED, DETERMINED AND ORDERED as
follows:
Section 1, The City Council of the City of Baldwin Park hereby
finds that'12
a. Due Notice of public hearing of the zone case No» h3f
Lucian McCornick, et al., for October l$th at 8:00 o'clock P.M.,
was given,
b, That the Planning cornmission of the City of Baldwin Park
had, on the 13th dsy of August, 19$6, recommended conditional
approval pursuant to their Resolution No. 6$; and
c. That the legal description of the property is;
The West one-half l/2) of the North three-eighths 3/8) of Lot 1,
of Revised Map of Vineland of the Aausa Tract, Map Records,
Book h2. Page 52, of Maps, Records of the County Recorder of Los
Angeles County,
d. Qiat after consideration of the evidence, both oral and
written, favoring and opposing the requested change, the City
Council finds in re the requested change from C"i uses as follows:
1) That the requested change would not adversely affect
the comprehensive Zoning Plan of the Ci-fy of Baldwin Park,
2) Qiat the requested change would be materially detrimen-
tal to the public welfare unless the proposed C-l uses are
made subject to the following conditions; and
3) That the requested change would be materially detrunen-
tal to the property of other persons located in the vicinity
unless the proposed C-l uses are made subject to the following
conditions2
a) The change of zone and uses shall apply to
various parcels of property located within the area
described in sub-section c" above,
b) That curb and gutter shall be installed
according to Ci-fcy specifications along the entire frontage
of the property on Olive Street, to wit, a distance of
1$0 feet.
c) Upon installation of curb and gutter, the
existing pavement shall be hooked up to said curb and
gutter in conformity with City specifications for like
streets as deteirmined by the City Engineer.
d) That sidewalks be installed according to
City specifications upon the footage of property along
Olive Street.

e) Tiat a strip of land 10 feet in width
and 1$0 feet in length along the frontage of the
property on Olive Street be deeded to the City of
Baldwin Park for street and highway purposes after
the improvements have been installed thereon.
f) That a masonry fence six feet in height
shall be installed in all areas where the parcel of
lanri described in c" above abuts residential
properties, along the Westerly and Southerly
property lines. Said fence shall not be higher
than four feet from the property line on Olive Street
to the set-back line*
g) That in the event any- floodlights are
installed on the premises they shall deflect away
from residential areas and shall not substantially
illuminate adjoining residential properties. That
a n areas designated as Parking" or Parking Area"
on the plot plan submitted and filed and identified
as Exhibit A" shall be paved with not less than
three 3") inches of Macadam pavement,
h) That improvements and development of the
property shall be substantially in conformity with
the plot plan submitted for the area and filed as
Exhibit A".
Section 2^ That subject to the conditions of Section 1,
d, 3/TiTTT^L c), d), e), f), g), h), above, the
City Council determines to grant change of zone from R-l to
C-l uses to the following described property, to-wit;
The West one-half 1/2) of the North three-eighths
3/8) of Lot 1, of Revised Map of Vineland of the
Azusa Tract, Map Records, Book 1^2, Page $2 of Maps,
Records of the County Recorder of Los Angeles
County n
Section 3« The City Engineer is directed to prepare a Map,
setting forth the area of the conditional zone change, and the
City Attorney is directed to prepare an ordinance in conformity
herewith effecting said Change of Zone.
