HomeMy WebLinkAbout1959 035 CC RESO1959 035 CC RESOxJ×¥RESOLUTION NO. 59-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OP BALDWIN PARK DENYING APPLICATION FOR CHANGE OF ZONE TO M-l ON PROPERTY BETWEEN PUENTE AVENUE AND BIG DALTON AVENUE SOUTHWESTERLY OF WALNUT CREEK, ZONE CASE NO. Z-57, AND GRANTING A VAR- IANCE FOR TRAILER PARK. WHEREAS, an application was filed fco rezone the following-described property to M-l; Those portions of Lot 31 of El Monte Walnut Place, in the City of Baldwin Park, County of Los Angeles, State of California, as per map recorded In Book 6, Page 104 of Maps, In the Office of the County Recorder of said County, described as follows: Beginning at a point on the southeasterly line of said lot distant thereon North 41° 53' East 393.88 feet from the most southerly corner of said lot; thence continuing along said southeasterly line, North 41° 53' East 253.85 feet; thence North 48° 07' West 217.80 feet; thence along the northwesterly prolongation of the southwesterly line of the land described in the deed to Walter O'Brlen and wife recorded on August 19 j 1925 as Instrument No. 523 in Book 5205, Page 384 of Official Records of said County, North 48° 07l West 182.20 feet, more or less to a line that is parallel with and distant 400 feet, measured at right angles, from the south- easterly line of said Lot 31; thence along said parallel line. South 41° 53' West 153.85 feet, more or less, to the northeasterly line of the land described secondly In the deed to H, T. Coffin, recorded in Book 2397^ Page 240 of Deeds, records of said County; thence along said northeasterly line and the southeasterly prolongation thereof, South 48° 07' East 400.00 feet to the point of beginning. Beginning at a point on the southeasterly line of said lot, distant thereon North 41° 53l East 393.88 feet from the most southerly corner of said lot; thence north 48° 07' West 400.00 feet to the true point of beginning; thence continuing North 48° 07' West to a point which is distant thereon South 48° 07' East 76.00 feet from the southeasterly line of Big Dalton Avenue, as described in the deed to the County of Los Angeles, recorded In Book 5536, Page 256 of Official Records of said County; thence parallel with said southeasterly line North 41° 53' East 66.00 feet; thence North 48° 07' West 76.00 feet to said southeasterly line of Big Dalton Avenue; thence along said southeasterly line. North 1- BIB] 38385-U01 1959-U02 035-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52525-U03 DO61318-U03 C6-U03 RESO-U03 2/1/2005-U04 ROBIN-U04 1959 035 CC RESOxJ×¥41° 53' East 68.05 feet; thence South 60° 08' 30" East 335.28 feet to the southwesterly prolongation of the northwesterly line of the land described In the deed to the La Puente Valley County Water Dis- trict recorded In Book 5148, Page 54 of Official Records of said County; thence along said prolong- ation North 41° 53' East 50.00 feet to the most westerly corner of the land described In said deed recorded In Book 5148, Page 54 of Official Records of said County; thence South 48° 07' East 357.72 feet; thence South 41° 53' West 100 feet; thence North 48° 07l West 182.20 feet; thence South 41° 53l West 153.85 feet to the true point of begin- ning, and WHEREAS, public hearings were duly held thereon by the Planning Commission and City Council and there were no protests; and WHEREAS, the evidence in the opinion of the City Council, shows facts which justify an exception for trailer park use but not a zone change, NOW, THEREFORE,the City Council of the City of Baldwin Park does find, determine and resolve as follows; Section 1. The application in Zone Case No. Z-57^ to rezone the above described property to M-l is denied. Section 2, The proposal of applicants to build a first-class trailer park on the property is necessary for the preservation of a substantial property right of the owner and will not be materially detrimental to the public welfare nor to the property of other persons in the vicinity. Section 3» An exception or variance is, there- fore, granted to build and operate such trailer park, subject to the following conditions: a) The trailer park shall be built substantially in accordance with the plot plan, marked Exhibit A", intro- duced in Zone Case No. Z-57. b) In order to handle the increased traffic that this development will 2- BIB] 38385-U01 1959-U02 035-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52525-U03 DO61318-U03 C6-U03 RESO-U03 2/1/2005-U04 ROBIN-U04 1959 035 CC RESOxJ×¥generate, a strip of land five 5) feet in width and adjacent to Big Dalton Avenue shall be dedicated to the City of Baldwin Park for street and highway purposes, c) The plans and specifications of the development are to be submitted to the City Engineer and his recommendations as to drainage and sewerage facilities shall be complied with. d) Curbs, gutters, sidewalks and pavement hook-up shall be installed on Big Dalfcon Avenue and Puente. e) Work on the development shall be com- pleted within one 1) year from the date of this resolution.
