Home My WebLink About1968 184 CC RESO1968 184 CC RESO ×P#€˜ö RESOLUTION NO. 68-184 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CONFIRMING THE REPORTS OF THE SUPERINTENDENT OF STREETS THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the City Council of the City of Baldwin Park, pursuant to Section 5870, et seq., of the Streets and Highways Code, commenced pro- ceedings to cause the construction of certain improvements, to wit: sidewalk and drive approach, as set forth on said Reports of Work; and b) That a public hearing was held on said matters, and there- after, said City Council ordered said construction to be accomplished; and c) That sixty 60) days after said orders were served, the work has not been completed by the owners or possessors of the properties and the Superintendent of Streets caused the work to be done; and d) That the Superintendent of Streets did file with the City Council of the City of Baldwin Park his reports of such work, Resolution No. 68-166; and e) That said City Council conducted a noticed hearing to consider any protests or objections to the Reports of the Work; and f) That NO protests were made. SECTION 2. That the Reports of the Work of the Superintendent of Streets heretofore filed and above described, be and the same is hereby confirmed. SECTION 3. That the cost of the construction, as set forth in said Reports, shall be assessed against the properties therein described, which properties front upon the improvements so constructed. SECTION 4. That if such assessments are not paid within the time permitted by law the same shall constitute a special assessment and lien against the property therein described, in the amounts set forth in said Reports, which lien shall continue until the assessment and all interest thereon is paid. SECTION 5. That if the assessments are not paid within the time permitted, the City Clerk shall deliver a Notice of Lien, signed by the Superintendent of Streets, as provided in Section 5891 of the Streets and Highways Code of the State of California, to the County Assessor and Tax Collector, who, in accordance with applicable law, shall collect said assessment, together with all other taxes relating to such properties. SECTION 6. That the interest rate of six percent 6%) per annum is hereby fixed as the rate of interest to be paid to the City upon the amount due for unpaid assessments. SECTION 7.
