A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDICT PARK 51ANTING A CONDITIONAL CHANGE OF ZONE AND ESTABLISHING THE CONDITIONS UPON 1/jKTCH THE PERECETTED USES MAY BE ALLOVJED. WHEREAS, the City Council of the City of Baldwin Park, did on the l8th day of June, 19^6 hear Zoning Case No« 20, Zone Change from A-l to M-l, Fred J. Meyer; and WHEREAS, the City Council desires to permit limited uses within certain A-l zone areas, subject to various conditions^ N0^, THEREFORE, be it DETERMINED, RESOLVED, and ORDERED as follows; Section 1. The City Council of the City of Baldwin Park hereby finds that; a« Due notice of Public Hearing in Zoning Case No, 20, Fred J. Meyer set for June 18, 19$6, at 8:00 O'clock P,M,, was given. b» The List of naires given notice of the hearing as prepared and submitted by the applicant is sufficient to give reasonable notice of the Public Hearing required in this zoning matter, c. That on the l8th day of June the matter was referred back to the Planning Commission^ and d. The Planning Commission of the City of Baldwin Park did on the 9th day of July, 19$6, recoimnend conditional approval pursuant to their resolution No» 0. e. That the legal description of the property is: Beginning at the N.W. corner of Lot 23 RS-MB 6-10U and the southerly line of North Virginia Avenue, being fifty feet 0*) in width), thence parallel to the southerly line a distance of two hundred ninety six feet 296'), thence at right angles in a southerly direction a distance of two hundred seventy three feet 273l), thence in an easterly direction parallel with the southerly line of North Virginia Avenue a distance of 99.26', thence north- westerly a distance of two hundred seventy three feet 2?3 r) to the southerly line of North Virginia Avenue, thence westerly parallel with the southerly line of North Virginia Avenue a distance of 99*26y to the point of be- ginning^ and located at 1^16 North Virginia Avenue, Baldwin Park. f» After consideration of the evidence both oral and written, favoring and opposing the requested change, the Hity Council f^nds in regard to the requested change to H-l uses as follows: 1) That the requested change would not adversely affect the comprehensive Zoning Plan of the City of Baldwin Park. 2) That the requested change would be materially detrimental to the public welfare unless the proposed M"l uses are limited in their scope and made subject to the following conditions, and BIB] 38238-U01 1956-U02 073-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52657-U03 DO52730-U03 C6-U03 RESO-U03 9/8/2004-U04 ROBIN-U04 1956 073 CC RESO ZX ZPJS8RESOLUTION NO. 3) That the requested change would be materially detrimental to the property of othor persons located in the vicinity unless the proposed M-l uses are limited in their scope and made subject to the following conditions a) he Change of Zone and uses shall apply to the property located within the area described in subsection e" above. b) Curb and gutter should be installed according to City specifications upon and aj-ong the frontage of the property on Virginia Avenue, that in lieu of the said installation of curb and gutter that monies shall be deposited with the City of Baldwin Park to guarantee the installation of said curb and gutter, the amount of said monies to be estimated by the City Engineer in an amount sufficient to cover the cost of said installation c) Upon installation of the curb and gutter the existing pavement shall be hooked up to said curb and gutter in con- formity with City sepcifications for like streets as determined by the City Engineer. d) Tho use of the parcel within the area described in 1, e" above shall be limited to the uses of an office building, warehouse, building materials storage yard, and cabinet and wood- working shop* Section 2» Subject to the conditions numbered a), b), c), d) under subsection 3) above, the City Council deternines to grant a conditional change of Zone from A-l to limited uses as to the following described property, to wits Beginning at the N,¥, corner of Lot 23 RS-l-B 6-10U and the southerly line of North Virginia Avenue, being fifty feet $0') in width), thence parallel to the southerly line a distance of two hundred ninety six feet 296*), thence at right angles in a southerly direction a distance of two hundred seventy three feet 273l), thence in an easterly direction parallel with the southerly line of North Virginia Avenue a distance of 99*26 *, thence north- westerly a distance of two hundred seventy three feet 273y) to the southerly line of Korth Virginia Avenue, thence westerly parallel with the southerly line of North Virginia Avenue a distance of 99«26* to the point of be- ginningj and located at 1^16 North Virginia Avenue, Baldwin Park. Section 3» The City Engineer is directed to prepare a map setting forth the area of the conditional Zone Change, and the City Attorney is directed to prepare an Ordinance in conformity herewith affecting said change of Zone.
