HomeMy WebLinkAbout1960 102 CC RESO1960 102 CC RESOxJê˜RESOLUTION NO. 60-102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OP BALDWIN PARK GRANT- ING A ZONE EXCEPTION TO SIERRA LODGE AND HARTLAND HOSPITAL TO OPERATE A SANATARIUM AND HOSPITAL, RESPECTIVELY, AT FRANCISQUITO AND PUENTE AVENUES, ZONE CASE ZE-34. WHEREAS, Sierra Lodge and Hartland Hospital operate a sanitarium and hospital, respectively, at Franclsquito and Puente Avenues, In the City of Baldwin Park, County of Los Angeles, State of California, on real property, zoned R-l, and containing approximately 5.2 acres, described as follows: Those portions of Lot 26 of El Monte Walnut Place, in the City of Baldwin Park, County of Los Angeles, State of California, as shown on map recorded in Book 6, page 104, of Maps on file in the office of the County Recorder of said County, described as follows: Parcel I: Beginning at a point in the northeasterly line of said lot distant north 48 degrees 07 minutes west 622.76 feet from the most easterly corner of said lot; thence parallel with the southeasterly line of s^id lot, south 4l degrees 53 minutes west 300 feet; thence par- allel with said northeasterly line north 48 degrees 07 minutes west 304,60 feet to the northwesterly line of said lot; thence along said northwesterly line north 41 degrees 53 minutes east 300 feet to the northeasterly line of said lot; thence along said northeast- erly line south 48 degrees 07 minutes east 304.60 feet to the point of beginning. Parcel 3: Beginning at the intersection of the southwesterly line of the northeasterly 300 feet measured along or parallel with the southeasterly line of said lot), with the northwesterly line of said lot; thence south- easterly parallel with the northeasterly line of said lot, 150 feet; thence southwesterly parallel with the northwesterly line of said lot, 125 feet; thence northwesterly parallel with said northeasterly line, 150 feet to a point in said northwesterly line; thence northeasterly 125 feet to the point of begin- ning. Parcel 4: Beginning at a point in the northeast- erly line of said lot distant north 48 degrees 07 minutes west 411.36 feet from the northeast corner of said lot; thence north 48 degrees 07 minutes west 108 feet; thence parallel with the southeasterly line of said lot south 41 degrees 53 minutes west 300 feet; thence par- allel with said northeasterly line south 48 degrees 07 minutes east 108 feet; thence par^ allel with said southeasterly line north 4l degrees 53 minutes east 300 feet to the point of beginning. Parcel 5s Beginning at a point in the northeasterly line of said lot distant north 48 degrees 07 minutes west 519.36 feet from the northeast corner of said lot; thence north 48 degrees 07 minutes west 108 feet; thence parallel with the southeasterly line of said lot south 41 degrees 53 minutes west 300 feet; thence parallel with said northeasterly line south 48 degrees 07 minutes east 108 feet; thence par- allel with said southeasterly line north 4l degrees 53 minutes east 300 feet to the point of beginning; and WHEREAS, said property was recently annexed to the City, and the City Council Initiated a zone exception proceeding to permit said sanitarium and hospital to con- tinue operating under the City's zoning ordinance; and 2- BIB] 38401-U01 1960-U02 102-U02 CC-U02 RESO-U02 LI3-U03 FO52524-U03 FO52560-U03 DO62338-U03 C6-U03 RESO-U03 2/15/2005-U04 ROBIN-U04 1960 102 CC RESOxJê˜WHEREAS, the Planning Commission duly held a public hearing on said exception after giving requisite notice thereof and has recommended that the exception be granted, subject to certain conditions; and WHEREAS, the City Council duly held a public hearing on the granting of said exception after giving requisite notice thereof; and WHEREAS, there were protests at both hearings, NOW, THEREFORE, the City Council of the City of Baldwin Park does find, resolve and determine as follows: Section 1. That exceptions are hereby granted to said Sierra Lodge and Hartland Hospital, respectively, to continue operation of a sanatarium on the Sierra Lodge property and a hospital on the Hartland Hospital property and to expand said uses as shown on a plan filed with the Planning Commission and marked Exhibit A11, subject, however, to the following conditions; 1. That development of the said properties shall be substantially in accordance with said plan marked Exhibit A". 2. That all new construction shall be in accordance with the regulations of the State Fire Marshal, the State Department of Health, and the City's ordinances, 3. That a paved off-street parking area shall be provided on the properties, with paved Ingress and egress and a ratio of one 10' x 20' space per each four 4) patients and employees. 4. That a masonry wall six 6) feet above the final grade of said parking areas shall be constructed along the entire south- erly boundary of the properties. 6. That all lights on said properties shall be deflected from the adjoining residen- tial properties as required by the City Engineer 7. That said exceptions shall terminate and become void if any condition thereof, or any statute or ordinance applicable thereto, is violated. Section 2. That said exception is necessary for the preservation of a substantial property right of the owners and will not be materially detrimental to the public welfare nor to the property of other persons lo- cated in the vicinity.
