HomeMy WebLinkAbout1957 054 CC RESO1957 054 CC RESO ZX ZPJè8RESOLUTION NO, T^ /f^ f'/ r7. 7., 7 A RESOLUTION OF THE CITY COUNCIL OF TOE CITY OF BALDWIN P^K ESTABLISHING A COMPENSATION PLAN FOR EMPLOYEES IN THE MUNICIPAL SERVICE FOR TOE 1957-58 FISCAL YEAR, SETTING FORTH RULES AND REGULATIONS REGARDING THE PAYMENT OF SALARIES, SICK LEAVES, VACATIONS, LEAVES OF ABSENCE AND OIH® REGULATIONS, AND REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH, 1/CT31EAS, Section 37206 of the Government Code requires the City Council to prescribe the time and method of paying salaries and wages of officers and employees of the City, and WHEREAS, the City Council has determined that it is necessary for the efficient operation and management of the City that rules and regulations be established prescribing side leaves, vacations, leaves of absence and other regulations for the employees and officers of the City, and WHEREAS, it is necessary from time to time to establish comprehensive wage and salary schedules and to fix the rates of compen- sation to be paid to officers and employees of the City, NOW, THEREFORE, BE IT RESOLVED BY TOE CITY COUNCIL OF TOE CITY OF BALDWIN PARK AS FOLLOWS: SECTION 1: All Resolutions in Conflict herewith are hereby repealed, SECTION 2: POSITIONS AND SALARIES. The number of positions, schedule of classes, and salary ranges for employees of the City of Baldwin Park, effective July 1, 1957, shall be as follows: Unless otherwise specified, figures are in dollars per month,) 1. SECTION 3, PROMOTIONS. Promotions will normally be made from step to step at the end of the period specified in Section 2 above, provided the head of tfae Department shall certify that the employee^ service has been satisfactory or better during the previous gradation period, and provided further that all advancements shall be subject to the final approval of the City Council before becoming effective, SBCTION 4, METHOD OF PAYMENT. Wages and salaries due officers and employees of the City of Baldwin Park shall be by warrants dra'»vn on City Funds deposited in a local Baldwin Park bank, SECTION 5, PAY PERIODS. The compensation due all officers and employees of the City shall be divided into two monthly pay periods. One period shall be from the 1st day to and inclusive of the 15th day of the calendar month, and the second period shall be from the 16th day of the month to and inclusive of the last day of the calendar month. SECTION 6, PAY DAYS. Warrants in payment of compensation shall be made available by the City to employees and officers of the City on the 5th day of the nonth for the second pay period of the preceding month, and on the 20th day of the month for the first pay period of that month. In the event that the 5th or 20th days of the month fall on a holiday as established by this Resolution, or on a Saturday or Sunday, then the warrants shall be nade available on the preceding day which is not a Saturday, Sunday or holiday, SECTION 7. COMPENSATION FOR LESS THAN A HJLL PAY PERIOD, Any person holding a position the compensation for mich is fixed by the month who works less than a full pay period, except when on an earned vacation, holiday, or paid sick leave, shall receive as compensation for such portion of a pay period an amount which shall be computed and established in the following manner: a) For all employees who have a regular weekly work schedule of forty 40) hours, the rate of pay shall be the semi-monthly rate divided by the number of 2" BIB] 38238-U01 1957-U02 054-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52735-U03 DO52789-U03 C6-U03 RESO-U03 9/8/2004-U04 ROBIN-U04 1957 054 CC RESO ZX ZPJè8RESOLUTION NO. 5 7^3 period, except when on an earned vacation, holiday, or paid sick leave, shall receive as compensation for such portion of a pay period an amount which shall be computed and established in the following manner: a) For all employees who have a regular weekly work schedule of forty 40) hours, the rate of pay shall be the semi-monthly rate divided by the number of actual work hours in the pay period, b) In determining the hourly rate as herein provided, computation shall be made to the nearest cent, and a computation resulting in an even one-half cent shall fix the rates at the next higher even cent, SECTION 8; WORKING HOl]RS, TORK MEHK: ANDOVERTIME. a) Eight 8) hours, exclusive of lunch periods, shall constitute a day's work for all employees* b) The official work week of the City of Baldwin Park shall be five 5) working days of eight 8) hours each. It shall be the duty of each department head to arrange the work of his department so that each employee therein shall work not more than five 5) days in each calendar week except that a department head may require any employee in his depart- ment to emporarily perform service in excess of five 5) days per week when public necessity or convenience so requires, c) Any employee occupying a position at a monthly salary who is required to work on a holiday shall be entitled to equivalent time off. d) Whenever any employee shall be required to work overtime, such person shall receive compensatory time off equivalent to the ever time hours worked, SBCTION 9; MILEAGE ALLOWANCE. Every officer or employee who is required to use a private automobile in the discharge of service of the City, shall after receiving the approval of the City Administrator, receive compensation for the use of such automobile at the rate of seven 7) cents per mile. SECTION lOt VACATIONS. a) A full-time employee after being in the continuous service of the City for at least six months, shall be entitled to a vacation which shall consist of one work day for each full calendar month of service. b) The to-fel vacation allowance shall be computed to the nearest whole day, based upon the number of full months of City service. c) In the event one or more municipal holidays fall within a vacation leave, such days shall not be charged as vacation leave and the vacation leave shall be extended accordingly for those employees eligible for such holidays. d) The time during the calendar year at which an employee shall take his vacation shall be determined with due regard for the wishes of the employee and particular regard for the needs of the service. The full vacation leave shall be taken at one time; however, the City Administrator under appropriate circumstances may permit a modification of this requirement. 3- BIB] 38238-U01 1957-U02 054-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52735-U03 DO52789-U03 C6-U03 RESO-U03 9/8/2004-U04 ROBIN-U04 1957 054 CC RESO ZX ZPJè8RESOLUTION NO, jf^J^7 e) Vacation may be taken during the year following which the vacation privilege has been earned, except that upon approval of the City Administrator, vacations may be accumulated for a period not to exceed thirty calendar days. f) In the event that an employee is separated from his employ- ment with the City, such employee shall be paid for any vacation leave which has accrued in the year in which he or she is separated, SBCTTON 11: SICK LEAVE. a) Sick leave with pay shall be granted each full-time employee at the rate of one work day for each calendar month of service. Full-time employees being defined here as one having worked at least six months for the City.) b) Unused sick leave may be accumulated to a total of sixty 60) work days. Absence for illness may not be charged to sick leave not already accumulated. Unused sick leave shall not be considered in calculating severance pay. c) Sick leave shall be allowed only in case of necessity and actual sickness or disability of the employee as determined by the City Administrator. In order to receive sick leave with pay the employee shall notify his Department Head prior to or within four 4) hours after the time set for beginning his daily duties. Upon return from an absence of one 1) day, the employee shall file with the Department Head a physician's certificate or a personal affidavit stating the cause of absence. d) When circumstances are such and the City Administrator determines that conditions warrant, an absence may be charged to sick leave in the event of serious illness or death to members of the immediate family of a full-time employee which absence shall not exceed three 3) working days in any one year, SBCTION 12> ON TOE JOB INJURY. Whenever any person is compelled to be absent from his employ- ment with the City on account of injury arising out of and in the course of his employment as determined by the Workman^ Compensation Act, he may elect to apply prorated accrued sick leave, if any, to such absence and to receive compensation therefore in an amount equal to the difference between the compensation received by him under the Workman* s Compensation Act and his regular City pay, not to exceed the amount of his earned sick leave. An employee in such instance, may also elect to use any earned vacation time and equivalent time off for overtime in like manner after his sick leave is exhausted. SBCTION 13t ATTENDANCE. Full-time employees shall be in attendance at their work in accordance with the rules regarding hours of work, holidays and leaves, All departments shall keep attendance records of all employees. Failure on the part of an employee absent without leave for more than eight 8) work hours, shall be cause for discharge. SECTION 14s HOLIDAYS. M. j) Every day on which an election is held throughout the State, k) Every day appointed by the President or Governor for a public fast, thanksgiving or holiday, SECTION 15: DISCHARGE, Employees may be discharged by appointed authority for violations of accepted rules of conduct. It is expected that an employee resigning from the City will give the City at least two weeks* written notice. SECTION 16: LEAVE OP ABSENCE: Leave of absence without pay nay be granted by the appointing authority for a period not to exceed ten work days. Leave of absence ivithout pay in excess of ten 10) work days shall not be granted without the express consent of the City Council, SECTION 17} CLOTHING REIMBURSEMENT. In the event that any employee of the Police Department of the City, loses or damages personal clothing or property in the discharge of his employment and in the line of duty, the police officer may receive such ail amount of money as will connensate him for the loss or danage by the City Council upon the receipt of a recommendation from the Chief of Police and the City Administrator. SECTION 38, Nothing contained in this Resolution shall be construed as guaranteeing to any employee or official of the City any vested interest i.n any salary or position, Furthermore, nothing contained herein is intended to prevent the City from terminating the employment of any employee or officer of the City at any time.
