HomeMy WebLinkAbout1961 039 CC RESO1961 039 CC RESOxJìRESOLUTION NO. 61-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK GRANTING A ZONE EXCEPTION TO THE BISHOP OF THE PROTESTANT EPISCOPAL CHURCH IN THE DIOCESE OP LOS ANGEIES, A CORPORATION SOLE, ON THAT PROPERTY LOCATED ON MAUPIN AND GIARK STREETS, IN THE CITY OF BALDWIN PARK, CALIFORNIA, DESIGNATED AS CASE NO. ZE-40. THE CITY COUNCIL OF THE CITY OF BAUDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Baldwin Park does hereby find, determine and declare; a) That an application was duly filed for a zone exception to expand the existing church facilities located at Maupin and dark Streets in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as: That portion of Section 17, Township 1, South, Range 10 West, also portion of licensed survey 22-39L as follows commencing at a point 127.32 feet from the East line of Maine Avenue, 70 feet wide) on the northerly line of dark Street 50 feet wide) thence northerly 250 feet with a uniform depth of 127.32 feet, b) That the Planning Commission and the City Council of the City of Baldwin Park, held public hearings on the said appli- cation. That as a result of said hearings, it was found and deter- mined that the said zone exception is necessary for the preservation of substantial property rights and that such zone variance, if granted, would not be detrimental to the public welfare or to other property located in the vicinity of the subject property. SECTION 2. Pursuant to the above enumerated findings, the zone exception as requested in Case No. ZE-40, is hereby granted upon the following terms and conditions; a) That the property shall be developed substantially in accordance with the plot plan as submitted with the application. b) That the applicant dedicate five 5) feet abutting dark Street for street and highway purposes. c) That at such time as dark Street is widened, that applicant remove, at its own expense, that portion of the now existing building which is located in the area to be used for street purposes, as shown on said plot plan. 1- BIB] 38401-U01 1961-U02 039-U02 CC-U02 RESO-U02 LI3-U03 FO19677-U03 FO50397-U03 DO62388-U03 C6-U03 RESO-U03 2/15/2005-U04 ROBIN-U04 1961 039 CC RESOxJìd) That applicant install sidewalks in conformity with the City's specifications therefor; that the sidewalks to be placed on the Glark Street frontage shall be an extension of the existing sidewalk so as to intersect with the proposed sidewalk on Maupin Street, in accordance with said plot plan. e) That paved off-street parking area shall be maintained as required by Section 9100.741 of the Baldwin Park Zoning Ordinance. f) If any condition above enumerated, or any law, statute, or ordinance is violated, this zone exception shall auto- matically terminate and the privilege hereby granted shall lapse, SECTION 3.
