RESOLUTION NO. 60"(
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK FIXING
SALARIES FOR THE YEAR 1960-61,
ESTABLISHING A CLASSIFICATION AND
PAY PLAN, PRESCRIBING THE TIME AND
METHOD OF PAYMENT, AND PROVIDING
FOR CONDITIONS OF EMPLOYMENT.
The City Council of the City of Baldwin Park does resolve, declare,
determine and order as follows:
SECTION I. COMPENSATION OF ELECTIVE OFFICERS. Elective Officers
shall be compensated as provided by law, which, for the sake of convenience,
is set forth as follows:

1. Mayor $ 75,00 per month

SECTION 2. SALARIES OF APPOINTIVE OFFICERS AND EMPLOYEES. The
salaries of appointive officers and employees, not otherwise prescribed, shal
be as to I lows, effective July I, 1960:

SECTION 5. EXPLANATION OF CLASSIFIED PAY PLAN. The pay plan for the
classified series shall be applied as follows:
A. SCHEDULE NUMBERS. The column headed Schedule Numbers"
contai ns a list of the scheduIe numbers assi gned to the various
positions in the classified series.
3. PAY STEPS. The columns headed A", B", C", D" and
E" and entitled Pay Steps," contain the basic monthly salary rates
for each of the positions in the classified series. Step A" represents the
starting level of pay. After six 6) months of satisfactory service has been
completed, the pay shall be advanced to Step S"; thereafter, the pay shall be
advanced to the next higher step after one I) year of satisfactory service in
the current step, provided the Department Head recommends and the Chief
Administrative Officer approves such advancement.
C. SALARY ADJUSTMENT 1960-61- The column headed Salary
Adjustment 1960-61" contains the salary increase to be added to the applicable
pay steps during fiscal year 1960-61.
D. ANNIVERSARY DATES. The period of satisfactory service
toward step advancement shall begin on the anniversary date. Anniversary dates
shall fall on the 1st or 15th day of the month for all entry steps, step increases,
reclassificatlon or promotions, whichever is closest to the actual date the
employee commences work or is advanced. Any doubt shall be resolved in the
employees favor.

Z P I ; 8E. RECLASSIFICATION /\ND PROMOTION. Any employee who is reclassified
or promoted to a position having a higher schedule number than the
position he occupies shall commence work in the higher schedule at a
pay step that is at least one step above the rate of pay he was re-
ceiving when reclassified or promoted. Conversely, any employee who
is reclassified downward shall begin work in the lower schedule at a
pay step equal to the rate of pay he was receiving when reclassified.
SECTION 4. DIFFERENTIAL PAY. Whenever the work week for any officer
or employee consists of one of the following, the basic salary for such officer
or employee shall be adjusted as hereinafter indicated,
ASSIGNMENT ADD

2. Investigator or Detective 5% of current salary
SECTION 5. PAY PERIODS. There shall be two pay periods in every
month. The first pay period shall be from the 1st through the I5th of the month;
the second pay period shall be from the I6th through the last day of the month.
SECTION 6. DATES WHEN SALARIES ARE TO BE PAID. Salaries and
compensation earned during the second pay period shall be paid on the 5th day
of the following month; salaries and compensation earned during the first pay
period shall be paid on the 20th day of the month. When City offices are to
be closed on the 5th or 20th days of the month, salaries and compensation shall
be paid on the next preceding day on which City offices are open.
SECTION 7. MANNER OF PAYMENT^ All salaries and compensation due
officers and employees shall be paid by warrant drawn against funds on deposit
i n a locaI bank.
SECTION 8. HOURLY RATE. Any officer or employee who works less than
a full pay period shall be paid at an hourly rate of pay computed as follows:

rate of pay,
SECTION 9. CONDITIONS OF EMPLOYMENT-^

for those officers and employees required to work
more, less or different hours or shifts as a regu-

3. WORK \A/EEK. The normal work week shall consist
of f i've 5) con sec ut ive work days fo! lowed by two
2) consecutive days off. Unless otherwise specified,
the work week shall begin on Monday, with Saturday
as the first day off and Sunday as the second day off.
C. EXTRA HOURS. A Department Head may require any
emp1oyee in his department to work additional hours,
including holidays, as may be required by public
necessity or convenience. The Chief Administrative
Officer may require any Department Head and employee
to work additional hours, including holidays, as may
be required by public necessity and convenience.
D. ATTENDANCE. Department Heads and employees shall
be in attendance at their work during regular working
hours as required by this resolution. At 1 departments
shall keep daily attendance records of employees on
forms prescribed by the Chief Administrative Officer.
E. EXCUSED ABSENCES DURING DAY. The Chief Administrative
Officer may excuse Department Heads and employees from
work for any part of a work day without loss of pay.
F< LEAVES OF ABSENCE. Leaves of absence without pay may
be granted by the Chief Administrative Officer for periods
of not to exceed ten 10) work days. Any leaves of absence
in excess of ten 10) work days shalI require the consent
of the Ci ty Counc1 I.
G. UNAUTHORIZED ABSENCES. Unauthorized absences for more
than eight 8) hours may lead to discharge.
H. RESIGNATIONS. Any Department Head or employee who
resigns from the City service shall give the Chief
Administrative Officer at least two 2) weeks' written
not ice.

Z P I ; 81- SUSPENSIONS AND DISCHARGES. Suspensions and dis-
charges shall be for just cause. However, suspended
or discharged officers and employees shall have no re-
course against the City or officials responsible for such
act Ion.
SECTION 10. OVERTIME. Any employee required to work overtime shall
be compensated by equivalent time off with pay as full compensation for the over-
time worked. However,
1. The Chief Administrative Officer and Department
Heads shall receive no compensation whatsoever for overtime;
2. Members of the Street Department and Custodial
personnel shall be paid one and one-half times their pre-
scribed rate of pay for overtime; and
5. Police Officers shall be paid their prescribed
rate of pay for overt ime, except on holidays, they shall
receive an extra day's pay.
Overt 1 me sha i1 consist of work performed by an employee at t imes
other than those normally required for his employment, or on a holiday to which
he is entitled. Police officers and Dispatcher Clerks shall receive holiday
overtime pay for holidays that fall on their regular day off. Such holiday pay
shall not be granted if the norma t work scheduIe of police personne1 permi ts
regular holiday privileges or if such holidays fall on Saturday or Sunday. For
holidays failing on Sunday, police personnel, entitled to holiday pay, shall
receive an extra day's pay if the general City offices are closed the following
Monday.
It is the policy of the City that overtime work is to be discouraged.
It should be required only in case of an emergency or whenever the public in-
terest or necessity requires.
No time off shall be taken or compensation paid for overtime without
a request therefor in writing and the approval thereof by the Chief Administrative
Officer.
SECTION 11. MILEAGE ALLOWANCE. Every officer or employee required to
use a private automobile in the discharge of his duties shall be entitled to re-
ceive compensation for mileage traveled at such rate as may be prescribed by
resolution of the City Council. Where no rate is prescribed, the rate of seven
7) cents per mile shall be paid therefor- All personnel who request compensation
at the rate of seven 7) cents per mile shall report their mileage on forms to be
furnished by the Finance Officer. Such mileage shall be subject to the Finance

SECTION 12. UNIFORM ALLOWANCE. Regularly sworn police personnel
shall receive in addition to their regular compensation a uniform allowance
of $60.00 per year, payable semi-annua1 Iy. Police personnel terminating or
resigning prior to completion of six months service after July I, 1960, or
prior to completion of six months service, in the case of a new employee, shall
not be entitled to receive accrued un i form a 1lowance, Pol ice personneI termina-
ting or resigning after six month^s service shall receive their prorated accrued
uni form o!lowance as part of their termination pay.
SECTION 15. CLOTHING REIMBURSEMENT, in the event any employee
of the Police Department of the City loses or damages personal clothing or
property in the discharge of his employment and in the line of duty, he may
receive such an amount of money as will compensate him for the loss or
damage, upon recommendation of the Chief of Police approved by the hief
Administrative Officer.
SECTION 14. HOLIDAYS. The holidays referred to herein shall be
thoseauthorized by Section 2602 of the Baldwin Park Municipal Code.
SECTION 15. VACATION LEAVE, Leaves of absence with pay for vacation
purposes shall be granted as follows:
A. VACATION ALLOWANCE. All full time officers and
employees shall be entitled to one I) work day vacation for
each calendar month, or major portion thereof, of service.
Vacation credits may be accumulated for a maximum of twenty
20) work days. However, not more than fifteen 15) work days
may be taken at one time without prior approval of the City
Council. Pursuant to Section 58654 of the Government Code of
the State of California, every member of the police force
shal1 be g i ven an annua1 vacat ion of at least f i fteen 15)
calendar days with pay notwithstanding anything in this
Section to the contrary.
B. WHEN VACATIONS MAY BE TAKEN. No vacation shall be
taken until the officer or employee has worked for the City
continuously for six months. Department Heads shall schedule
all vacations with due regard for the wishes of the employee
and particular regard for the needs of the service.

Z P I ; 8C. ACCUMULATED VACATION ALLOWANCE MUST BE USED AT ONE TIME.
Accumulated vacation allowance must be used at one time. The
Chief Administrative Officer, under appropriate circumstances,
may permit a modification of this requirement, if so requested
or the needs of the service require.
D. HOLIDAYS OCCURRING DURING VACATION. When a legal
municipal holiday falls within a vacation leave period, such
day or days shall not be charge against the vacation allowance.
E. TERMINATION OF EMPLOYMENT. If an officer or employee
with accrued vacation leave is separated from his employment
with the City, he shall be paid for such accrued leave at his
current rate of pay.
SECTION 16. SICK LEAVE. Leaves of absence with pay for injury or
ness shall be granted as follows:
A. SICK LEAVE ALLOWANCE. All full time officers and
employees shall be entitled to one I) work day sick leave for
each calendar month of service, or major portion thereof. Un-
used sick leave may be accumulated to a total of not to exceed
sixty 60) work days.
B. WHEN SICK LEAVE MAY BE TAKEN. Use of sick leave
shal1 not begin untiI the officer or employee has worked for
the City six months on a full time basis. Sick leave shall
be taken only in case of necessity and actual sickness or
disability of the officer or employee as determined by the
Chief Administrative Officer. The officer or employee taking
sick leave shall notify his Department Head or, if there is
no Department Head, the Chief Administrative Officer) prior
to or within four 4) hours after the time set for beginning
his daiIy dut ies.
C. RETURN FROM SICK LEAVE. Upon returning from sick leave,
If absent one I) day or more, the officer or employee shall file
with his Department Head or. If there is no Department Head,
the Chief Administrative Officer) a physician's certificate or
a personal affidavit stating the cause of absence.
D. USE OF SICK LEAVE BEFORE EARNED. Sick leave may not
be used until it is earned.

Z P I ; 8E. TERMINATION OF EMPLOYMENT. No compensation shall be
paid for unused sick leave when the employment of an officer
or employee is terminated,
SECTION 17. DEATH OR ILLNESS OF MEMBER OF IMMEDIATE FAMILY.
When circumstances are such and the Chief Administrative Officer determines
that conditions warrant he may authorize an officer or employee to use up to
t-iree 5) days of accrued sick i eave for an absence necessi fated by a serious
illness to or the death of a member of the immediate family of the officer or
employee. For the purpose of this provision, the term member of the immediate
famiIy" is Iimifed to:
1) Any relative by blood or marriage who is a member
of the officer or employee's household;
2) Any parent, spouse, child, brother or sister of
the officer or employee, regardless of place of residence; and
SECTION 18. ON THE JOB INJURIES. Whenever any person is compelled
to be absent from his employment with the City on account of injury arising
out of and in the course of his employment as determined by the Workman^
Compensation Act, he shall receive his full salary for the first week of
absence. Thereafter, he may elect to apply pro rated accrued sick leave,
If any, to such absence and to recei ve compensat ion therefor In an amount
equal to the difference between the compensation received by him under the
Workman's Compensation Act and his regular City pay, not to exceed the amount
of his earned sick leave. An employee in such instance, may also elect to
use any earned vacation time and equivalent time off for overtime In like
manner after his sick leave is exhausted.
SECTION 19. Nothing contained in this resolution shall be construed
as guaranteeing to any employee or official of the City any vested interest
In any salary or position. Furthermore, nothing contained herein is intended
to prevent the City from terminating the employment of any employee or officer
of the City at any time. This resolution may be changed or modified at any
time by the City Council.
SECTION 20. Resolution No. 59-70, adopted July 20, 1959, and alt
resolutions, or portions thereof, that are in convlict with the provisions
of this resolution are hereby repealed, except Resolution No. 60-60.
