A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK URGING THE
STATE LEGISLATURE TO ADOPT LEGISLATION
PROVIDING FOR TAXATION OF POSSESSORY
INTERESTS IN PERSONAL PROPERTY.
WHEREAS, the California Supreme Court has ruled
in General Dynamics Corporation v. County of Los Angeles
and Aerojet-General Corporation v. County of Los Angeles,
51 Adv. Cal. 59, rehearing denied November 19» 1958), that
the Legislature has the power to provide for the taxation
of all forms of tangible personal property" and any legal
or equitable Interest therein" but that it has not provided
for the taxatlQp of limited Interests in tangible personal
property and has not defined personal property as including
a right to its possession, and
WHEREAS, local governments will be deprived of
much needed revenue unless appropriate legislation is adopted
providing for the taxation of possessory Interests in per-
sonal property, and
WHEREAS, said California Supreme Court decision
has had the effect of removing from the tax rolls of Los
Angeles County alone personal property having an assessed
value of approximately $258,000,000.00,
NOW, THEREFORE, the City Council of the City of
Baldwin Park does resolve as follows:
1. The Assembly and Senate of the State of
California are urged to adopt appropriate legislation to pro-
vide for the taxation of limited Interests in tangible per-
sonal property and to define personal property as including
a right to its possession.
2. The City Clerk shall send certified copies of
this resolution to State Senator Richard Richards, to each
Assemblyman in Los Angeles County, and to Supervisor, Frank
Bonelll.
PASSED and ADOPTED this 19 day of January, 1959.
