HomeMy WebLinkAbout1960 025 CC RESO1960 025 CC RESO ZX ZPHÓ8RESOLUTION NO. 60-25 RESOLUTION DECLARING THAT PROCEED- INGS HAVE BEEN INITIATED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK TO ANNEX TO SAID CITY CERTAIN UNIN- HABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED ANNEXATION NO. 10, tt AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK: 1. That, pursuant to the provisions of the An- nexation of Uninhabited Territory Act of 1939^ proceed- ings have been initiated by the City Council of the City of Baldwin Park, on its own motion, to annex to the City of Baldwin Park all that uninhabited territory situate In the County of Los Angeles, State of California, hereby designated as Annexation No. 10" and described as fol- lows: Beginning at the intersection of the north- westerly line of the strip of land 25 feet wide, for Big Dalton Avenue, as described in deed recorded In Book 5168, Page 371 of Official Records, in the office of the Recorder of the County of Los Angeles, with the northerly line of Walnut Creek Wash, as described in deed to Los Angeles County Flood Control District, recorded in Book 10789^ Page 90 of said Official Records, said northerly line of Walnut Creek Wash being also the City of Baldwin Park boundary line as it existed February 9, I960; thence westerly along the northerly line of the land described in said last mentioned deed to the southeasterly line of Big Dalton Wash, 60 feet wide, as described in deed to said Flood Control District recorded in Book 784, Page 379 of said Official Records; thence southwesterly along said last described south- easterly line and southwesterly prolongation thereof, to the southwesterly line of Franclsqulfco Avenue, 60 feet wide as shown on map of El Monte Walnut Place, recorded in Map Book 6, page 104, in the office of said County Recorder; thence northwesterly along the southwesterly line of said Francisqulto Avenue to the northwesterly line of an easement for Walnut Creek Wash granted to the Los Angeles County Flood Control District by deed recorded in Book 2172, Page 83^ of said Official Records, thence southwesterly along said last described northwesterly line to the northeasterly line of Lot 18 of said El Monte Walnut Place; 1- BIB] 38238-U01 1960-U02 025-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52560-U03 DO52585-U03 C6-U03 RESO-U03 9/7/2004-U04 ROBIN-U04 1960 025 CC RESO ZX ZPHÓ8thence westerly along a direct line which passes through the Intersection of the northwesterly line of Vineland Avenue, 60 feet wide, as shown on Map of said El Monte Walnut Place, with the northerly line of Walnut Creek Wash as described in deed to said Flood Control District recorded in Book 7896, Page 226 of said Official Records to the southeasterly line of said Vineland Avenue; thence southerly in a direct line to the most northerly corner of Lot 111, Tract No. 20533^ recorded in Map Book 540, Pages 28 to 30, inclu- sive, in the Office of said County Recorder; thence in an easterly direction and following the northerly boundary line of said Tract No. 20533 to its common point between Lots 124 and 125 of said last mentioned tract; thence north- easterly along the northwesterly boundary line of said Tract No, 20533 and the northeasterly prolongation thereof to the intersection with the northeasterly line of said Pranclsquifco Avenue; thence southeasterly along said northeasterly line of Franclsqulto Avenue to the southeasterly line of the strip of land 15 feet wide, for Big Dalton Avenue, as described in Document No, 98305^ filed on June 18, 1926, under provisions of the Land Title Act, recorded in the office of said County Recorder; thence northeasterly, southeasterly, northeasterly and westerly along the boundary line of said City of Baldwin Park to the point of be- ginning. 2. That the City Council of the City of Baldwin Park desires to annex said uninhabited territory to the City of Baldwin Park for the following reasons: The ter- ritory is contiguous to the City of Baldwin Park, and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and con- tribute to the proper and orderly layout, design and con- struction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will prevlde and facilitate proper overall planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most con- ducive to the welfare of said City and said uninhabited territory, 3. That May- 2, I960, at the hour of 8:00 P.M., In the Council Chambers In the City Hall in the City of Baldwin Park, County of Los Angeles, Califor- nia, Is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Baldwin Park, and having any objections to the proposed annexation, may appear before the City Council of the City of Baldwin Park and show cause why such unin- habited territory should not be so annexed to said City of Baldwin Park, Such protest must be in writing, may be filed at any time before the hour set for hearing objec- tions to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description and area of such property, in general terms, 5. The City Clerk of the City of Baldwin Park is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Baldwin Park Banner News, a news- paper of general circulation published in said City of Baldwin Park, the city to which it is proposed to annex the aforesaid territory, and also in the San Gabriel Val- ley Tribune, a newspaper of general circulation published outside the City of Baldwin Park, but in the County of Los Angeles, California, the county in which is located the territory proposed to be annexed to the City of Baldwin Park, said publication to be complete at least twenty 20) days prior to the date set for hearing, 3- BIB] 38238-U01 1960-U02 025-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52560-U03 DO52585-U03 C6-U03 RESO-U03 9/7/2004-U04 ROBIN-U04 1960 025 CC RESO ZX ZPHÓ86. The City Clerk is further authorized and di- rected to cause written notice of such proposed annexation to be mailed to each person to whom land within the ter- ritory proposed to be annexed is assessed in the last equalized county assessment roll available on the date the above said proceedings were Initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an Interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty 20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such pro- posed annexation to be mailed to the Board of Supervisors of the county, such notice to be given not less than twenty 20) days before the first public hearing on the proposed annexation. 8. In the event there Is, upon the land proposed to be annexed, a structural improvement owned, being ac- quired or leased by a county fire protection district, the said Clerk Is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten 10) days before the first public hearing upon such proposed annexation, 9. The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
