HomeMy WebLinkAbout1971 007 CC RESO1971 007 CC RESO(Ììæ:RESOLUTION NO. 71-7 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DE- TERMINING THE EXISTENCE OF A PUBLIC NUISANCE AND ORDERING THE SAME ABATED 70-N-87) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOE6 RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to Section 3200 et seq., of the Baldwin Park Municipal Code, proceedings have been initiated to determine whether certain premises, and buildings and structures thereon constitute a public nuisance; and b) That the property located at 3419-21 Frazier Street more particularly described as follows: Lot 10 of Tract No. 11045. 8551-1-26). c) That a duly noticed public hearing having been con- ducted, pursuant to Section 3203 et seq., of the Baldwin Park Municipal Code, to determine whether the buildinqs and structures on said property, in their present state, constitute a public nuisance; and d) That as a result of the evidence presented at said hearing, it was determined that the same does constitute a public nuisance, and that the public interest requires that the same be abated; and e) That the staff report, relating to this matter, is hereby approved and adopted by this reference. SECTION 2. That the owners of said property, or others having an interest therein, shall abate said nuisance in the manner set forth in the staff report, as approved by this City Council. If such abatement is not accomplished, as required hereby, within 90 days from the date here- of, the City Manager shall abate the same, as provided in Section 3208 et seq., of the Baldwin Park Municipal Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and cause copies hereof to be forwarded as prescribed by the Baldwin Park Municipal Code. LOCATION: 3419-21 Frazier Street II. III. IV. ZONING: R-l DESCRIPTION AND CONDITION OF PREMISES: Substandard structures and general yard cleanup INSPECTION REPORTS: 1. 2. 3. LOS ANGELES COUNTY FIRE DEPARTMENT: Violations of the City Fire Code are: 27.113, weeds and trash in the front and back yards and 13.27, unsafe building. The shed in the back yard is dangerous to human life due to dilap- idation. 13.26, vacant building. Any vacant building front house) shall be securely locked. LOS ANGELES COUNTY HEALTH DEPARTMENT: Violations are Sections 628, 808 and 809 of Ordinance 7583 of the Los Angeles County Health Code. Weeds, clothing, house- hold articles, two cars in yard area. Rear garage substandard by recent fire. Defective screens and windows. 3421 low roof, excessive amounts of debris in dwellings as well as outside. Recommend eliminate possible rodent harborage and repair or re- move substandard building. BALDWIN PARK POLICE DEPARTMENT: Location is insecure. for human occupancy. Large amount of debris. Posted unsafe BALDWIN PARK PLANNING DEPARTMENT: 4. Structure on property does conform to the general plan. Violations are: two structures on one lot, non-conforming old shed, disabled vehicles stored on property, weeds and debris. Recommend removal of vehicles, raze shed and general cleanup. BALDWIN PARK BUILDING DEPARTMENT: 5. Structure framing in bad condition. Hazardous electricc-1. Inad- equate and illegal plumbing. Shed posted 10/1/1970. House posted 10/7/1970. It is the opinion of this department l-hat it will not be economically feasible to bring this house to code, therefore complete demolition is recommended. It is recommended that the Public Nuisance be abated by the following: 1. Rehabilitate or demolish front residence. Pictures A, D and E. 2. Conduct general yard cleanup. All pictures. Note: One residence and burned shed have been demolished by persons unknown.
