HomeMy WebLinkAbout1958 104 CC RESO1958 104 CC RESOxJ×ÏRESOLUTION NO. 58-104____ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK RE: GRANTING A LOT SPLIT AT 15511-15 EAST FRANCISQUITO AVENUE, HORTON AND LAYTON, CASE NO. L.S, 140. WHEREAS, a regular meeting was held by the Planning Commission of the City of Baldwin Park at 7:30 P.M», September 4, 1958, at the Council Chambers, 14405 East Pacific Avenue, Baldwin Park, California, and WHEREAS, on the 4th day of September, 1958, the Planning Commission considered the request for a Lot Split at 15511-15 East Francisquito Avenue, Horton and Layton, and WHEREAS, at its regular meeting on the 15th day of September, 1958, the City Council of the City of Baldwin Park considered the request for a Lot Split at 15511-15 East Francisquito, Horton and Layton, NOW, THEREFORE, the CITY COUNCIL OF THE CITY OF BALDWIN PARK does hereby RESOLVE, DETERMINE and ORDER as follows: SECTION I The City Council finds the property to be located at 15511-15 East Francisquito Avenue, legally described as: the southerly 425 feet of Lot 29 of Tract 718 in the Rancho La Puente, as per map recorded in Book 7, Page 17 of Maps, in the office of the County Recorder in said county, the Northerly line of said Southerly 425 feet to be parallel with Francisquito Avenue, EXCEPT therefrom the Northwesterly 548 feet thereof, ALSO EXCEPT therefrom the East one-half of the Southerly 425 feet of said Lot 29, as described in the deed to Lillian T. Linton, recorded in Book 4505, Page 46. SECTION II The City Council finds that Lot Split Case No. 40 was considered by the Planning Commission of the City of Baldwin Park and the proper findings were made as stated in Resolution No, 529, therefore, the City Council finds: a. That the proposed Lot Split does not adversely affect the comprehensive zoning map of the City of Baldwin Park. b. That the proposed Lot Split is in ac- cordance with the Master Plan of Streets and Highways; and provision is made for the future street development of the City. c. The proposed Lot Split was covered by a prior action Lot Split Case No* 45), and proper dedication on Francisquito Avenue was made, and is filed in the Planning Department, The applicant has agreed to install curb, gutter and side- walk according to City specifications. d» There are no curb, gutter or sidewalks on the subject property at the present time. The City Council finds that the survey monuments are not in compliance with paragraph e". Section 9507 of the Municipal Code, f. The City Council finds that this lot split is in compliance with paragraph f" of Section 9507 of the Municipal code, SECTION III The City Council recommends approval of this Lot Split subject to the following conditions: a* That the applicant deed sixty 60) feet as shown on the map) of the subject property to the City of Baldwin Park for future street and highway purposes, b. That the applicant sign an Improvement Agreement, satisfactory to the City Attorney; that the applicant will bear the cost of improving the sixty 60) feet as shown on the map) ac- cording to City specifications, upon demand of the City, at such time as the future street is developed. Said agreement shall be recorded and the applicant shall bear the expense of recordat ion, c. That the houses, when constructed, in the immediate area of said future street shall be oriented to front on said future street, and the location of said houses and accessory buildings shall conform to the front yard setbacks as specified in the zoning ordinance of the City of Baldwin Park, d, That curb, gutter and sidewalk be in- stalled, according to City specifications, on the southwesterly 115,68 feet frontage of the subject property on Francisquito Avenue, e. That if houses are constructed prior to the complete installation of the sixty 60) foot future street, a ten 10) foot paved drive shall be installed to provide access to said parcels. f. That the future street deed regarding sixty 60) feet shall be offered to the City and signed by Mr, Layton, the present owner. g« That Parcel No, I be altered to show a depth of 155 feet. h.
