COMPENSATION^ REMUNERATION OR PAY INDICATED OR PROVIDED. Tha.t effective as of and on and after the first day of July, 1958, and until further orders of the City Council of the City of Baldwin Park, the respective officers, department heads and employees of said City whose respective positions or employments are hereinafter respectively set forth in this Resolution shall, subject to any other provision contained in this Resolution, respectively receive for their respective employments, posi- tions and services to be rendered said City, the compensation, remunera- tion or pay hereinafter set forth, indicated or provided therefor. SECTION 2. ELECTIVE OFFICERS; SALARIES AS SUCH. the elective officials of said City, as such, shall receive the re- spective salaries, compensations or amounts attached to their respective offices as provided by law, which salaries, compensations or amounts at the present time under the laws and ordinances of said City are herein- after set forth, for the purposes of convenience in reference as follows, to-wit: OFFICE COMPENSATION 1. Mayor $ 75*00 per month 2. Councilmen 50.00 per month 3. City Clerk, as such 350.00 per month U. City Treasurer, as such 75-00 per month SECTION 3» FIXED ADMINISTRATIVE SERIES. That subject to the other provisions of this Resolution, each of the incumbents of the following offices or positions in the service of the City of Baldwin Park shall be entitled to receive for his or her services, in his or her office,or position, the respective rate or rates of compensa- tion hereinafter set forth for his or her respective office or position, to-wit: 1. Chief Administrative Officer $10,000.00 per year 2. Chief of Police 750.00 per month 3. Planning Director To be established h. City Engineer to be established 5. Assist. Chief Admin. Officer-Purchas- ing Agent to be established 6. Police Captain to be established 7. Director of Civil Defense 50.00 per month 8. Crossing Guards 1.50 per hour 9. Graduation from step to step at the periods specified shall be made as contemplated, provided, however, that the department head shall certify that the employee's service has bean satisfactory or better during the previous period, and provided further that all graduation shall be subject to the final approval of the Chief Administrative Officer. PAY PERIODS AND METHODS CF PATMENIS. Wages and salaries due officers and employees of the City of Baldwin Park shall be warrants drawn on City funds deposited in a local Baldwin Park bank. The compensations due shall be divided into two 2) monthly payment periods. One period shall be from the first day to and inclusive of the l$th day of the calendar month; and the second period shall be from the l6th day of the month to and inclusive of the last day of the calendar month* iferrants in payment of compensation shall be available by the City to the employees and officers of the City on the $th day of the month for the second pay period of the preceding month; and on the 20th day of the month for the first pay period of that month. In the event that the $th or the 20th days of the month fall on a holiday, as established by this Resolution, or on a Saturday or Sunday, then the warrants shall be made available on the preceding day which is not a Saturday, Sunday or a holiday. SECTION 7* COMPENSATION FOR LESS THAN A FULL PAY PERIOD Any person holding a position, compensation for which is fixed by the month, who works less than a full pay period, except when on an earned vacation, holiday or sick leave, shall receive as compensation for such portion of a pay period, an amount which shall be computed and established in the following manner: A. For all employees who have a regular weekly work schedule of forty Uo) hours, the rate of pay shall be the semi-monthly rate divided by the number of actual working hours in the period. B. In determining the hourly rate as herein provided, compensa- tion shall be made to they8§fiS3 and a computation resulting in an even half cent shall fix the rate at the nearest higher even cent. SECTION 8. IVORKING HOURS, WRK MEEK, AND OVERTIME. A. It shall be the duty of each Department Head to arrange the work of his department so that each employee therein shall work not more than five 5) days in each calendar week except that a Department head may require any employee in his depart- ment to temporarily perform service in excess of five 5?) days per week when public necessity or convenience so requires. C. Any employee except uniformed police officers or detectives) occupying a position at a monthly salary who is required to work on a holiday, shall be entitled to equivalent time off, D. Whenever any employee, except uniformed police officers, shall be required to work overtime, such persons shall receive compensatory time off equivalent to the overtime hours worked, except that members of the Street Department and Custodial Help shall be compensated for such over- time at time and one-half for all time worked in excess of forty Uo) hours per week, subject to the approval of the department head. E. It is the policy of the City of Baldwin Park that the Chief Administrative Officer and all Department Heads shall devote as much of their ability as is necessary in the performance of their duties, and all of such persons who are employed by the City of Baldwin Park are expect- ed to, and shall comply with this policy. In this regard the Chief Administrative Officer and all Department Heads of the City of Baldwin Park shall not be entitled to compensatory time off or overtime payment in the event that their work for the City of Baldwin Park is in excess of forty UO) hours per week. F. The official work day of all employees except those required to work unusual hours or shifts, shall be between the hours of 8:00 A.M. and $;00 P.M. exclusive of lunch periods. The working hours of any em- ployee which deviate from the above stated hours shall be subject to the approval of the Chief Administrative Officer. SECTION 9. OTORTIME RAIMENT POLICE OFFICERS. Subject to other provisions of this Resolution, police officers re- quired to perform official duties after their regular shift of employ- ment or on their regular day off, shall be entitled to receive overtime compensation not to exceed the employees1 current established hourly rate of pay as hereinabove contemplated. The overtime payments contemplated in this Resolution shall be subject to the approval and certification of the Chief of Police that said overtime is necessary, and the employee is en- titled to additional compensation for the same. It is further provided that the City Council of the City of Baldwin Park desires to establish an equitable and fair method of compensating police officers for their extra duty hours. However it is the expressed intention of this City Council that the overtime hours, as hereinabove provided, shall be kept at an absolute minimum. It is further provided that so long as the policy of providing overtime pay to police officers is in effect, that compensatory time off will not be granted. SECTION 10. MILEAGE ALLOWANCE. Every officer or employee who is required to use a private auto- mobile in the discharge of the service of the City shall, after receiving approval of the Chief Administrative Officer, receive compensation for the use of said automobile at the rate of seven 07) cents per mile, SECTION 11. VACATIONS. Ihe total vacation allowance shall be computed to the nearest whole day, based on the number of full months of City service. C. In the event that one or more Municipal holidays falls within a vacation leave, such days shall not be charged as vacation leave, and the vacation leave shall be extended accordingly for those employees eligible for such holidays, D. Ihe time during the calendar year at which an employee may take his vacation shall be determined with due regard for the wishes of the em- ployee and particular regard for the needs of the service. Ihe full vaca- tion leave shall be taken at one time. However, the Chief Administrative Officer, under appropriate circumstances, may permit a modification of this requirement, if so requested. E, Vacations may be taken during the year following which the vaca- tion privilege has been earned, except that upon approval of the City Administrator, vacations may be accumulated for a period not to exceed twenty-one 21) calendar days. In the event that an employee is separated from his employment with the City, such employee shall be paid for any vacation leave which has accrued, at his or her current rate of salary at the time he or she is separated. F. In the event that any employee of the City has previous to December 31, 19^8, accumulated vacation time in excess of twenty-one 21) calendar days but not exceeding thirty 30) calendar days, then with the approval of the City Administrator such employee may take his or her accumulated vacation at one time not exceeding 30 calendar days. After December 31, 19?8, no employee may accumulate his or her earned vacation in excess of 21 calendar days, SECTION 12. SICK LEAVE, A. Sick leave with pay shall be granted each full-time employee at the rate of one work day for each calendar month of service. Full-time employees being defined here as one having woAed at least six months for the City.) B, Unused sick leave may be accumulated r.o a total of sixty 60) work days. Absence for illness may not be charged to sick leave not al- ready accuiirulated. Unused sick leave shall not be considered in calculating severance pay, C, Sick leave shall be allowed only in case of necessity and actual sickness 01 disability of the employee as determined by the City Administrator, In order to receive sick leave with pay the employee shall notify his Department Head prior to or within four IQ hours after the time set for beginning his daily duties. Upon his return from an absence of one 1) day, the employee shall file with the Department Head a physician's certificate or a personal affidavit stating the cause of absence. D. When circumstances are such and the City Administrator de- termines that conditions warrant, an absence may be charged to sick leave in the event of serious illness or death to members of the immediate family of a full-time employee which absence shall not exceed three 3) working days in any one year. SECTION 13. ON THE JOB INJURY. Whenever any person is compelled to be absent from his employ- ment with the City on account of injury arising out of an^ in the course of his employment as determined by the Workman1 s Compensation Act, he may elect to apply prorated accrued sick leave, if any, to such absence and to receive compensation therefor in an amount equal to the difference be- twon the compensation received by him under the Workman's Compensation Act and his regular City pay, not to exceed the amount of his earned sick leave, BIB] 38253-U01 1958-U02 065-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO54140-U03 DO54205-U03 C6-U03 RESO-U03 9/23/2004-U04 ROBIN-U04 1958 065 CC RESO¼òw @|_>Page Mo. 6 PESO. N0,58-6^ An employee in such instance, may also elect to use any earned vacation time and equivalent time off for overtime in like manner after his sick leave is exhausted. In the event of such an injury then the employee shall receive his salary from the date of injury for one calendar week without a deduc- tion from his earned vacation time or his earned sick leave time. SECTION lU. ATTENDANCE. Full-time employees shall be in attendance at their work in accordance with the rules regarding hours of work, holidays and leaves. All departments shall keep attendance records of all employees. Failure on the p^t of an employee absent without leave for more than eight 8) work hours, shall be cause for discharge, SECTION 15. HOLIDAYS, Municipal offices shall be closed on the following legal holidays; New Year's Day, Washington^ birthday. Memorial Day, Independence Day, Labor Day, Veteran's Day, Christmas, Good Friday from 12:00 noon to 3;00 P.M., Thanksgiving Day and every day when an election is held throughout the State, and every day appointed by the President and Governor for a public fast, thanksgiving or holiday provided, however, that members of the Baldwin Park Police Department whose hours do not permit observance of the here- in and above stated holidays, shall receive for such holiday o9 holidays worked, an extra day's pay for each such holiday worked at his regular hourly or daily rate as herein above contemplated^ such police officers subject to the provisions of this section shall receive extra holiday pay for each day that the general City offices are closed in observance of such holiday. Said officers shall be entitled to holiday pay even though the holiday may fall on the regular day off of the subject officer. In the event that any of these days fall on Saturday or Sunday then the employee is entitled to the preceding day or the day following. Should the holiday fall on a Saturday then the preceding Friday shall be a holiday. In the event that the day falls on a Sunday then the following Monday shall be a holiday. SECTION 16. DISCHARGE. Employees may be discharged by appointed authority for violations of accepted rules of conduct. It is expected that an employee resigning from the City will give the City at least two weeks' written notice. SECTION 17. LEAVE CF ABSENCE, Leave of absence without pay may be granted by the appointing authority for a period not to exceed ten work days. Leave of absence without pay in excess of ten 10) work days shall not be granted without the express con- sent of the City Council. SECTION 18. CLOfflING REIMBURSEMENT. In the event that any employee of the Police Department of the City loses or damages personal clothing or property in the discharge of his employment and in the line of duty, the police officer may receive such an amount of money as will compensate him for the loss or damage by the City Council upon the receipt of a recommendation from the Chief of Police and the City Administrator. SECTION I?. Nothing contained in this Resolution shall be con- strued as guaranteeing to any employee or official of the City any vested interest in any salary or position. Furthermore, nothing contained herein is intended to prevent the City from terminating the employment of any employee or officer of the City at any time. This Resolution may be chang- ed or modified at any time by the City.
